Terms of Service

1. Acceptance of Terms
By downloading, installing, accessing, or using Plexon AI (the "Service"), operated by Hellenic Development ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.
2. Eligibility
You must be at least 13 years of age (or the applicable age of consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Service Description
Plexon AI is a multi-domain AI desktop assistant available as a desktop application. It connects to our stateless server for AI processing and supports multiple third-party AI providers. The server stores no user data between requests. Features, availability, and supported platforms may change over time.
4. Account Registration
To access certain features, you may need to create an account or sign in using a third-party authentication provider such as Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
5. User Responsibilities
You are responsible for maintaining the security of your API keys and local data. You agree not to: use the Service for any unlawful purpose or to violate any applicable laws or regulations; attempt to gain unauthorized access to the Service or its related systems; interfere with or disrupt the integrity or performance of the Service; reverse engineer, decompile, or disassemble the Service except where permitted by law; use the Service to generate malicious code, malware, or content that violates the rights of others; or misrepresent your identity or affiliation.
6. API Keys & Third-Party Services
You are responsible for your own API keys and their usage costs. Plexon AI acts as a secure conduit to AI providers (Anthropic, OpenAI, Google, Qwen, etc.). You must comply with each provider's terms of service. We are not responsible for the availability, accuracy, or content of third-party AI responses, or for any charges incurred through third-party providers.
7. Intellectual Property
Code and content you generate using AI through Plexon AI belongs to you, subject to the terms of the underlying AI providers. The Plexon AI software, branding, logos, documentation, and website content are the property of Hellenic Development and are protected by applicable intellectual property laws. You may not use our trademarks without prior written permission.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, available at /privacy. Please review it to understand how we collect, use, and protect your information.
9. Service Availability & Modifications
We strive to maintain the availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
10. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. All locally stored data remains on your machine and under your control.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content is accurate, complete, or suitable for any specific purpose. You use AI-generated code and content at your own risk.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Hellenic Development shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Hellenic Development, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Greece. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Athens, Greece. Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hellenic Development regarding the Service and supersede all prior agreements and understandings.
