OtakuKart respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we respond to properly formatted takedown notices and will remove infringing material when legally required to do so.
Reporting Copyright Infringement
If you believe that any material available on or through OtakuKart.com infringes upon your copyright, you may submit a DMCA takedown notice by providing our designated Copyright Agent with the following information in writing (pursuant to 17 U.S.C. § 512(c)(3)): your physical or electronic signature; identification of the copyrighted work claimed to have been infringed, or a representative list of such works if multiple are involved; identification of the material you claim is infringing, including enough detail for us to locate it (a direct URL is preferred); your full name, mailing address, telephone number, and email address (if available); a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner. If your notice is incomplete or does not meet the legal requirements under Section 512(c)(3) of the DMCA, it may not be effective.
Counter Notification
If you believe that content you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our Copyright Agent. To be valid under the DMCA, your counter-notice must include: your physical or electronic signature; identification of the material that has been removed or disabled, and the location where the material appeared before removal; your full name, mailing address, telephone number, and email address (if available); a statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification; and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district where your address is located (or any judicial district where we may be found, if outside the U.S.), and that you will accept service of process from the person who filed the original DMCA takedown notice or their agent. Once a valid counter-notification is received, we may restore the content unless the original complainant files a court action within ten (10) business days.
Repeat Infringer Policy
OtakuKart reserves the right to disable or terminate accounts, access, or contributions from users who are determined to be repeat infringers of copyrighted content, consistent with Section 512(i)(1)(A) of the DMCA.
