Paper abortion, also known as a financial abortion, male abortion or a statutory abortion,[1] is the proposed ability of the biological father, before the birth of the child, to opt out of any rights, privileges, and responsibilities toward the child, including financial support. By this means, before a child is born, a man would be able to absolve himself of both the privileges and demands of fatherhood.

Some readers may understand that I’m making a statement here about what is called “philosophy of law,” and a very controversial one. More on philosophy of law below.

Little says, “the introduction of an affirmative consent standard would not only incentivize rational behavior on the part of both women and men in dating situations but that such a shift in the law would potentially shift public perceptions of women and their role in sexual relationships.” We’re unused to people actually bargaining around sex like rational people with interests, because there’s a social script. People have, basically, emotional objections to dealing with sex rationally. But it will not ruin sex!

Where do these objections come from?

The more we say with our laws that consent is the norm and its absence is aberrant, the more that becomes not just a feminist ideological point but the collective wisdom of the culture

There are all kinds of theoretical questions about creating an obligation to report, and I’ll leave those all aside. Let’s just look at it practically. Is reporting a sexual assault in a BDSM context likely to work? No, absent serious injuries or hospitalization, or video evidence, it’s hard to conclude that it’s likely to work. It’s hard to conclude that it will work even for relatively privileged people within BDSM communities, let alone the sorts of folks who can’t count on the cops for other reasons. So if it’s not all that likely to actually produce a conviction, the notion that we should pressure victims in the the criminal justice system is busted. It’s a derail, a way of throwing up a hurdle and washing hands of the allegation. Until it’s fixed (if it can be), it cannot be a mandatory part of any solution and we can’t count on it to save us from having to figure out how to deal with rape and abuse in BDSM communities ourselves.
