To use certain features of our Service, you may be required to create an account. You are responsible for safeguarding your account information and for any activities or actions under your account. You agree not to disclose your password to any third party.

• 2A.1. 

  Description of the Chat Services

  The Service includes an AI-powered chat feature that allows you to exchange messages with virtual, fictional characters generated by artificial intelligence ("AI Companions" or "Characters"). Exchanges with AI Companions may include text, images, voice, video, and other media formats as made available by us from time to time (the "Chat Services").

  You may interact with pre-made Characters that we make available on the platform, or configure Characters by selecting attributes and characteristics through our tools. We may add, modify, de-list, or delete any Character, feature, or content at any time at our sole discretion.

• 2A.2. 

  Fictional Nature of AI Companions

  All conversations between users and AI Companions are entirely fictional and must be treated as such. AI Companions are artificial intelligence characters designed to simulate human-like interaction; they do not possess genuine emotions, intentions, memory of the real world, or the ability to fulfill promises or take actions outside the Service.

  Any elements of a conversation that may resemble reality, including offers of real-life meetings, declarations of feelings, or promises of tangible outcomes, are fictional outputs and must not be relied upon. We assume no responsibility for any confusion, expectation, or belief extending beyond the digital environment of the Service.

  All Characters portrayed in the Chat Services are intended to be, and must at all times be treated and depicted as, adults over the age of 18.

• 2A.3. 

  Entertainment Purposes Only

  The Chat Services are provided for adult entertainment purposes only. They are not intended as, and do not constitute, emotional support, companionship therapy, medical care, mental health services, or any other professional service. We make no claims, representations, warranties, or guarantees that the Chat Services provide any therapeutic benefit.

  If you are experiencing distress, mental health difficulties, or thoughts of self-harm, please stop using the Service and contact a qualified professional or an emergency service in your region. The Service must not be used in emergency situations.

• 2A.4. 

  AI Outputs

  The Chat Services rely on emerging AI technology. Outputs may be inaccurate, incomplete, inconsistent, unexpected, or not reflective of human judgment, and may not match your preferences or expectations. You are responsible for evaluating the appropriateness of any output before relying on, sharing, or otherwise using it.

  Our moderation systems may alter, block, or decline to fulfill a request before an output is generated, including where the request contains or seeks content prohibited under these Terms.

• 2A.5. 

  Privacy and Moderation of Conversations

  Conversations between users and AI Companions are generally treated as private and are not made publicly visible unless you deliberately use a feature that publishes or shares them.

  We operate automated content moderation systems, which may include proprietary and third-party classifier and LLM-based technology, to ensure compliance with these Terms, our Community Guidelines, and applicable law. Where our systems flag content as potentially violating, we or our authorized partners may access and manually review the flagged content and related context, and take appropriate action, including altering or blocking outputs, removing content, restricting or terminating the account, preserving relevant records, and reporting to competent authorities where required or permitted by applicable law.

  Do not disclose financial details, government identifiers, passwords, addresses, contact information, or other sensitive personal information that you do not want processed through the Chat Services. Further information about how Chat Content is collected, used, shared, retained, and protected is provided in our Privacy Policy.

• 2A.6. 

  Additional Prohibited Uses of the Chat Services

  In addition to Section 3, you agree not to use the Chat Services to create, request, upload, share, roleplay, or otherwise engage with any content that:

  • depicts, describes, sexualizes, or solicits sexual content involving any person under the age of 18, whether real, fictional, AI-generated, text-based, edited, or otherwise manipulated;
  • includes text-based sexual roleplay involving minors, Characters described or presented as under 18, "age regression" or similar scenarios, or Characters whose stated or apparent attributes indicate an age below 18;
  • creates or configures a Character based on the name, image, voice, likeness, or persona of any real, identifiable person, including a public figure or celebrity, without explicit and verifiable consent from that person;
  • impersonates any real person or entity, or misrepresents AI-generated conversations as communications with a real person;
  • infringes the intellectual property, privacy, publicity, or other rights of any person; or
  • otherwise violates applicable law, these Terms, or our Community Guidelines.

  Violations involving apparent child sexual abuse material or child sexual exploitation may result in immediate account termination, preservation of associated records, and reporting to competent authorities and child protection organizations as required or permitted by applicable law.

• 2A.7. 

  Message Economics

  Use of the Chat Services consumes Tokens and/or is subject to plan limits, as indicated within the platform at the time of use, including on a per-message, generated-image, voice, video, model, or feature basis.

  Rates and limits may vary by feature, model, and plan and may change from time to time. Free-tier limits, where offered, are provided at our discretion and may be modified or withdrawn at any time.

  Cancellation of a subscription does not by itself cause separately purchased unused Tokens to expire, provided that the account remains active and unless otherwise specified during purchase.

• 2A.8. 

  Chat Content, Characters, and Outputs

  "Input" means anything you submit to the Chat Services, including prompts, messages, uploaded materials, settings, and Character configurations. "Output" means content generated by the Chat Services in response to your Input, including AI Companion messages, images, video, voice, and other media. Input and Output are collectively referred to as "Chat Content."

  You retain any intellectual property rights you hold in your Input.

  All rights, title, and interest in and to the AI Companions and Characters made available on or generated through the Service, including their names, personas, visual representations, underlying prompts, configurations, and associated data, belong exclusively to us. Creating or configuring a Character does not grant you any ownership interest in it.

  By using the Chat Services, you grant us a non-exclusive, royalty-free, fully paid-up, transferable, sub-licensable, worldwide license to use, host, store, reproduce, modify, and otherwise process your Chat Content as necessary to operate, provide, secure, maintain, moderate, and improve the Service; enforce these Terms and our policies; respond to support requests; and comply with applicable law.

  We will use private Chat Content to train or improve generative AI models only in accordance with our Privacy Policy, applicable data protection law, and the consent controls made available through the Service. Private Chat Content will not be used for public display or marketing unless you deliberately publish or share it, enable a setting that clearly permits that use, or separately consent to that use.

  Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Outputs generated within the Chat Services through your account for your personal, non-commercial purposes. Any commercial use of such Outputs requires our prior written consent.

  AI-generated Output may not be unique and may not qualify for copyright or other intellectual property protection. We do not guarantee that any Output is original, protectable, accurate, or non-infringing.

• 2A.9. 

  Reporting

  You may report concerning content, a Character, or behavior through the reporting tools provided within the Service or by contacting support@pornx.co

• 8.1. 
  "User-Generated Content" refers to all content created by you, including but not limited to images and prompts ("User Prompts"). The term 'Prompts' includes both the prompt text and any user input settings associated with it.
• 8.2. By using the Service to create User-Generated Content, images and prompts, you retain the ownership rights to those content.
• 8.3.1. 
  However, by using the public mode of the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and transferable license to host, reproduce, distribute, and create derivative works of the User-Generated Content in connection with the Service and our business, including for promoting the Service in any media formats and through any media channels.
• 8.3.2. 
  In fostering a collaborative environment, you also grant each user of the Service a non-exclusive, royalty-free, worldwide license to access your User-Generated Content through the Service, and to use, reproduce, distribute, and create derivative works of such content. This usage should abide by the principles of this community and maintain a spirit of openness, collaboration and respect.
• 8.3.3. 
  Our Service encourages the exchange of ideas and creativity within our community. By contributing your User-Generated Content, you are granting others the opportunity to build upon and draw inspiration from your works, while still retaining the copyright to your original creations.
• 8.3.4. 
  Keep in mind, your User-Generated Content is yours. You are simply granting a license for us and others to use them, but you still hold the copyright to your creations.
• 8.4. 
  If you choose to use the private or offline mode of our Service, we do not assert any rights to your User-Generated Content (images and prompts) and do not use them for any public or commercial purposes. You remain the sole owner of your content, with full rights reserved.
• 8.5. 
  We are closely monitoring the ongoing legal debates regarding copyright and intellectual property rights for AI-generated content in various jurisdictions. We encourage all users to understand their rights and responsibilities under their local laws as well as international law.
• 8.6. 
  You represent and warrant that you have all rights necessary to submit the User-Generated Content and you also represent and warrant that such User-Generated Content does not violate any proprietary or intellectual property rights, public rights, or any other applicable law.
• 8.7. 
  The use of automated systems or software to extract data from the Service for commercial purposes, ('screen scraping') is prohibited. We reserve the right to take necessary legal or other actions against any users found to be engaging in such behavior. This includes but is not limited to potential litigation and/or account suspension or termination.
• 8.8. 
  We reserve the right, but are not obligated, to remove or refuse to distribute any User-Generated Content on the Service. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of our users and the public.

You agree to defend, indemnify, and hold harmless PornX AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

This Terms of Service ("Agreement") shall be governed by and interpreted in accordance with the laws of the jurisdiction of the Spain, without regard to its conflict of law provisions. The parties irrevocably agree that any legal proceeding seeking the enforcement or interpretation of this Agreement shall be brought in the appropriate courts of the same jurisdiction.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
