THE CANADIAN FREE TRADE AGREEMENT IMPLEMENTATION ACT (LABOUR MOBILITY ACT AND REGULATED HEALTH PROFESSIONS ACT AMENDED)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

THE LABOUR MOBILITY ACT

1(1)

The Labour Mobility Act is amended by this section.

1(2)

The preamble is repealed.

1(3)

Section 1 is amended by striking out "of Chapter 7 (Labour Mobility) of the Agreement on Internal Trade" and substituting "found in domestic trade agreements".

1(4)

Section 2 is amended

(a) by repealing the definition "Agreement on Internal Trade"; and

(b) by adding the following definition:

"domestic trade agreement" means a domestic trade agreement within the meaning of subsection 16.1(1) of The Proceedings Against the Crown Act. (« accord sur le commerce canadien »)

Subsection 3(1) is amended

(a) in the section heading, by striking out "the Agreement" and substituting "domestic trade agreements"; and

(b) by striking out "Chapter 7 (Labour Mobility) of the Agreement on Internal Trade" and substituting "a domestic trade agreement".

1(6)

Clause 5(2)(a) is amended by striking out ", if the purpose of the measure is to achieve a "legitimate objective" as that term is used in Chapter 7 (Labour Mobility) of the Agreement on Internal Trade".

THE REGULATED HEALTH PROFESSIONS ACT

C.C.S.M. c. R117 amended

2(1)

The Regulated Health Professions Act is amended by this section.

2(2)

Subsection 1(1) is amended

(a) by repealing the definition "Agreement on Internal Trade"; and

(b) by adding the following definition:

"domestic trade agreement" means a domestic trade agreement within the meaning of subsection 16.1(1) of The Proceedings Against the Crown Act. (« accord sur le commerce canadien »)

Subsection 32(3) is amended by striking out "Chapter 7 (Labour Mobility) of the Agreement on Internal Trade" and substituting "a domestic trade agreement".

2(4)

Subsection 221(6) is amended by striking out "Chapter 7 (Labour Mobility) of the Agreement on Internal Trade" and substituting "a domestic trade agreement".

This Act comes into force on the day it receives royal assent.
