TERMS AND CONDITIONS
RENTAL TERMS AND CONDITIONS
Lessee agrees to return machine clean and in good condition, less normal wear and tear with a full tank of fuel. If
machine is returned dirty or low of fuel, cleaning and fuel servicing charges will apply.
Standard rental rates based on single shift at 160 hours per 4 weeks, 40 hours a week, and 8 hours a day. Additional
hours accumulated will be billed accordingly. Rates do not include sales tax, insurance, surcharge, or freight.
Hourly overtime rate = 100% of standard hourly rate
RENTER’S RESPONSIBILITIES:
Unless otherwise noted, daily maintenance, inspections and safety operations as stated in owner operation manual.
Empire offers daily on-site lube service at an additional cost: contact (480) 633-4340 for more information. Replacing
teeth and cutting edges as needed. All damages to rubber tires. Damage charges not to exceed cost of new tires.
FIRE, THEFT AND VANDALISM PLAN (FTV)
As a service to our Clients, Empire offers a Fire, Theft and Vandalism Plan (FTV) that provides some limited protection
(FTV rate is 14% of machine list rental rate) from accidental direct physical loss of or damage to rented/leased
equipment. The FTV is generally available for up to $1,000,000 of off-highway construction equipment per client.
The FTV is not insurance. It is not a substitute for business insurance of any kind. The FTV will not be in effect if the
Client refuses to pay the appropriate fees when due.
INSURANCE REQUIREMENTS FOR RENTED OR LEASED EQUIPMENT
All Clients are required to have general liability insurance and physical damage insurance as outlined below. Clients
may purchase Empire’s Fire, Theft and Vandalism Plan (FTV) for rented off-highway equipment valued at up to
$1,000,000. Proof of physical damage insurance shall not be required for equipment covered by the FTV.
Insurance carried by Empire is not intended to cover the Client, Client’s employees or any person to whom the Client
may entrust the equipment. The maximum amount of coverage available to a person or entity, other than Empire,
required by law to be an insured on Empire’s policy, will be the limit of insurance needed to comply with the minimum
limits provision of the law in the appropriate jurisdiction.
