I. Circumstances in the Taking of this Judicial Affidavit:
That in accordance with A.M. No. 12-8-8-SC, which prescribes
the use of judicial affidavits to serve as the direct examination testimony of
the witness, on the basis of which the adverse party may conduct their
cross-examination on such a witness, petitioner hereby execute this
judicial affidavit in a question and answer format.
That conformably with section 3 (b) of the said A.M. No. 12-8-8-
SC, this Judicial Affidavit was taken before Atty. Teodoro Jose M. Bruno

III, at Public Attorney’s Office, Hall of Justice, Brgy. Sta. Monica, Puerto
Princesa City, this _____ day of July 2023 around 3:30 o’clock in the
afternoon.
That conformably also with section 3 (c) thereof, Witness hereunder
state under the pain of perjury that in answering the questions asked, as
appearing herein below, he is fully conscious that she did so under oath,
and that she may face criminal liabilities for false testimony or perjury;
Pinaliwanag sa kanya na siya ay nakapanumpa na magsasabi
lang ng katotohanan sa kanyang mga sagot sa dahilang kung
sakaling mapatunayan na siya ay maaaring sampahan ng
kasong criminal o pagsisinungaling sa pagsagot (perjury) sa
mga tanong sa kanya.
III. PURPOSE OF TESTIMONY
A) To prove the capacity of the petitioner as a co-owner of
the land covered by ORIGINAL CERTIFICATE OF
TITLE NO. E-9840 LOCATED IN BARANGAY
ALIMANGUAN, SAN VICENTE, PALAWAN, WITH
AN AREA OF MORE OR LESS TWENTY THREE
THOUSAND EIGHT HUNDRED EIGHTY THREE
(23,883) SQUARE METERS;
B) To prove that the petitioner is in possession and control
of the above described parcel of land;
C) To prove the loss of the Owners’ Duplicate Copy of the
ORIGINAL CERTIFICATE OF TITLE NO. E-9839, and
that it can no longer be retrieved in its original form and
state despite diligent efforts;
D) To prove that the Owners’ Duplicate Copy of the
Certificate of Title was lost as shown and attested in
the Affidavit of Loss executed before Attorney Arabella
Maladaga Pe as further annotated in the Memorandum
of Encumbrances in the Electronic Copy of the
Certificate of Title.
E) To show further that the petitioner has regularly and
religiously paid the real property taxes thereon and that
the same has been updated;
F) He will likewise testify and identify documents related
thereto;

Filipino, biyudo. Isa akong magsasaka at
nagbabasakan.
Tanong 4. Alam mo po ba kung bakit kayo naririto at
kasalukuyang kinukuhaan ng salaysay?
S: Opo
Tanong 5. Maari po bang malaman ang dahilan ng
pagbibigay ninyo ng testimonya o salaysay na ito?
S. Para po sa Petition sa hukuman na mag-
isyung muli ng Owner’s Duplicate Copy ng
nawalang titulo ng lupa namin na binigay ng
Department of Environment and Natural
Resources CENRO sa Roxas.

kapag ipinakita ko ho ba sa inyo ang kopya/sipi ng

MANIFESTATION: The undersigned counsel
prays that the marking for the Petition during the
hearing for Jurisdictional requirements be
maintained. For the record, the Petition was
marked as Exhibit “B” to Exhibit “B-__” with the
signature of the Petitioners as “B-__”.

S. Wala na po. Electronic copy na ibinigay ng
Registry of Deeds na lamang.
MANIFESTATION: The witness is presenting to

the initial marking of Exhibit “C” and corresponding
subsequent pages as “C-1”, “C-2”, “C-3” and “C-4”

asawa ni Ms. Elisa Badilla, kung mayroon man?
S. Opo, ang Marriage Contract namin.
MANIFESTATION: The witness is presenting to
the undersigned a PSA Certified Copy of the
Marriage Contract for Elisa Badilla and Marcial
Bebit. We pray that the same be marked as
Exhibit “E” in accordance with the marking as
prayed during the hearing on jurisdictional facts.

tagapagmana, kung mayroon maan?
S. Noong namatay ang asawa ko ay lumapit ako
kay Atty. Arabella Maladaga-Pe para magpagawa
ng Affidavit of Self-Adjudication ako lang ang
tanging tagapagmana ng aking asawa. Ito ho.
MANIFESTATION: Manifestation: The witness is
presenting to the undersigned an Affidavit of
Self-Adjudication of Estate of Elisa B. Bebit,
paragraph D of which covers OCT No. E-9840
covering a parcel of land with an area of twenty
three thousand eight hundred eighty three
(23,883) square meters. We pray that the same
be marked as Exhibit “F”, paragraph D thereof as
Exhibit “F-1”, and Exhibit “F-2” for the second
page, in accordance with the marking as prayed
during the hearing on jurisdictional facts.
Tanong 22. Paano niyo po nasabi na nawala ang titulo
na sipi ng may-ari?
S. Tinatago naming mag asawa ang titulo sa aming
bahay sa Barangay Alimanguan, San Vicente,
Palawan. Noong 2016, noong hinahanap ko na ang
titulo ng lupa ay hindi ko na Makita.
Tanong 23. Ano po ang pinaglalagyan ng Titulo kung
mayroon man?

S. Nasa aparador sa aming kuwarto. Noong
namatay ang aking asawa ay hinanap ko ang mga
Titulo pero itong para sa lupa na ito (OCT No. E-
9840) ay nawawala na. Hinanap ko rin sa buong
bahay pero hindi talaga makita.
Tanong 24. Saan po matatagpuan ang lupang ito na
sakop ng Titulo?
S. Sa Barangay Alimanguan, San Vicente, Palawan
Tanong 25. Alam niyo po ba kung gaano kalaki ang
lupang sakop ng titulo?
S. Nasa dalawampu’t tatlong libo, walong daan at
walumpu’t tatlong (23,883) metro kwadrado.
Tanong 26. Sino po ang naka-okupa sa lugar na iyan?
S. Kaming mag-asawa noong nabubuhay pa siya.
Ngayon ay ako pa rin ang nagsasaka sa basakan.
Tanong 27. Bilang may-ari, mayroon po ba kayong mga
binabayaran para sa lupa, kung meron man?
S. Nagbabayad ako ng real property tax. Ito ang
Tax Clearance Certificate para sa titulo noong 2023
at iyang Tax Declaration para sa lupa.
MANIFESTATION: before us is a Tax Declaration
issued to the Petitioner Mr. Marcial Bebit. We
pray that the tax declaration be marked as our
Exhibit “G”.
MANIFESTATION: The witness is also confirming
payment for 2023 tax due. Tax Clearance
presented was marked as Exhibit “G.” we pray
that the marking be maintained.

nasabing sipi ng titulo?
S. Mga 2016, noong hinanap ko na matapos
mamatay ang asawa ko.
Tanong 29. Ano ang hakbang na inyong ginawa
upang hanapin ang nasabing titulo?

barangay ngunit hindi rin nila alam kung nasaan ito.
Tanong 30. Mayroon pa po bang kayong ginawa upang
patunayan ang pagkawala nito, kung meron man?
S. Opo. May Salaysay ng Pagkawala ng Titulo.
MANIFESTATION: The witness is presenting to
me the Affidavit of Loss signed and executed
before the Atty. Arabella M. Pe with Document
No. 14; Book No. LVIII, Page 4, Series of 2016
dated December 30, 2016. We pray that this
Affidavit be marked as our Exhibit “H”, as
previously marked.
Tanong 31. Meron pong nakalagda sa taas ng pangalan
ni Marcial H. Bebit, Kaninong pirma po ang naririto?
S. Pirma ko po iyan.
MANIFESTATION: Witness identified a signature
on the lower right hand portion of the Affidavit
above the printed name Marcial H. Bebit. We pray
that the marking as “H-1” be adopted.

niyo, kung meron man?
S. Ipinasok ho sa Registry of Deeds ng Probinsya
ng Palawan ang nasabing Affidavit.
MANIFESTATION: The Affidavit was entered in
the Memorandum of the Certificate of Title as
Entry No. 2021000967 dated July 07, 2017.
Same was marked as Exhibit “C” and series.

S. Wala ho. Ang huling mortgage ay kanselado na.
