eDiscovery

MNIT’s eDiscovery Service identifies ESI sources and collects ESI data for internal processes and document review engagements for the agency’s paralegal, attorneys and other support staff.

Examples of eDiscovery engagements include:

• Court requests (subpoenas, court orders).
• Internal investigations.
• Litigation matters.
• Public data requests.

An eDiscovery effort may include activities such as:

• Scoping an eDiscovery request.
• Identifying evidence sources.
• Evidence collection.
• Processing evidence.
• Searching, sorting, and filtering data.
• Creation of deliverables in various file formats.
• eDiscovery expert testimony (if needed).
• Other activities as needed.

MNIT provides data to agency staff who enter it into the eDiscovery application and conduct any data manipulation required by the agency. 

eDiscovery requirements and service levels are set up between the agency and MNIT per each engagement.

• MNIT does not perform document review.
• MNIT provides consultation at no charge on potential requests, data preservation, and pre-request scoping to identify investigative viability and recommended actions.
• The eDiscovery Service is charged using the following rates which are based on a variety of factors including:
  • Data sources accessed.
  • Tools used.
  • MNIT staff time.

• Work with MNIT to define engagement requirements.
• Agencies are responsible for taking the data provided by MNIT, entering it into the eDiscovery application, and conducting any data manipulation required. 
• Alternatively, the agency can request eDiscovery Advanced professional services that are charged at an hourly rate. With this service level, MNIT enters data into the eDiscovery application and completes the required manipulation for the agency.
