MIDWIFE PLACEMENT PROGRAM
KNOW ALL MEN BY THESE PRESENTS:
This Contract of Service made and entered into this 20th day of June, 2019 in
____________, Philippines by and between:

DEPARTMENT OF HEALTH, an executive department of the Republic of
the Philippines, created pursuant to E.O. 94, s. 1947, transformed under E. O. 102, s.
Second Party
1999, with principal office at San Lazaro Compound, Sta. Cruz, Manila, represented
by MINERVA P. MOLON, MD, MPH FPPA, CESO III, Director IV, Regional
Office VIII and herein referred to as the “FIRST PARTY”;
and
_______________________, of legal age, Filipino and with residence address
at _____________________________________________, herein referred to as the
“SECOND PARTY”.

-WITNESSETH-
WHEREAS, the First Party is in need of the services of the Second Party
who shall perform work not performed by the regular personnel of the First Party;

WHEREAS, the Second Party has signified his/her intention, to which the
First Party has accepted, to provide the service needed by the latter;
WHEREAS, the Second Party hereby possesses the education, experience
and skills required to perform the job as described herein;
WHEREAS, the Second Party hereby attests that 1) he/she is not related
within the third degree of consanguinity or affinity to the hiring authority and/or
REPRESENTATIVE of the First Party; 2) he/she has not been previously dismissed
from government service by reason of an administrative offense; 3) that he/she has

not already reached the compulsory retirement age of sixty-five (65);

WHEREAS, the performance of service by the Second Party pursuant to
EO No. 782 or No. 366 is not under an “employer-employee relationship” hence, it
is a sale or exchange of service which is within the ambit of Section 108 of the 1997
Tax Code.
WHEREAS, the Second Party shall have the full support of the Department
of Health as a member of the organization;

NOW THEREFORE, in consideration of the foregoing premises, the First
Party hereby engages the services of the Second Party effective June 20, 2019 to

July 15, 2019, subject to the following terms and conditions:
1. The Second Party shall receive a monthly salary equivalent to Salary
Grade SG 11-Step I Fourth Tranche of the Salary Schedule under
National Budget Circular no. 575 dated March 25, 2019 in the amount of
TWENTY THOUSAND SEVEN HUNDRED FIFTY FOUR PESOS
ONLY (Php 20, 754.00); inclusive of taxes, payable on the 3rd week of the
following month. Salary shall be processed for payment after the cut-off
period and upon submission of complete supporting documents chargeable

against the funds of HRH DEPLOYMENT , this Department, subject to
the usual government accounting and auditing rules and regulations;
Second Party
2. The Second Party will receive an additional of 5% premium compensation
based on their monthly salary stated above pursuant to Department of Health
Department Memorandum Order no. 2019-0009 dated January 4, 2019,
including remittances of Philippine Health Insurance Corporation.
3. The Second Party is expected to perform the following functions:
a. Conducts house-to-house health education and awareness campaigns for
reproductive health and health maintenance;

b. Conducts home visit to households for monitoring and proper referral of
pregnant and post-partum mothers;
c. Reports status of families/household visited especially the pregnant and
post-partum mothers;
d. Assist in the conduct of health education and advocacy campaigns on
MNCHN and demand generation activities and provision of FP services;
e. Facilitate community participation in implementation and monitoring of
MNCHN programs and projects;

f. Provides direct maternal, handle deliveries and direct child care services
(preventive and curative under DOH guidelines) in coordination with the
Rural Health Midwife;
g. Maintains referral systems for difficult/complicated pregnancies in the
SDN;
h. Refer new FP acceptors for counseling and FP provision and assist in the
inventory of DOH procured FP commodities;
i. Mans the birthing facility together with the Rural Health Midwife;
j. Participate in the conduct of maternal and neonatal death review and
surveillance activities with the PHN and MHO;
k. Participate in data gathering and response during health emergencies and

disasters on FP/MNCHN related concerns
l. Performs other related functions as may be assigned subject to the

approval of the DOH.
4. The Second Party shall perform work at a time and schedule to be agreed
upon by both parties, such as, but not limited to:
a. Completes the eight (8) working hours per day or forty (40) working
hours a week

b. Renders night shift duty together with an organic RHU staff as deemed

c. Works with the DOH Provincial Health Team Leader / DOH

Development Management Officers (DMOs) / Provincial Health
Officers (PHOs) who shall oversee his/her activities in coordination
with the Municipal Health Officer or the designated officer-in-charge.
d. Submits Daily Time Records (DTRs), Accomplishment Reports, Leave
Applications, Individual Performance Commitment and Reviews
(IPCRs) and other administrative related documents / reports required
from all deployed HRH signed / approved by respective DMOs, PHOs,
or authorized signatories of Integrated Provincial Health Offices
(IPHOs) in ARMM.

e. Submits other necessary documents and records for purposes of
compensation, program monitoring and evaluation as may be required

by the Regional Offices.
f. Reports to the respective DMOs / immediate supervisor, DOH
Regional Office, DOH-ARMM or HHRDB as necessary, any untoward
events that can threaten his/her safety and security and that of his/her
community.
5. The First Party shall have the right to terminate this Contract on the
following grounds:
a. Violation by the Second Party of the Terms and Conditions of this

Contract;
b. Non-availability of funds;
c. Violation of Office rules and regulations; and
d. Unsatisfactory performance of his/her duties and responsibilities.
6. The First Party shall ensure health and security of HRH who renders night
shift duty. Eight (8) hours per day or forty (40) hours per week working hours

shall be strictly observed.
7. The Second Party shall comply with all administrative issuances and
technical guidelines of the DOH, DOH-Regional Offices or PHOs for DOH-
ARMM in close coordination with the concerned RHU officials or Local
Chief Executives.
8. The First Party shall ensure the safety and security of HRH deployed through
the following:
7.1 Provision of a Hotline for reporting of cases;
7.2 Establishment of a chain of communication in reporting and
responding to threats and emergencies;

7.3 Designation of a focal person at the provincial and regional level

who will be the over-all in charge in managing and responding to
safety and security issues and concerns
