                In order to protect certain species against over-exploitation,the United States
  becnm e asignatory to an internationaltreaty known asthe Convention on Intem ationalTrade in
  Endangered Species of W ild Fauna and Flora (hereinafter IGCITES').Appendix Iof CITES
  includesspecieswhich are threatened with extinction and forwhich trade mustbe subjectto
  particularly strictregulation and for which no trade is allow ed for com m ercialpurposes.CITES,
  Art.11 at! 1.Appendix 11of CITES includes wildlife speciesthatalthough notnecessarily
  threatenedwith extinctionnow,m aybecom esollnlesstradeinppecim ensofsuch speciesisstrictly

  individually applyfordoctlmentationforeach singleexport.50C.F.R.jj 13.11and23.51.
         8.     A çiM asterFile''perm itissued by USFW S pursuantto CITES is valid dtzring the
  period specified on the face ofthe permit,and by itsterms,reptile breedersare notallowed to
  expol'
       tCITES protectedreptiles(snakes,turtles,geckos,etc.)capturedinthewild.50C.F.R.jj
  13.21 and 23.54;see also U SFW S Form 3-200-85.
                Reptilebreedersmustsubmita CITES Form 3-201A (the CITES Permit)to the
  U SFW S with each reptileshipmentthey intend to export.By submission ofthisform,thereptile
  breedercertifiesthata11reptilescovered by thepermitwerebred and hatched from parentalstock
  maintainedattheirfacility.50 C.F.R.j23.26.
         10.    A11 exports of wildlife must be accompanied by a USFW S Form 3-177, a
  Declaration for lmportation orExportation of Fish orW ildlife,listing nm ong other things,the
  speciesandapplicableCITESpermitnumbers.50C.F.R.j14.63.
                In orderto facilitate the comm ercialexportprocess,m alay businessesemploy the
  servicesofa custom sbroker.Custom s brokersazeregulated and em pow ered by U .S.Custom sand
  Border Protection (6tCBP'') to assist importers and exporters in meeting U.S.govelmment

  requirements governing imports and exports.However,with respectto exporting wildlife,the
  exporteremploying aM asterFilepermitisresponsibleforenstlringthata1linvoices,exportforms
  and CITES declarationsare true arld correctsince the wildlife mustOriginate from hisparental
  stock,located athisfacility.
                DM SUKE M W AU CHI was a residentof Yokohama,Japan,who owned and
  operated abusinesskrlown asM AN IA C REPTILES.
                Through M AN IAC REPTILES,DAISUU           M IYAUCH Ioffered forsalevarious
  snake species,lizard/gecko species,alzd t'urtle species,including butnotlim ited to,ballpythons
  (python regius),boa constrictors (boa constrictor imperator),Stlmatra short-tailed pythons
  (python curtus),common iguanas (iguana jgzftwtzl,argentine tegus (salvator rufescens),and
  commontegus(salvatormerianae),al1ofwhichareCITES11species.

  individualsand businessesin the U nited States.
                Unindicted Co-conspirator 1 owned and operated a business located in M iam i,
  Florida and engaged in thebreeding ofvariousreptilespecies.
         16.    Unindicted Co-conspirator 1 holds a M aster File perm itthatisvalid urftilJuly 12,
  2023.Unindicted Co-conspirator 1 has been a M aster File permitholder since 2008.Prior to
  issuanceoftheM asterFilepermit,Unindicted Co-conspirator1wasrequiredtosubmittoUSFW S
  photographsofhisfacility,docum entation astowhereilisparentalstock cam efrom,theestimated
  production capacity ofspecim ens,the anticipated volum eofexportofspecimens,andthenorm al
  m ortality rates for specim ens atthe facility.Pttrsuantto hisM asterFilepermit,Unindicted Co-
  conspirator1isallowedtobreedcertainreptilesfrom hiscertifiedparentalstock(bredincaptivity)
  for com m ercialsale and export.

          17.     On July 13,2020,Unindicted Co-conspirator1renewed hisM asterFilepermitfor
  specific captive bred species reared athis facility in M inmi,Florida.The renewalletter f'

         18.      Unindicted Co-conspirator2 operated abusinessin Davie,Florida,jhrough which
  hebought,sold,and bred reptiles.
         19.      Between October 17,2014,and August27,2021, U nindicted Co-conspirator 1

         20.      The GeneralA llegatiqnssection ofthislrlformation isre-alleged and incop orated
  by reference herein,asthough setforth in itsentirety.
                  Beginning on or about October 17,2014,the exact date being llnknown,and
  continuing upto and includingAugust27,2021,in the Southern DistrictofFloridaand elsewhere,
  the Defendant,

  combine,conspire,confederate,and agree with Unindicted Co-conspirators 1 and 2,and other
  persons both known and llnknown to the Governm ent,to com mit certain offenses againstthe
  U nited States,thatis:
                 a.        to m ake and subm it mly false record,account,and labelfor,and any false
                           identitk ation ofany w ildlife,including reptiles and any part,product,egg,
                           and offspringthereollwhich hasbeen,andisintendedtobe,exported,,in
                           violatiopof16U.S.C.jj3372(d)(1)and3373(d)(3)(A)(i);and
                 b.        to fraudulently and know ingly exportand send from the U nited States any
                           merchandise,article,and objectcontrary to any law and regulation ofthe
                        United States,in violation ofTitle 18,United StatesCode,Section 554.
                                      Purpose ofthe Conspiracv
         22.     Thepurposeoftheconspipcywasforthedefendantandhisco-conspirators,known
  and llnknown to the United States,to sm uggle CITES Appendix 11protected species and other
  w ildlife for financialgain.
                                 M anner and M eans ofthe C onspiracv
         23. Themannerand meansby whichtheDefendantsoughtto accomplish theobject
  and pup ose ofthe conspiracy included,nm ong others,the follow ing:
                 a.     ln f'urtherance oftheconspiracy and to effectthe illegalobjectsthereof,
  U nindicted Co-conspirator 1 agreed to allow D AISU K E M IYA U CH T to use his M aster File
  pennitto exportreptilesin exchangeforthepaym entofapproxim ately $2,000perexport.
                 b.     ln furtheranceofthe conspiracy and to effectthe illegalobjectsthereof,
  DM SUK E M IY A U CH I traveled frequently to the United States to attend reptile show s and to
  m akeptzrchasesofreptilesforhisbusiness,M ANIAC REPTILES.
                        In furtheranceofthe conspiracy and to effectthe illegalobjectsthereof,
  M IY A UC H I contacted U nindicted Co-conspirator 1 and prokided details regardipg hispurchase

  plans in advance of aniving in the Ulzited States,to allow Unindicted Co-conspirator 1 the
  necessary tim e to com plete the fraudulentexportpaperwork.

  thatinform ation to prepare fraudulentexportform s declaring thatal1ofthe CITES 11reptilescnm e
  from hiscaptive-bred stock.
                 e.     Inf'urtheranceoftheconspiracyandtoeffecttheillegalobjectsthereof,afler
  purchasing reptiles in the U nited States,DM SU K E M IY A U CH I w ould either arrange for the
  reptiles to be shipped to the residence ofUnindicted Co-conspirator 2 who would care forthe
  reptilesuntilM IY A U CH I anived,or M IY A U CH Iw ould personally transportthe reptilesto the
  M iam iarea.
                 f.     In furtheranceofthe conspiracy and to effectthe illegalobjectsthereof,
  upon arrivingin theM iamiarea,DM SUKE M IYAUCHItransported thereptilesto thebusiness
  location of Unindicted Co-conspirator 1, personally repackaged the reptiles, obtained the
  fraudulentexportdocuments from Unindicted Co-conspirator 1,and then delivered the reptiles
  and exportdocum ents to a custom s broker who,in ttum,submitted the fraudulentpaperwork,
  including U SFW S Form 3-177, and CITES Form 3-201A ,to the U SFW S.

  conspirator   caused a declaration for exportation of wildlife (USFW S Fonn 3-177) and
  accompr ying CITES pennits (3-201A)listing Unindicted Co-conspirator 1'sbusiness asthe
  exporter arld M AN IA C REPTILES,Y okoham a,Japan, as the foreign im porter to be filed w ith
  USFW Sand CBP,falselycertifyingthatthereptilescoveredbythepermit(towit,atleastforty-
  lzine ballpythons (python regiusl)were bred and hatched from parentalstock maintained at
  Unindicted Co-conspirator 1's business.
                d.     On or about November 20, 2020, M W AUCH I and Unindicted Co-
  conspirator 1 caused a declaration for exportation ofwildlife (USFW S Form 3-177) and

  deliverfourparcels,addressedto M IYAUCHI,to the residence/businesslocation ofUnindicted
  Co-conspirator2.Theparcels contained eleven ballpythons (sllipped by GGS.B.''),and various
  speciesand quantitiesofgeckos.
                h.     On or about April 29, 2021, DAISUK E M IYAUCHI loaded and
  trdnsported reptilesfrom theresidence/businesslocation ofUnindicted Co-conspirator2 by rental
  caz,to Unindicted Co-conspirator 1's business's warehouse in Mjnmi,Florida,where he
  repacked thereptilesinto fiveboxes.
                       W hileatUnindicted Co-conspirator 1's business,M IYAUCH Im etwith
  Co-conspirator 1,who provided M IY A UC H I with âaudulentexportpaperw ork.
                       Thereafter,on or aboutA pril29,2021,DM SU K E M IY A UC H I traveled
  directly from U nindicted C o-conspirator 1's business to a custom s broker in M inm i,Florida,
  w herehe dropped offthe five boxes ofreptiles.
