                                          DECISION
An application for patent bearing number 2598/DELNP/2013 was filed in Patent office, Delhi on
22/03/2013 as a Divisional PCT National Phase Application. The said application was examined
under sections 12 and 13 of the Patents Act, 1970 (as amended) and Examination report was
issued. In response to the Examination Report, applicant’s agent submitted its reply.
After considering the reply filed against examination report and the report of the examiner on
such reply, it was observed that the said patent application was not in order for grant. In order to
dispose of the application, hearing was offered to the applicant and accordingly hearing was
fixed on 22.04.2022. The intimation of said hearing (hearing notice) was given to applicant’s
agent vide email dated 01.04.2022 along with the following objections which I found outstanding
in the application:

On 22.04.2022 hearing was attended by Mr. Rana Bhanu Pratap Singh, patent agent for the
applicant through video conferencing. During hearing the agent argued for the application and
sought permission to file written submission which was allowed. Accordingly the agent filed a
written submission on 06.05.2022. Having considered the written submission dated 06.05.2022,
I did not find submission fully persuasive. Hence, the matter was further discussed with the
patent agent on 23.06.2022. Accordingly, the agent filed further written submission on
23.06.2022.
In respect of objections regarding Clarity and Conciseness; Invention u/s 2(1)(j); Other
Requirements; and Scope, the applicant amended the claims and submitted following reply:

Having considered the aforesaid submission and amendments, I find the submission and
amendments persuasive to meet the requirements. I find that amended claims submitted along
with hearing written submission dated 23.06.2022:
    -    are definitive, clear and concise;
    -    are novel and do involve inventive step over cited documents;
    -    fulfil the requirement of section 16 of the Act; and
    -    do not fall within scope of section 3(k) and 3(m) of the Act.
In respect of objection regarding Formal requirements, the applicant submitted following
reply:

The applicant also submitted following documents:
   i.   Duly stamped power of attorney
   ii. English translation certificate as per rule 20 of the Patents Rules, 2003 (as amended)
   iii. Fresh Form 1, Form 5 and Form 18.
Having considered the aforesaid submission and documents, I find the submission and
documents persuasive to meet the requirements.
In view of aforesaid, the objections raised vide the hearing notice dated 01.04.2022 have been
met. Hence, I hereby proceed for grant with the patent application no. 2598/DELNP/2013 under
section 15 of the Patents Act, 1970 (as amended).
