1. Introduction and Acceptance

Welcome to GOATY ("GOATY," "we," "us," or "our"), a platform available at www.goaty.gg that provides interactive snack-culture games, including tier lists, world cup bracket games, polls, and related community features. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and the operator of GOATY.

By accessing or using the GOATY website, creating an account, or submitting any content, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must immediately discontinue use of the Service.

Your continued use of the Service following any modification to these Terms constitutes acceptance of the revised Terms. GOATY is operated as a sole proprietorship registered under the laws of the Republic of Korea. For all inquiries, contact us at [email protected].

2. Eligibility

You must be at least 14 years of age to use the Service. If you are under the age of majority in your jurisdiction, you represent that you have obtained the consent of a parent or legal guardian. GOATY does not knowingly collect personal information from children under 14, and accounts found to have been created by individuals under this age will be terminated upon discovery.

By using the Service, you represent and warrant that: (a) you meet the minimum age requirement stated above; (b) you have the legal capacity to enter into a binding agreement; and (c) your use of the Service complies with all applicable laws and regulations in your jurisdiction.

3. User Accounts and Registration

3.1 Account Creation via Third-Party OAuth

GOATY offers account registration exclusively through third-party OAuth authentication providers, including Google, Discord, Twitch, and GitHub (collectively, "OAuth Providers"). By registering via an OAuth Provider, you authorize GOATY to receive and store certain profile information from that provider, as detailed in our Privacy Policy.

Your use of any OAuth Provider is additionally governed by that provider's own terms of service and privacy policy. GOATY is not responsible for the practices of any OAuth Provider.

3.2 Account Responsibilities

You are solely responsible for all activity occurring under your account. You agree to: (a) maintain the security and confidentiality of your account credentials; (b) promptly notify GOATY at [email protected] upon any unauthorized access to or use of your account; and (c) provide accurate information in connection with your use of the Service.

GOATY reserves the right to suspend or terminate any account, with or without notice, where we reasonably suspect a breach of these Terms, fraudulent activity, or conduct harmful to other users or the platform.

3.3 Account Termination by User

You may request deletion of your account at any time by contacting us at [email protected]. Account deletion will result in the permanent removal of your account data, subject to any retention obligations described in our Privacy Policy. Certain content you have submitted—such as publicly shared tier lists—may, at our discretion, be retained in anonymized or de-attributed form to preserve the integrity of community-created content.

4. User-Generated Content

4.1 Ownership and License

The Service allows users to upload images, create tier lists, brackets, polls, and other interactive content (collectively, "User Content"). You retain full ownership of any intellectual property rights you hold in your User Content.

By submitting User Content to the Service, you grant GOATY a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, display, and distribute such User Content solely for the purposes of operating, maintaining, and improving the Service. This license does not confer on GOATY any ownership of your User Content, and we will not commercially exploit your personal creations outside of the Service.

4.2 Your Sole Responsibility for User Content

You are solely and exclusively responsible for all User Content you upload, submit, publish, or otherwise make available through the Service. This responsibility includes, without limitation, ensuring that your User Content: (a) does not violate any applicable law or regulation; (b) does not infringe any third-party intellectual property, privacy, or publicity right; and (c) complies fully with these Terms.

GOATY exercises no editorial control over User Content prior to its publication on the Service and does not assume any responsibility or liability for User Content uploaded by you or any other user. The fact that GOATY provides technical hosting for your content does not mean that GOATY endorses, verifies, or takes responsibility for that content.

4.3 Third-Party Intellectual Property in User Content

You acknowledge that many images and media files publicly available on the internet are protected by copyright, trademark, or other intellectual property laws. While GOATY does not prohibit the use of third-party material for non-commercial, personal creative expression in the spirit of fan culture (for example, a tier list of fictional characters), you represent and warrant that your use of any such third-party content is lawful under applicable copyright law, including any applicable fair use or fair dealing doctrine.

GOATY does not claim any ownership of, and expressly disclaims any liability arising from, third-party intellectual property incorporated into User Content. In the event a rights holder submits a valid copyright complaint, GOATY will act in accordance with its Copyright Policy set out in Section 11 of these Terms.

5. Prohibited Content and Conduct

5.1 Prohibited Content

You agree not to upload, post, transmit, or otherwise make available through the Service any content that:

• Is sexually explicit or pornographic, including nudity, sexual acts, or sexually suggestive material;
• Depicts or promotes graphic violence, including gore, torture, mutilation, or content that glorifies acts of violence against any person or animal;
• Constitutes hate speech or discriminatory content, including material that promotes, incites, or celebrates hatred, hostility, or discrimination on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic;
• Promotes, glorifies, or facilitates terrorism, extremism, or violent radicalization, including recruitment material, propaganda, or content that incites or plans acts of violence against any person, group, or government;
• Depicts or promotes illegal drug use, including the manufacture, trafficking, or glorification of controlled substances;
• Is defamatory, harassing, or threatening toward any individual or group;
• Exploits or endangers minors, including any depiction of child sexual abuse material (CSAM) or content that sexualizes minors in any form—such content will be reported immediately to the relevant law enforcement authorities;
• Constitutes troll content or targeted harassment, including brigading, doxxing, or coordinated efforts to harass or harm other users;
• Violates any applicable local, national, or international law or regulation; or
• Is otherwise harmful, offensive, or objectionable in GOATY's sole and reasonable discretion.

5.2 Prohibited Conduct

In addition to the content restrictions above, you agree not to:

• access, scrape, crawl, or index any portion of the Service using automated tools, bots, or scripts without GOATY's prior written consent;
• use the Service to collect user data without authorization or in violation of applicable privacy laws;
• attempt to gain unauthorized access to any account, server, or system associated with the Service;
• interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
• reverse engineer, decompile, or disassemble any portion of the Service;
• create a competing product or service that substantially replicates the features of GOATY using content, data, or functionality derived from the Service;
• impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
• use the Service for any unauthorized commercial purpose.

6. Moderation and Enforcement

6.1 GOATY's Right to Moderate

GOATY reserves the right—but not the obligation—to review, monitor, remove, or disable access to any User Content at any time, for any reason, without prior notice and without liability to you. This includes, without limitation, content that GOATY reasonably determines to violate Section 5 of these Terms or to be otherwise harmful to users, third parties, or the platform.

The absence of moderation action with respect to any particular piece of content shall not constitute GOATY's endorsement of that content or a waiver of GOATY's right to act against similar content in the future.

6.2 Account Suspension and Termination

GOATY reserves the right to suspend or permanently terminate your account, with or without prior notice, if GOATY determines in its reasonable judgment that:

• you have violated any provision of these Terms;
• your conduct poses a risk to other users, third parties, or the integrity of the Service; or
• you are a repeat infringer of intellectual property rights (see also Section 11.4).

GOATY's moderation decisions are made in good faith and at its sole discretion. GOATY is not liable for any loss or damage resulting from the suspension or termination of your account.

6.3 Reporting Violations

If you encounter User Content that you believe violates these Terms, you may report it to GOATY at [email protected]. GOATY will review all reports in good faith and take action where appropriate. Submitting a report does not guarantee that the reported content will be removed.

7. Platform Intellectual Property

All elements of the Service not constituted by User Content—including but not limited to the GOATY name, logo, brand identity, website design, interface elements, game mechanics, and proprietary software—are the exclusive intellectual property of GOATY and are protected by applicable intellectual property laws of the Republic of Korea and international conventions.

Nothing in these Terms grants you any right, title, or interest in GOATY's trademarks, trade dress, copyrights, or proprietary technology, beyond the limited right to use the Service as expressly permitted herein.

8. Advertising

GOATY displays third-party advertisements on the Service, including advertisements served through Google AdSense or similar advertising networks (collectively, "Ad Partners"). By using the Service, you acknowledge and agree that:

• GOATY and its Ad Partners may use cookies, web beacons, and similar tracking technologies to serve interest-based advertisements tailored to your browsing behavior and preferences;
• the collection and use of data by Ad Partners is governed by their respective privacy policies—we encourage you to review Google's Privacy & Terms for further information;
• you may opt out of personalized advertising through Google Ads Settings or through industry opt-out mechanisms such as the Network Advertising Initiative (NAI); and
• GOATY does not sell your personal information to advertisers.

GOATY does not endorse any product or service advertised through the Service. Advertisers are solely responsible for ensuring their advertisements comply with applicable law. GOATY reserves the right to remove or reject any advertisement at its sole discretion.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOATY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

GOATY does not warrant that: (a) the Service will be uninterrupted or error-free; (b) any defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) any content on the Service is accurate, reliable, or complete.

9.2 No Liability for User Content

GOATY expressly disclaims all liability for any User Content uploaded, transmitted, or otherwise made available by users of the Service. GOATY is not responsible for the accuracy, legality, or appropriateness of any User Content, and shall not be liable for any harm or damage resulting from your reliance on or exposure to User Content generated by other users.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOATY, ITS OPERATOR, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION—ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF GOATY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

GOATY's total cumulative liability to you for any and all claims arising from your use of the Service shall not exceed the greater of: (a) the total amount paid by you to GOATY in the twelve (12) months preceding the claim; or (b) USD $10.00.

10. Indemnification

You agree to defend, indemnify, and hold harmless GOATY, its operator, and any affiliated personnel from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your access to or use of the Service; (b) your User Content, including any claim that your User Content infringes a third-party intellectual property right, constitutes illegal material, or violates any applicable law; (c) your violation of these Terms; or (d) your violation of any third-party right.

This indemnification obligation applies regardless of whether GOATY was aware of the existence of the User Content in question prior to the claim being made.

11. Copyright Policy

11.1 Respect for Intellectual Property

GOATY respects the intellectual property rights of others and expects users to do the same. GOATY handles copyright complaints in accordance with the Copyright Act of the Republic of Korea, including the online service provider provisions under Articles 102 and 103, and related enforcement rules.

11.2 Submitting a Copyright Takedown Request

If you are a copyright owner or an authorized agent thereof and believe that any User Content on the Service infringes your copyright, please submit a written notice to [email protected] with the subject line "Copyright Takedown Request", containing all of the following:

• a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
• identification of the copyrighted work claimed to have been infringed, or a representative list of such works if multiple works are covered;
• identification of the allegedly infringing material and information reasonably sufficient to permit GOATY to locate it (e.g., a direct URL);
• your contact information, including name, address, telephone number, and email address;
• a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law; and
• materials reasonably showing that you are the rights holder or are authorized to act for the rights holder.

11.3 Restoration Request

If you believe that your User Content was removed in error or as a result of misidentification, you may submit a restoration request to [email protected] containing: (a) your physical or electronic signature; (b) identification of the material that was removed and its former location; (c) a short explanation of why you believe the content was lawful or removed by mistake; (d) materials reasonably supporting your right to use the content; and (e) your name and contact information.

Upon receipt of a valid restoration request, GOATY may notify the original complainant and may restore the removed content if the request appears valid and we do not receive information showing that continued removal is required.

11.4 Repeat Infringers

GOATY maintains a policy of terminating the accounts of users who are determined, in GOATY's reasonable judgment, to be repeat infringers of intellectual property rights. GOATY reserves the right to make this determination without prior notice.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy, which is incorporated by reference into these Terms and governs our collection, use, and disclosure of information you provide through the Service. By using the Service, you consent to the practices described in our Privacy Policy.

13. Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by GOATY. GOATY provides these links solely as a convenience and does not endorse, and is not responsible for, the content, privacy practices, or terms of any third-party website or service.

Your interactions with third-party services—including OAuth Providers, advertising networks, and external websites—are governed solely by the terms and policies of those third parties. GOATY shall have no liability arising from your use of any third-party service.

14. Modifications to the Service and These Terms

GOATY reserves the right, at any time, to modify, suspend, or discontinue the Service (or any portion thereof), with or without notice. GOATY shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

GOATY reserves the right to revise these Terms at any time. Material changes will be communicated to registered users via email or by a prominent notice on the Service. The revised Terms will be effective upon the date stated at the top of this document. Your continued use of the Service following any change constitutes your acceptance of the new Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms and any dispute arising from your use of the Service shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict-of-law provisions.

15.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Korea. Notwithstanding the foregoing, GOATY retains the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of its intellectual property rights.

15.3 Informal Dispute Resolution

Before initiating any formal legal proceedings, the parties agree to attempt to resolve any dispute in good faith through informal negotiation. Either party may initiate this process by sending written notice to the other party describing the nature and basis of the dispute. The parties shall have thirty (30) days from the date of the notice to attempt resolution.

15.4 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive any right to bring or participate in a class, collective, or representative action against GOATY.

16. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy and any other legal notices published by GOATY on the Service, constitute the entire agreement between you and GOATY with respect to the Service and supersede all prior agreements and understandings of any kind.

Severability. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver. GOATY's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer any of your rights or obligations under these Terms without GOATY's prior written consent. GOATY may freely assign these Terms in connection with a merger, acquisition, or sale of assets.

Language. These Terms are written in English. In the event of any inconsistency between the English version and any translation thereof, the English version shall prevail.
