Swads is developed and operated by Sven, an independent developer ("we", "us", or "our"). These Terms of Use ("Terms") apply to the Swads public beta distributed through Apple TestFlight (the "App"). They also apply to the Swads website at swads.app (the "Website").
By installing or using the App, or by using the Website, you agree to these Terms. If you do not agree, do not install or use the App, and stop using the Website. If you are not legally able to agree to these Terms yourself, a parent or legal guardian must review and agree to them for you.
These Terms supplement the terms that apply to TestFlight and other Apple services. They do not replace any mandatory terms or rights provided by Apple or applicable law. Your use of Synology and other third-party services is also subject to their own terms.
1. Public Beta
Swads has not yet been released as a final product. The App is provided for public testing through TestFlight.
Beta software may contain bugs, incomplete features, inaccurate information, or unexpected behavior. A build may stop working or expire. Features may be added, changed, limited, or removed during testing. We may pause or end the beta at any time.
Do not rely on the App for critical operations. Keep appropriate backups and check important actions directly in Synology DSM when needed.
2. No Charge During the Beta
We do not currently charge for access to the public beta. If a TestFlight build displays a purchase, subscription, restore, or redemption flow, it is there only to test that experience. Transactions made in TestFlight use Apple's sandbox environment and do not create a real charge. They are not a sale of Swads or a promise of future pricing, plans, or features.
If Swads later offers paid products, the relevant App Store screen will show the price and included features before a real purchase. It will also show any billing period, renewal terms, or trial. We will update these Terms before or when real purchases become available.
3. Permission to Use Swads
Subject to Apple's applicable terms, we give you limited permission to use the App on Apple devices that you own or control. This permission is personal, non-exclusive, non-transferable, and revocable. It is for testing and personal use.
You may not sell, sublicense, redistribute, rent, or commercially exploit the App. You may not bypass access limits or security measures. You may not reverse engineer, decompile, disassemble, or try to extract the source code. This restriction does not apply where the law or an open-source license expressly allows the activity.
Swads, its design, code, branding, and Website content are owned by us or our licensors. These Terms do not transfer ownership to you.
4. Your NAS, Account, and Downloads
Swads is an independent client for Synology Download Station. Swads is not made, endorsed, or supported by Synology Inc. Synology, DSM, Download Station, and QuickConnect are names or marks belonging to their respective owner.
You are responsible for:
- the Synology NAS, network, and DSM account that you connect;
- keeping your devices, accounts, and credentials secure;
- confirming that your DSM account has the required permissions;
- reviewing important actions before Swads sends them to your NAS; and
- ensuring that your download tasks and downloaded content comply with applicable law and third-party rights.
Actions in Swads can affect Download Station on your NAS. For example, creating, editing, pausing, or deleting a task may change data managed by Download Station. Swads does not provide, select, or host the content you choose to download.
5. Third-Party Services
Swads depends on services and systems that we do not control. These include Apple TestFlight, iCloud, Keychain, Synology DSM, Download Station, QuickConnect, your network provider, and service providers used to operate the App and Website.
A third-party service may be unavailable, delayed, changed, or discontinued. This can affect how Swads works. We do not control a third party's service, content, security, or terms. We remain responsible for Swads to the extent required by law.
6. Privacy
Our Privacy Policy explains how the App and Website handle information. It includes information about NAS connections, device storage, iCloud and Keychain sync, TestFlight purchase testing, support messages, Website analytics, and feedback forms.
Please do not send passwords, private keys, or other sensitive information when contacting support or submitting feedback.
7. Feedback
You may choose to send bug reports, ideas, or other feedback. You keep ownership of your original feedback. You give us permission to use and adapt it to develop, test, document, and improve Swads. This permission is non-exclusive, worldwide, and royalty-free.
We may refer to feedback when explaining improvements to Swads. We will not intentionally publish your private contact details, credentials, or confidential material without your permission.
You confirm that you have the right to submit the feedback. Our use of it for these purposes must not violate another person's rights. We are not required to use or respond to feedback.
8. Availability and Changes
We aim to keep the beta useful. However, we do not promise that the App or Website will always be available, secure, complete, or error-free. Maintenance, testing, technical problems, security concerns, or third-party changes may interrupt access.
We may update the App, change compatibility requirements, limit a feature, or stop providing part or all of Swads. When practical, we will explain significant changes that affect testers.
9. Ending Your Use
You may stop using Swads at any time by deleting the App. You can also remove saved NAS connections before deleting it.
We may restrict or end access to the beta if you misuse Swads or interfere with its operation. We may do the same if you violate these Terms or create a security or legal risk. When these Terms end, the permission granted in Section 3 ends as well. Sections that should continue by their nature will remain in effect. These include ownership, feedback rights, disclaimers, and liability limits.
10. Beta Disclaimer
To the extent permitted by law, Swads is provided "as is" and "as available" during the beta. We do not promise that it will meet every need or work with every NAS or network setup. Compatibility may also change across versions of DSM, Download Station, iOS, iPadOS, and macOS.
Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
11. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss. This limit applies to loss arising from your use of, or inability to use, Swads. Examples include loss caused by a service interruption, an unavailable NAS, or a failed download.
This limitation does not apply where liability cannot legally be limited. It also does not remove responsibilities that applicable consumer, privacy, or product laws place on us.
12. Governing Law
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. This choice does not take away any mandatory protection that applies to you under the law of your place of residence.
Before starting formal proceedings, you and we agree to make a reasonable effort to resolve the issue by email.
13. Changes to These Terms
We may update these Terms when the beta, our practices, or applicable requirements change. The updated version will be posted on this page with a new "Last updated" date.
If a change materially affects testers' rights or responsibilities, we will use reasonable efforts to provide additional notice. Updated Terms apply from the date shown on this page. If you do not agree to an update, stop using Swads.
