This Mercury B2B Privacy Policy describes how Mercury Technologies, Inc., together with its affiliates and subsidiaries (collectively "Mercury," "we," "our," or "us") collects, uses, shares, and protects the personal information of Mercury’s business customers, including businesses applying for and using our products or services, and Mercury’s business contacts, including Mercury’s partners and vendors (collectively, “you” or “your”).
This Mercury B2B Privacy Policy also tells you about your rights and choices with respect to your personal information, and how you can reach us to get answers to your questions.
If you are not a Mercury business customer or business contact, the privacy policy that was provided at the point of collection applies.
1. Information We Collect
We collect information about you in a variety of ways depending on how you interact with us and our websites, mobile applications, products, and services, including:
- Directly from you, such as when you register for an account, sign up to receive communications from us, or engage with us in a business capacity.
- Through the use of cookies, server logs, and other similar technologies when you interact with our websites, mobile applications, advertisements, and emails.
- From other sources, like information from our subsidiaries and affiliates, Business Partners, Service Providers, financial institutions, credit agencies, and other third parties, or from publicly available sources.

3. How We Share Information.

- Service Providers. We may disclose your Personal Data to service providers that support our core business functions, including, but not limited to, services providers that assist with processing payments and orders, maintaining databases, billing, providing credit, complying with governmental or quasi-governmental reporting, collection services, or customer service.
- Merchants. We may disclose your personal information to merchants with whom we do business for the purpose of delivering gift cards to you or other people or entities.
- Joint Promotions. We may disclose your personal information to affiliates or business partners for the purpose of offering joint promotions.
- Acquisitions. We do not sell your Personal Data. We only share and disclose your Personal Data with the third parties set forth in this section or as discussed in this Privacy Policy, such as with the use of cookies and similar tracking technologies for purposes of targeted advertising.
Sensitive personal information. We do not process “sensitive personal information” for purposes other than those specified in the CCPA Regulations section 7027(m) (such as to provide our products and services and for security purposes).

5. How You Can Control Your Information
Profile and data sharing settings. You may update your profile information, such as your username and profile photo, and may change some of your data sharing preferences on your Settings Page.
Access to your mobile device information. You may control our access to your mobile device information through the “Settings” app on your device. For instance, you can withdraw permission for our App to access your address book, location, photo stream and camera.
How to control your communications preferences. You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, and technical and security notices).
6. How We Protect Your Information
Data storage and transfer: Personal Data collected through our Services may be stored and processed in the United States or any other country in which Mercury or its affiliates subsidiaries, Business Partners, or Service Providers maintain facilities. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that with respect to “personal data” that you may provide to us, we serve as the “controller” and may transfer Personal Data to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. Where possible, we take steps to treat Personal Data using the same privacy principles that apply pursuant to the law of the country in which we first received your information, and in all cases, we shall put in place adequate safeguards to ensure your personal data has an equivalent level of protection. By using our services, you acknowledge and agree to such transfer of information to the U.S. or any other country in which Mercury or its affiliates, subsidiaries, Business Partners, or Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.
Keeping your information safe: We care about the security of your Personal Data and while we use reasonable efforts to protect your Personal Data from unauthorized access, use, or disclosure, cannot guarantee the security of your Personal Data. If we are required by law to inform you of a breach to your Personal Data, we may notify you electronically, in writing, or by telephone, if permitted to do so by law.
Links to other websites and services. Our Services may contain links to the third-party websites of our Business Partners, advertisers, and social media sites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. We strongly recommend that you read their privacy policies and terms and conditions of use to understand how they collect, use, and share Personal Data. Deidentified information. To the extent we process “deidentified” Personal Data, as defined under applicable law, we will maintain and use that information in deidentified form and will not attempt to reidentify the information except as permitted by applicable law.
