Hyper Privacy Policy

This Privacy Policy explains how Hyper Labs Pty Ltd (“Hyper”, “we”, “us”, “our”) collects, uses, stores, and discloses personal information when you use the Hyper mobile application and related services (the “Services”).

We are committed to protecting your privacy and handling personal information in an open and transparent way, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Scope of This Policy

This Privacy Policy applies to:

  • The Hyper mobile applications (iOS and Android)
  • Hyper websites and related services
  • All users of the Services

This Policy should be read together with:

2. Personal Information We Collect

“Personal information” means information that identifies or could reasonably identify you.

2.1 Information You Provide

  • Content you post (photos, comments, reviews, check-ins)
  • Preferences and settings (e.g. visibility controls)

You may choose not to provide some information, but this may limit functionality.

2.2 Location Information

Hyper collects location-related information only in limited ways:

  • Check-in location: when you choose to check in to a place
  • Approximate location: to help surface nearby places or content

Important clarifications:

  • Hyper does not support live or continuous location tracking
  • Location is associated with a moment in time (a check-in)
  • You control visibility (Public, Followers, Private)
  • You may disable location access in your device settings

2.3 Automatically Collected Information

When you use the Services, we may automatically collect:

  • Device information (device type, OS version)
  • App version and configuration
  • Log data (IP address, timestamps, crash logs)
  • Usage data (features used, interactions)
  • Approximate location derived from IP (not precise GPS)

This information helps us operate, secure, and improve the Services.

2.4 Third-Party Authentication Information

Hyper uses Firebase Authentication. Depending on how you sign up, we may receive:

  • Email address
  • Unique user ID
  • Authentication tokens
  • Basic profile information from identity providers (if enabled)

We do not receive your passwords.

3. How We Use Personal Information

We use personal information for the following purposes:

3.1 Core Service Operation

  • Creating and managing user accounts
  • Enabling check-ins and content sharing
  • Displaying content based on visibility settings
  • Providing support and responding to enquiries

3.2 Safety, Moderation, and Integrity

  • Enforcing our Terms and policies
  • Detecting and preventing abuse, fraud, and misuse
  • Moderating content and responding to reports
  • Protecting users, places, and the platform

3.3 Improvement and Development

  • Analysing usage patterns
  • Fixing bugs and improving performance
  • Developing new features

3.4 Communications

  • Sending service-related notices
  • Responding to support requests
  • Providing updates about changes to the Services

We do not sell personal information.

4. Legal Basis and Consent

By using the Services, you consent to the collection, use, and disclosure of your personal information as described in this Policy.

Where required by law, we will seek additional consent (e.g. device-level location permissions).

We may disclose personal information to:

  • Public or follower-visible check-ins may be visible to others
  • Private check-ins are visible only to you

  • Comply with legal obligations or court orders
  • Respond to lawful requests from authorities
  • Protect the rights, property, or safety of users, Hyper, or the public

6. Overseas Disclosure

Hyper uses cloud services hosted by global providers. As a result, personal information may be stored or processed outside Australia (including in the United States and other jurisdictions).

We take reasonable steps to ensure overseas recipients handle personal information in a manner consistent with Australian privacy standards.

7. Data Storage and Security

We take reasonable technical and organisational measures to protect personal information, including:

  • Secure cloud infrastructure
  • Access controls and authentication
  • Encryption in transit and at rest where appropriate
  • Monitoring and logging for security events

No system is completely secure, and you acknowledge this risk.

8. Data Retention

We retain personal information only for as long as reasonably necessary to:

  • Provide the Services
  • Comply with legal obligations
  • Resolve disputes
  • Enforce our agreements

You may delete your account, subject to legal and operational retention requirements.

9. Your Rights

Under Australian privacy law, you may have the right to:

  • Request correction of inaccurate information
  • Request deletion of your account and content (subject to limitations)

Requests can be made through the app or our support channels.

10. Children and Minors

Hyper is intended for users aged 16 and over.

We do not knowingly collect personal information from children under 16. If we become aware that we have done so, we will take reasonable steps to delete the information.

11. Cookies and Similar Technologies

Hyper may use cookies or similar technologies on our websites to:

  • Maintain sessions
  • Analyse usage
  • Improve functionality

You can control cookies through your browser settings.

12. Payments and Financial Information (Future)

Payments are disabled at launch.

If payments are enabled in the future:

  • Transactions will be processed by third-party payment providers (e.g. Stripe)
  • Hyper will not store full credit card details
  • Additional privacy disclosures may apply

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated through the Services or other reasonable means.

Continued use of the Services after changes take effect constitutes acceptance of the updated Policy.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).
