Affidavit of Desistance

Rebecca Baybay and Jan Russel Garrovillas filed a criminal case against Jonathan Agnes Cruz for violation of Section 10(a) of RA 7610. After assessing the incident, they realized that the accused had repented and felt remorse. As such, they now completely exonerate the accused from any liability and no longer wish to prosecute the criminal case. WE, MS. REBECCA BAYBAY & MR. JAN RUSSEL B. GARROVILLAS,


of legal age, Filipino, and presently residing at Sungay West, Tagaytay City,
Province of Cavite after having duly sworn to in accordance with law hereby
depose and state:
That we are the private complainants for VIOLATION OF SECTION
10 PAR. (A) OF RA 7610 filed against JONATHAN AGNES y CRUZ;
That I formally lodged a criminal case before Regional Trial Court
Branch 134, Fourth Judicial Region at Tagaytay City docketed as CRIM. CASE
TG-17-889;
After my sober and soul searching assessment and analysis of the
incident, I have realized that the accused has repented and showed remorse
for what he did;
That in view of the foregoing, I finally manifest that I now completely
and absolutely exonerate the accused from any liability in connection with
the above-mentioned criminal case and that I am no longer interested, and I
hereby desist, in prosecuting the said criminal case;
That I execute this Affidavit of Desistance so that the above-
mentioned criminal case be immediately dismissed and considered finally
closed;and
As such, I respectfully pray that the aforementioned case against the
accused be dismissed and be finally closed.
