The two dump truck drivers, John Richard Umaran and Joseph Nailles, signed a joint sworn affidavit stating that: (1) They work for AH Trucker Construction Aggregates and Trading as dump truck drivers, (2) On March 07, 2020 their dump trucks were held by DENR Balingasag due to missing delivery receipts for loaded sand, (3) They unintentionally left the delivery receipts believing their helper had secured them, (4) They contacted their supplier who confirmed the receipts were left at the quarry office, and (5) The receipts were sent to them and they take responsibility for the negligence.

JOINT SWORN AFFIDAVIT

We, JOHN RICHARD UMARAN, and JOSEPH NAILES both of legal age, Filipino,


and a resident of Villanueva, Misamis Oriental, after having been duly sworn to
in accordance with law, depose and state:

1. That we are employed at AH Trucker Construction Aggregates and Trading as Dump


Truck Drivers with office address at New Road Camaman-an, J.R. Borja Ext.,Cagayan de
Oro City ;

2. That we have been in the Company for about Six (6) Months;

3. That on March 07, 2020 our leased Dump trucks with Plate NO. NEG2065 and NEG1948
have been held by DENR Balingasag due to failure in showing the Delivery Receipts of
the loaded sands;

4. That the Delivery Receipts of the aggregates were unintentionally left with belief that
our dump truck helper had secured the documents;

5. That upon knowing that the Delivery Receipts were left and not in our possession we had
called up our supplier for the left delivery receipts;

6. That our supplier had affirmed that the delivery receipts were left at the quarry office ;

7. That the delivery receipts were sent to us by our supplier upon our request.

8. That we affirm and declare that it was our negligence;

9. That we are executing this affidavit to attest the truth of the foregoing facts and for
whatever purpose this may serve.
