The legal picture

Healthcare & Home Care screening: what the law requires and what it doesn’t

Florida writes a multi-state registry search into law: Level 2 screening includes the sex offender registries of any state the employee lived in during the preceding five years (Fla. Stat. § 435.04). Illinois requires nursing homes to screen residents within 24 hours of admission and to give a registered sex offender their own room (210 ILCS 45/2-201.5). These are the clearest examples of registry screening written into healthcare law.

Federal rules are thinner than vendor marketing suggests. Medicare home health conditions of participation (42 CFR 484.115) contain no aide-screening requirement, and the CMS National Background Check Program was a voluntary state grant that ended in 2024. Agencies screen because state law, payer contracts or liability require it — and because a caregiver’s registration in another state never shows up on an in-state check.

Home-care agencies feel the multi-state problem more than most employers. Caregivers often move between states and agencies, and a registration in another state never appears on an in-state criminal check.
