1.0 CPECC COMMITMENT, POLICY ON SAFETY, HEALTH AND ENVIRONMENT

1.1 General

In order to fulfill all over the engineering, procurement, construction, testing and commissioning of Additional
White-Oils Storage Tanks and Accessories at Pump Station 10 (Nairobi Terminal), and assure its proper
operation under the prerequisite of HSE and complete it as required by the Employer and tender documents
about HSE, CPECC prepares HSE Management System for this project.

1.2 HSE Commitment

The Company believes that the most important sources in the world are human and natural environment
they are relying on. “Care for lives and protect environment” is one of its core tasks. In order to have and
preserve a good HSE performance, it will:

♦ Comply with laws and regulations in China and the host country and respect local customs.
♦ Take human and precaution as the priority to pursue objectives of zero injury, zero pollution
and zero accident.
♦ Protect environment and save energy to promote clean production and sustainable
development.
♦ Continually improve the HSE management.
♦ Provide necessary resources for the effective operation and continuous improvement of HSE
MS.
♦ Take HSE performance and achievements as the important basis of reward and punishment as
well as recruitment and employment.
♦ Carry out HSE training, cultivate and preserve its HSE culture.
♦ Frankly disclose its HSE performance and achievements.
♦ Keep the same attitude towards HSE consistently, anytime, anywhere.

All employees, contractors and suppliers of CPECC have responsibilities to keep the Company’s HSE

1.3 HSE policy

The purpose and objective of this policy is to protect the safety of CPECC employees, visitors and
subcontractors personnel and to minimize losses caused by unsafe acts, situations or omissions at all
times.

It is the policy of CPECC to regard the safety of its employees, the protection of assets and the environment
with equal priority and importance as any operational aspect of CPECC activities.

CPECC assures all employees that CPECC management will, as far as possible, follow operating practices
that shall protect all employees and environment whilst maintaining efficient operation and standards of
quality.

Safety training will be provided at no cost to the employee or visitors. All levels of management shall be held
accountable for their safety, security and environmental responsibilities. To achieve this, CPECC safety
procedures are mandatory for all personnel. All levels of management, senior and supervisory are
responsible for implementing the safety and environmental requirements of CPECC.

Any safety, security and / or environmental requirements identified in safety and environmental standards
which are not implemented, will be indirect conflict with this policy statement and as a consequence line
management, line supervision and all individual employees will be held accountable.

All employees are required to understand and promote the safety, security and environmental standards of
the company at all times and to cooperate with the companies safety program in every aspect, that includes
a secure work site, compliance with the rules and regulations and all requests for security identification /
passes to clients work site and areas.

1.4 HSE Targets

Pursuing zero injury, zero pollution, zero accident.

1.5 Job Safety Analysis

1.5.1 Introduction

The Job Safety Analysis (JSA) is the formal review and development procedure for minimizing, eliminating
and or controlling the risk during the operation and performance of the work. The purpose of this practice is
to instruct all managers, discipline engineers, supervisors, foreman and also the workers in the basic
step-by-step procedure conducting a JSA.

1.5.2 General

A Job Safety Analysis (JSA) involves the detailed and systematic review of a given task, resulting in the
identification and understanding of:

• The sequence and events or activities to be followed

• The specific job hazards associated with each activity

• The degree or magnitude of risk associated with each activity

• The control measures required to eliminate and control the associated risks

• A safe work procedure that can be followed by all personnel which includes the precautions needed to
be taken whilst performing the work.

1.5.3 When to perform a JSA

A Job Safety Analysis must be performed for each and every new activity that contractors and
sub-contractors intend to perform

If there is no existing safe work practice for a particular task or work activity or if existing safe work practices
are not sufficient to control the risks, conduct a JSA.

1.5.4 How to prepare to conduct a JHA

List all fundamental risks and related questions:

• What is the activity to be performed?

• What tools, equipment and materials are required?

• What qualifications and training are required?

• Who is best suited to accomplish the activity?

• What could go wrong?

• Who could be affected?

• How series could the negative effects be?

• How likely is the negative effect to actively occur?

• What can be done or implemented to prevent incidents or accidents from occurring?

1.5.5 Job Safety Analysis Process

• Describe the activity to be done?

• List tools, equipment and materials required?

• List the major task or steps in sequence?

• Identify the hazards and risks with each task or step?

• Estimate the risk for each task or step?

• Define the method of control to eliminate or reduce the risk?

• Determine if the control has minimized the risk to an acceptable level?

• Re-confirm that each activity / task are in a logical sequence?

Job Safety Analysis (JSA) should be conducted by the person responsible for the activity along with
supervisors and personnel that will be involved in the doing of the work. The completed Job Safety
Analysis (JSA) must be agreed to and signed off by the following:

Area HSE Manager

2.0 Organization and Responsibilities

2.1 HSE Department

CPECC will establish HSE Department identifying the objective and responsibility of safety, health and
environment. And the responsibilities of HSE Dept just as following:

Assist the Project Manager in HSE management of the PROJECT according to the laws and regulations of
Kenya, the relevant standard and specification of the CONTRACT.

Be responsible for preparation, submittal, and execution of management manual, procedure, execution plan,
risks evaluation and emergency plans concerning HSE as well as HSE policy and objective.

Be responsible for preparation and submittal of permits and admittance concerning HSE before the start of
the PROJECT and during the construction.

Be responsible for HSE training for the project personnel as well as the examination and qualification for the
personnel at special and key position.

Be responsible for establishment of HSE management system to carry out internal examination and the
inspection of Employer.

Be responsible for preparation or examination of allocation plan for labor protection appliances, safety
measures investment and labor health cost plan.

Be responsible for investigation and handling of emergency.

Be responsible for supervision and examination of safety guard system.

Be responsible for health and safety of the project personnel as well as the protection of surrounding
environment.

2.2 Personnel HSE Responsibilities

2.2.1 Department Managers

Must ensure that all persons using equipment or engaged in work operations are competent suitably
experienced or that such persons work under close supervision of a person who is competent and suitably
experienced.

Must ensure that all work operations should not do harm to environment

2.2.2 Project Managers/Deputy Managers/HSE Manager

These individuals must ensure that:

All plant and equipment on the site or place of work is safe, is guarded and equipped with the appropriate
safety devices.

All operations should do harmless to environment.

Taking corresponding measures to protect environment.

All personnel employed are suitable for the jobs they have been recruited to perform. Periodic tests,
inspections and maintenance are carried out.

They appraise all Engineers, General Foremen, Foremen and Charge hands under their control to ascertain
their individual effectiveness and performance with regard to health, safety and environment-protecting at
work.

2.2.3 Deputy HSE Manager/HSE Engineer/ Report to the HSE Manager

Deputy HSE Manager/HSE Engineer is responsible for:

Reporting to the HSE Manager on a regular basis regarding CPECC HSE Standards;

Checking up and monitoring the implementation of environment protections;

Ensuring that implementation of the CPECC Safety Security Documents are monitored. Implementation is
the responsibility of management and supervisors. Safety is responsible for monitoring and audit of the
Safety Security systems;

Preparing and conducting HSE Training courses on a regular basis;

Scheduling Inspections of all CPECC areas of work;

Ensuring all accidents/ incidents and property loss or damage is thoroughly investigated and
recommendations are given to prevent reoccurrence;

Ensuring that all Safety Security and fire equipment conforms to recognized National and International
Standards and Company requirements;

Submitting a Monthly Safety Report to the HSE Manager on accident trends and Safety performance
on-site;

Ensuring effective HSE coverage of all onsite activities;

Monitoring the effectiveness of the fire teams or sections operating within the HSE Department;

Reviewing construction procedures, to identify potential areas of loss and bring these to the attention of the
Safety Security Manager;

Review minutes of all Safety Meetings and ensure the actions on all points relating to actions by the Safety
Security Department are completed;

During the absence of the Safety Security Manager the Deputy Safety Security Manager will report directly
to the Project Manager.

2.2.4 HSE Coordinators Reports to HSE Manager

The HSE Coordinator is responsible for:

Reporting to the HSE Manager on a regular basis regarding site safety standards and activities.

Ensuring regular safety inspection is carried out at site.

Monitoring and auditing of work sites safety systems.

Training in carried out on a regular basis.

Liaison with clients and subcontractors for all aspects of safety.

Investigating accidents and incidents and make recommendations to avoid reoccurrence are detailed to
CPECC management.

Liaison with the HSE Engineer regarding safety materials that are available and ordering new equipment.

Ensuring an effective fire team/section is operating within the Project HSE Department.

Ensuring Safety meeting reports are submitted to HSE Manager regarding the Safety standards of the
Project sites.

2.2.5 Security Supervisors

The Security Supervisors are to ensure that all personnel and vehicles visiting the Project Site Areas are
provided with the required security documents as per the requirements of the Client. Exhibits of all
documents will be made available to the Security Staff.

The Security Supervisors are to ensure that sufficient security cover is provided (seven days a week,
subject to contract requirements. This will be achieved by a rotary system, to ensure no man works without
a rest and recreation period).

Any person or persons not exhibiting the correct site documents will be refused entrance or exit and the
Project Manager and HSE Department be advised immediately.

The Security Supervisor will ensure that the security staff are correctly dressed at all times whilst on duty,
and that they are fully equipped with Radio & Telephone communication Systems; that they are in
possession of the “Emergency Plans” and that all other equipment is made available for their duties: such
as Flashlights(heavy duty type). Fire Fighting Extinguishers, First Aid Boxes, Tow Ropes, Sand mats,
Shovels, Water and Food Supplies and Vehicle.

The boundaries of the Project sites will be patrolled at regular intervals in addition to the gate duties. The
guards will keep records of all vehicles entering/ leaving site by recording the vehicle license number and
the time of arrival and or exit.

The supervisor must ensure no security staff leaves their post until relieved and that no security personnel
are to leave the boundaries of the site.

Security for the pipe line system will be dependent on flexible arrangements to be determined later in the
construction program but the essence of the aforesaid activities will apply in principle if not exactly in
practice.

2.2.6 Construction Supervision and General Foremen

Construction Supervision and General Foremen must ensure that:

Sites and work areas are organized in such a manner that work is carried out to the required standard with
minimum risk to men, equipment and environment.

All Safety/Security environment law and specific client regulations must be observed.

All tradesmen have to be given site induction before starting work, or a buddy system has to be set up for
the first shift ONLY. The person acting as the buddy has to have been on the induction and knows the site
procedures for emergency action etc.

The delivery, transfer and storage of materials and equipment is carried out in a safe manner and that all
electrical supplies are insulted and maintained safely.

The work site is maintained in a safe and tidy condition at all times and that debris is removed on a daily
basis.

Sub-contractors are made aware of their areas of responsibility so that they may work safely on the site.

All machinery and plant, including hand tools and power tools are maintained in a safe and serviceable
condition.

Adequate protective clothing and equipment is issued to each person within their control and that the
protective equipment is properly maintained and correctly used.

All employees under his control know what to do in the event of a fire and that they know the location and
operation of the fore fighting equipment available.

Arrangements are made to investigate all accidents and incidents which occur, then try to discover their
cause and eliminate re-occurrence.

The Construction Supervisors and General Foreman will also discuss with Line Management matters of
safety and continually develop safe working practices and procedures within their sections.

The Construction Supervisors and General Foremen are expected to set a personal example for the
personnel within their control by working safely and recommend that others to do the same.

2.2.7 Foremen

Foremen must ensure that:

All safety Instructions are incorporated into routine day to day orders and that they are obeyed.

Workers should not take any unnecessary risks.

Checking up and monitoring the implementation of environment protections.

New employees are encouraged to consider their own safety and the safety of other employees, who may
be effected by their actions.

The Foremen are also expected to reprimand personnel within their control who fail to work in a safe
manner and to encourage a safe place of work with procedures followed personal example.

2.2.8 All Supervisor Staff

All supervisory Staff have a responsibility for safety and environment-protection within their area of
operations, they must ensure:

That they are themselves fully aware of the Company’s Safety Policy and the relevant legislation and safety
practices.

That the personnel for whom they are responsible have been fully trained in the use of all machinery and
equipment and are fully aware of the potential hazards associated with such equipment.

That adequate supervision is provided at all times for the personnel under their control.

That potential safety hazards are reported and rectified immediately.

That good housekeeping is maintained at all times, in their areas of control and that all machinery and
equipment is properly maintained and inspected that efficient safety devices are fitted, working properly,
and used effectively.

That all personal within their control know what actions they should take in the event of a fire or other major
incident and know the “whereabouts of the relevant such as Fire Extinguishers, First Aid Boxes, Safety
Showers and Eye Baths etc.”

That the relevant returns are made to the Safety Manager so accurate and up to date records are
maintained for the statutory period.

Promotion of safety awareness and responsibilities.

Encourage personnel to report any incidents or near misses.

Hold regular safety meetings within sphere of operations, record and action if necessary.

Where any unsafe practice, breach of regulations or non-conformance with procedures is observed the
supervisor is responsible for drawing to the attention of the line manager responsible.

The duties of Supervisory Staff towards safety may also require that they:

Coordinate with other departments and activities.

Have first-hand knowledge of the work activity the hazards which may be involved and the circumstances
under which the activity may be carried out.

Instruct other personnel in the relevant safe working practices and procedures for their work.

Provide special equipment expertise and techniques where appropriate.

Recommend improvements in the methods of safe working to meet changing circumstances.

All Supervisory staff are advised to demonstrate commitment to safety instructions and procedures and in
particular to observing the contents of this Safety Manual.

2.2.9 All Employees

All personnel are responsible for their personal safety and for the safety of others who may be affected by
their acts or omissions at work.

Complying with all applicable laws, regulations, environmental standards, guidelines and terms and
conditions of approvals issued by Kenya government and OWNER.

Personnel should not take ‘short cuts’ through process units or plants unless their work is inside the area.

Unauthorized personnel must not operate equipment.

All persons on Site must:

Conduct themselves in a responsible manner.

Comply with any safety instruction giving.

Wear the correct PPE at all times.

Observe all signs and notices.

Report ASAP any accident or incident to line management.

Identify any hazard, so action can be taken.

Know what actions to be taken during General Alarm Situation.

Know muster station location and emergency equipment, plus how to use it.

3.0 ENVIRONMENT MANAGEMENT

3.1 General

The CPECC Environmental Management will conform to industrial standards and the requirements of the
EMS principles stated in the draft ISO14000.

Consistent with economy and efficiency in the execution of the project, CPECC shall prevent, minimize, or
mitigate environmental damage during all erection activities.

CPECC shall implement all measures necessary to avoid undesirable adverse environmental and social
impacts wherever possible, restore work sites to acceptable standards, and abide by any environmental
performance requirements specified in an EMP. In general these measures shall include but not be
limited to:

a) Minimize the effect of dust on the surrounding environment resulting from earth mixing sites, asphalt
mixing sites, dispersing coal ashes, vibrating equipment, temporary access roads, etc. to ensure
safety, health and the protection of workers and communities living in the vicinity dust producing
activities.

b) Ensure that noise levels emanating from machinery, vehicles and noisy construction activities (e.g.
excavation, blasting) are kept at a minimum for the safety, health and protection of workers within the
vicinity of high noise levels and nearby communities.

c) Ensure that existing water flow regimes in rivers, streams and other natural or irrigation channels is
maintained and/or re-established where they are disrupted due to works being carried out.

d) Prevent bitumen, oils, lubricants and waste water used or produced during the execution of works from
entering into rivers, streams, irrigation channels and other natural water bodies/reservoirs, and also
ensure that stagnant water in uncovered borrow pits is treated in the best way to avoid creating
possible breeding grounds for mosquitoes.

e) Prevent and minimize the impacts of quarrying, earth borrowing, piling and building of temporary
construction camps and access roads on the biophysical environment including protected areas and
arable lands; local communities and their settlements. In as much as possible restore/rehabilitate all
sites to acceptable standards.

f) Upon discovery of ancient heritage, relics or anything that might or believed to be of archaeological or
historical importance during the execution of works, immediately report such findings to the Employer/
Engineer so that the appropriate authorities may be expeditiously contacted for fulfillment of the
measures aimed at protecting such historical or archaeological resources.

g) Discourage construction workers from engaging in the exploitation of natural resources such as
hunting, fishing, and collection of forest products or any other activity that might have a negative
impact on the social and economic welfare of the local communities.

h) Implement soil erosion control measures in order to avoid surface run off and prevents siltation, etc.

i) Ensure that garbage, sanitation and drinking water facilities are provided in construction workers
camps.

j) Ensure that, in as much as possible, local materials are used to avoid importation of foreign material
and long distance transportation.

k) Ensure public safety, and meet traffic safety requirements for the operation of work to avoid accidents.

l) Ensure not to recruit children below the age of 16 years for the works he is responsible for.

m) Ensure to pay daily rates of reasonable amount for the daily laborers depending on their skills.

CPECC will comply with various regulations and legislations that have been developed by the Kenyan
Government and institutions in order to safeguard the environment.

3.2 Worksite/campsite waste management

All vessels (drums, containers, bags, etc.) containing oil/fuel/surfacing materials and other hazardous
chemicals shall be bundled in order to contain spillage. All waste containers, litter and any other waste
generated during the construction shall be collected and disposed off at designated disposal sites in line
with applicable government waste management regulations.

All drainage and effluent from storage areas, workshops and camp sites shall be captured and treated
before being discharged into the drainage system in line with applicable government water pollution control
regulations.

Used oil from maintenance shall be collected and disposed off appropriately at designated sites or be
re-used or sold for re-use locally.

Entry of runoff to the site shall be restricted by constructing diversion channels or holding structures such as
banks, drains, etc. to reduce the potential of soil erosion and water pollution.

Construction waste shall not be left in stockpiles along the road, but removed and reused or disposed of on
a daily basis.

The disposal sites for spoiled materials shall be located in areas, approved by Employer/ Engineer, of low
land use value and where they will not result in material being easily washed into drainage channels.
Whenever possible, spoiled materials should be placed in low-lying areas and should be compacted and
planted with species indigenous to the locality.

3.3 Material excavation and deposit

CPECC shall obtain appropriate licenses/permits from relevant authorities to operate quarries or borrow
areas.

The location of quarries and borrow areas shall be subject to approval by relevant local and national
authorities, including traditional authorities if the land on which the quarry or borrow areas fall in traditional
land.

New extraction sites:

a) Shall not be located in the vicinity of settlement areas, cultural sites, wetlands or any other valued
ecosystem component, or on high or steep ground or in areas of high scenic value, and shall not be
located less than 5km from such areas.

b) Shall not be located adjacent to stream channels wherever possible to avoid silting to river channels.
Where they are located near water sources, borrow pits and perimeter drains shall surround quarry
sites.

c) Shall not be located in archaeological areas. Excavations in the vicinity of such areas shall proceed
with great care and shall be done in the presence of government authorities having a mandate for their
protection.

d) Shall not be located in forest reserves. However, where there are no other alternatives, permission
shall be obtained from the appropriate authorities and an environmental impact study shall be
conducted.

e) Shall be easily rehabilitated. Areas with minimal vegetation cover such as flat and bare ground, or
areas covered with grass only or covered with shrubs less than 1.5m in height, are preferred.

f) Shall have clearly demarcated and marked boundaries to minimize vegetation clearing.

Vegetation clearing shall be restricted to the area required for safe operation of construction work.
Vegetation clearing shall not be done more than two months in advance of operations.

Stockpile areas shall be located in areas where trees can act as buffers to prevent dust pollution. Perimeter
drains shall be built around stockpile areas. Sediment and other pollutant traps shall be located at
drainage exits from workings.

CPECC shall deposit any excess material in accordance with the principles of the general conditions, and
any applicable EMP, in areas approved by local authorities and/or the Employer/ Engineer.

Areas for depositing hazardous materials such as contaminated liquid and solid materials shall be approved
by Employer/ Engineer and appropriate local and/or national authorities before the commencement of work.
Use of existing, approved sites shall be preferred over the establishment of new sites.

3.4 Rehabilitation and soil erosion prevention

To the extent practicable, CPECC shall:

• rehabilitate the site progressively so that the rate of rehabilitation is similar to the rate of construction.

• always remove and retain topsoil for subsequent rehabilitation. Soils shall not be stripped when they
are wet as this can lead to soil compaction and loss of structure.

• not store the top-soil in large heaps. Low mounds of no more than 1m to 2m high are recommended.

• re-vegetate stockpiles to protect the soil from erosion, discourage weeds and maintain an active
population of beneficial soil microbes.

• locate stockpiles where they will not be disturbed by future construction activities.

• reinstate natural drainage patterns where they have been altered or impaired.

• remove toxic materials and dispose of them in designated sites. Excavated areas shall be backfilled
with soils or overburden that is free of foreign material that could pollute groundwater and soil.

• Identify potentially toxic overburden and screen with suitable material to prevent mobilization of toxins.

• ensure reshaped land is formed so as to be inherently stable, adequately drained and suitable for the
desired long-term land use, and allow natural regeneration of vegetation.

• minimize the long-term visual impact by creating landforms that are compatible with the adjacent
landscape.

• minimize erosion by wind and water both during and after the process of reinstatement.

• compact the surfaces deep rip to relieve compaction unless subsurface conditions dictate otherwise.

• re-vegetate with plant species that will control erosion, provide vegetative diversity and, through
succession, contribute to a resilient ecosystem. The choice of plant species for rehabilitation shall be
done in consultation with local research institutions, forest department and the local people

3.5 Water resources management

CPECC shall at all costs avoid conflicting with water demands of local communities.

Abstraction of both surface and underground water shall only be done with the consultation of the local
community and after obtaining a permit from the relevant Water Authority.

Abstraction of water from wetlands shall be avoided. Where necessary, permission has to be obtained from
relevant authorities.

Temporary damming of streams and rivers shall be done in such a way to avoid disrupting water supplies to
communities downstream, and maintains the ecological balance of the river system.

No construction water containing spoils or site effluent, especially cement and oil, shall be allowed to flow
into natural water drainage courses.

Wash water from washing out of equipment shall not be discharged into water courses or road drains.

Site spoils and temporary stockpiles shall be located away from the drainage system, and surface run off
shall be directed away from stockpiles to prevent erosion.

CPECC shall install water-conserving automatic taps and toilets. Moreover any water leaks through
damaged pipes and faulty taps will be fixed promptly by qualified staff within the construction workers
camps, warehouses and storage areas or sites. In addition project workers shall be sensitized on the
efficient use of water.

3.6 Traffic management

Location of access roads/detours shall be done in consultation with the local community especially in
important or sensitive environments. Access roads shall not traverse wetland areas.

Upon the completion of civil works, all access roads shall be ripped and rehabilitated.

Access roads shall be sprinkled with water at least five times a day in settled areas, and three times in
unsettled areas, to suppress dust emissions.

3.7 Blasting

Blasting activities shall take place more than 2km from settlement areas, cultural sites, or wetlands without
the permission of Employer/ Engineer.

Blasting activities shall be done during working hours, and local communities shall be consulted on the
proposed blasting times.

Ambient noise levels reaching the communities from blasting and other activities shall not exceed 55 db in
the daytime and 45 db in the nighttime.

3.8 Disposal of unusable elements

Unusable materials and construction elements such as electro-mechanical equipment, pipes, accessories
and demolished structures will be disposed off in a manner approved by Employer/ Engineer. CPECC agree
with Employer/ Engineer which elements are to be surrendered to the Employer’s premises, which will be
recycled or reused, and which will be disposed off at approved landfill sites.

As far as possible, abandoned pipelines shall remain in place. Where for any reason no alternative
alignment for the new pipeline is possible, the old pipes shall be safely removed and stored at a safe place
to be agreed upon with Employer/ Engineer and the local authorities concerned.

AC-pipes as well as broken parts thereof have to be treated as hazardous material and disposed of as
specified above.

Unsuitable and demolished elements shall be dismantled to a size fitting on ordinary trucks for transport.

3.9 Health and safety

In advance of the construction work, CPECC shall mount an awareness and hygiene campaign. Workers
and local residents shall be sensitized on health risks particularly of AIDS.

Adequate road signs to warn pedestrians and motorists of construction activities, diversions, etc. shall be
provided at appropriate points.

CPECC ensure that his construction crew are equipped with the necessary safety materials (helmets,
gloves, boots, etc.).

Adequate first aid facilities shall be provided at all sites where construction activities are being undertaken
and a Safety Officer shall be appointed who has first aid training and a knowledge of safety regulations.

3.10 Repair of private property

Should he deliberately or accidentally, damage private property, CPECC shall repair the property to the
owner's satisfaction and at his own cost. For each repair, CPECC shall obtain from the Owner a certificate
that the damage has been made good satisfactorily in order to indemnify the Employer from subsequent
claims.

In cases where compensation for inconveniences, damage of crops etc. are claimed by the owner, CPECC
shall inform the Employer. This compensation is in general settled under the responsibility of the Employer
before signing the Contract. In unforeseeable cases, the respective administrative entities of the
Employer will take care of compensation.

3.11 Training of CPECC’s personnel

CPECC shall provide sufficient training to his own personnel to ensure that they are all aware of the
relevant aspects of these general conditions, any project EMP, and it’s own EHS-MP, and are able to fulfill
their expected roles and functions. Specific training should be provided to those employees that have
particular responsibilities associated with the implementation of the EHS-MP. General topics should
include:

- EHS in general (working procedures);

- Emergency procedures; and

- Social and cultural aspects (awareness raising on social issues).

3.12 Fire risk reduction

During the construction phase the workers’ camps, warehouses and storage areas or sites for the project
shall contain firefighting equipment of recommended standards and placed in key strategic points all over
the proposed project site of the workers’ camps, warehouses and storage areas/sites.

They include:

• Fire pumps

• Hydrants

• Sprinklers/water spray systems

• Hosereels

• Dry chemical systems

• Carbon dioxide systems

• Detection/alarm systems

• Portable fire extinguishers among others.

A fire evacuation plan shall be posted in various points of the workers’ camps, warehouses and storage
areas/sites including procedures to take when a fire is reported. All workers must be trained on fire
management and fire drills shall be undertaken regularly.

4.0 Occupational Health Management

4.1 Responsibility

CPECC shall set up and develop the Health Risk Management System; keep the System in good
performance, and coordinate and resolve relevant matters of health management.

The HSE Dept. will organize to scrutinize information of the hydrological, geology, climate, infectious
diseases, endemics, medical treatment and epidemic prevention conditions, as well as sanitary resources.
They will prepare management and plan as per the investigation results, and organize to implement

CPECC will supervise and inspect for food hygiene, environment sanitation of the camping areas, potable
water hygiene, industrial conditions and infectious disease prevention activities etc., and CPECC shall
identify, evaluate, and control the health risk; also, CPECC will be responsible for the implementation of risk
reduction measurements.

CPECC is responsible for providing all required first aid and medical care for occupationally injured or ill
personnel, including transportation of employees to a physician, clinic, or hospital for treatment of routine
occupational injuries and illnesses.

CPECC shall ensure that all its personnel and/or other personnel assigned for the performance of the
WORK are medically fit and healthy. Any medical disabilities including such disabilities which CPECC
may consider will not adversely influence the person's ability to perform his role in the WORK should be
reported to OWNER prior to the start of the WORK. CPECC, if requested by OWNER, shall provide medical
certificates for all his employers.

CPECC subject its key personnel and its Sub’s personnel to regular medical examination at their cost.
Records of such examination shall be made available to OWNER on request.

4.2 Emergency Ambulance Service

Due to the remoteness or distance of the job site from the nearest available hospital, emergency ambulance
service must be established or provided by the . The ambulance shall be staffed by professionally trained
personnel and used for emergency only transportation of injured employees, to the nearest medical
treatment center.

Other transport will include an aircraft or helicopter on standby for emergency situations.

4.3 Minimum Medical Requirements

Minimum medical requirements have been established to ensure that proper and efficient care and facilities
are available at each of the project job-sites. The following provisions are the minimum guidelines which
shall be adhered to in establishing, implementing, and controlling medical services on the project job-sites.

(1) A qualified medical doctor, registered nurse or certified Red Cross Attendant shall be available at all
times during working hours to render first aid and medical care to occupationally injured or ill employees
(see section 2, Medical Doctor Qualifications, in Part 11).

(2) There shall be adequate medical supplies and equipment for the number of employees at the project
job-site and for the types of injuries anticipated as a result of the safety and health hazards at that location.

(3) Adequate equipment and arrangements for prompt transportation of ill and injured employees to the
nearest medical facility for continued treatment and care shall be provided.

(4) One or more properly equipped, manned, and supplied medical stations shall be situated to provide
easy access by employees.

Locations of physicians, emergency ambulance service, hospitals, and key personnel to be contacted in
case of medical emergencies shall be posted on each safety bulletin board.

4.4 Medical doctor Qualifications

4.4.1 Training and Experience

The physician shall have the training and experience to completely and competently render medical
treatment to occupationally injured or ill employees. Competency in vital life support techniques is
absolutely essential.

4.4.2 Resume of Qualifications

The physician shall be currently qualified. A copy of his resume showing his qualifications and place of
schooling, and a copy of his degree or license, shall be provided to the Project Management before coming
to the project.

4.5 Medical Station, Equipment, and Supplies

4.5.1 Location of Medical Station

The CPECC medical station shall be located as close as practical to the 's principal work area on the project
job-site, limited only by the means of communication. The station shall be open with the physician present
during all working hours.

4.5.2 Minimum Facilities Requirements

The minimum facility requirements for medical stations shall be as follows:

(1) Artificial light providing a minimum of 32.3 dekalux (30 foot-candles) of illumination.

(2) Heat and air conditioning as required.

(3) Hot and cold potable pressured water with a stainless steel or porcelain sink connected to an
approved wastewater disposal system.

(4) Desk with two straight chairs.

Figure II -1 shows the size and arrangement of a typical medical station trailer recommended for
construction job-sites with a peak of 500 or fewer employees. Exclusion of the safety office function
increases its capacity for first aid proportionately, to a peak of 700 employees.

Figure II - 2 shows the size and arrangement of a typical medical station trailer recommended for
construction job-sites with a peak of over 700 employees.

4.5.3 Recommended Medical Equipment and Supplies

Tables II - 1 and II - 2 show recommended medical equipment and supplies based upon actual
requirements of various construction job-sites. Quantities are based on an adjusted 1,000-man peak,
one-year job. Brand names and catalog numbers are indicated solely to assist in identification. It is highly
important that close equivalency be attained. Therefore, the purchasing supervisor must be cautioned to
compare substitutions very carefully with those on the list. Except for replacement of worn, broken, or lost
items, the quantities shown on the list of medical equipment should be sufficient for several years of use on
a job-site.

Physicians who are authorized to provide medical service to personnel may utilize such additional
medical equipment and supplies as are customary in their professions and that are authorized by the Kuwait
Government for use in such service.

4.6 Doctor, Hospital, and Ambulance Services

Although CPECC is fully responsible for obtaining and providing medical care for occupationally injured and
ill personnel, it is recommended that each confer with the Principal Project Manager at the project job-site
regarding the availability of local doctors and those in Kenya. The nearest available local hospital and those
in Kenya should also be discussed, because it may be necessary to contract for their services.

4.6.1 Local Doctors and Medical Care Facilities

CPECC is responsible for making arrangements for the services of a physician and hospital for the medical
care of its injured and ill employees.

4.6.2 Ambulance Services

See Section 1, in Part II for a Description of Emergency Ambulance Service, which is responsible for
emergency and routine (non emergency) ambulance service.

4.6.3 Order for Medical, Surgical, or Hospital Services

This is a sample form which can be used to accompany each injured or ill employee sent to a physician for
treatment.

This form can be given to the physician, thereby authorizing him to provide necessary treatment. A copy is
included as Exhibit 1 of Part II.

4.6.4 Medical Report

This sample form (included as Exhibit 2 of Part II) is intended for use by the physician providing medical
treatment to an occupationally injured or ill employee. The form provides with a short report of diagnosis,
treatment, and medical limitations, if any, by which is able to properly handle the employee's reassignment
to work or recuperation. Additionally, the data on the form enables to complete and submit any immediately
required insurance reports.

This report shall not be confused with a doctor's or physician's report, customarily required to be prepared
by the treating physician and submitted to the employer for transmittal to the employer's workmen's

compensation insurance carrier. Such reports are quite detailed and normally require several days before
they can be completed. On the other hand, the Medical Report Form, should be given to the treated injured
or ill employee, or the form can be returned by others, in the event immediate hospitalization is required.

4.7 Emergency Transportation

4.7.1 Doctor

The onsite emergency transportation system for getting aid to the injured, and for moving the injured to a
hospital, shall be periodically reviewed. Based upon the reviews, appropriate directives shall be issued to
ensure that the physician will arrive at the location in a timely manner, properly equipped and supplied to
render prompt and effective medical care.

4.7.2 Patient

Ambulance service should be used to transport seriously injured personnel to the hospital. Because of the
distance of the project from the nearest available hospital, the use of vehicles other than ambulances
should be avoided, if at all possible.

The telephone number of the ambulance service shall be prominently posted on all safety bulletin boards
throughout each job-site.

4.7.3 First Aid and Medical Reports

4.7.4 Introduction

Accurate and concise reports of first aid and medical treatment for occupationally injured and ill employees
are essential to the effective implementation of corrective measures for the unsafe conditions or acts which
caused the injuries and illnesses.

4.7.5 Contractors

All contractors, including CPECC, shall record their employee occupational injuries and illnesses on the
following forms:

(1) First Aid Treatment Log (Exhibit 3 in Part II).

(2) Log and Summary of Occupational Injuries and Illnesses (Exhibit 4 in Part II).

These logs shall be available for examination by OWNER or Project Management at all times. The
recording of employee occupational injuries and illnesses on the above forms shall be in accord with the
requirements in ANSI Z16.4-1977, American National Standard for Uniform Record Keeping for
Occupational Injuries and Illnesses.

4.7.6 Monthly summary of Injuries and Illnesses

As part of a continuing effort to involve all construction personnel in the prevention of accidents, each is
required to inform its personnel of the statistics of principal occupational injuries and illnesses that occur.
This is accomplished by posting a monthly summary of the injuries and illnesses.

5.0 HSE TRAINING

5.1 Purpose

Outline the program for HSE training of field construction personnel and for making them aware of their
assigned responsibilities and duties. The intention is not to specify what training all must have, but to
suggest training, which a typical workforce could have.

5.2 Scope

The scope of this procedure applies to all CPECC personnel that require appropriate training, qualification,
or certification to contractually complete the tasks assigned to them.

5.3 Responsibilities

The field Safety Manager/Safety Trainer is responsible for the preparation and presentation of training
material that pertains to the field safety. He is also responsible for assisting the Project Manager in the
preparation and presentation of indoctrination and training material to project personnel on an as-requested
basis.

5.4 Procedure

5.4.1 Designated safety, personnel assigned to specific tasks or project where general and special training,
certification or qualification is required, shall attend and successfully complete the appropriate training
program. Safety personnel must meet other prerequisites of the governing code, specification, or other
document.

5.4.2 The general training includes familiarization with the Project HSE Policy and construction safety in all areas
of the project.

5.4.3 The project-specific training and indoctrination program provides specialized training in compliance with
qualification and certification requirements of applicable codes, standards and specifications.

5.5 Documentation

5.5.1 Safety personnel successfully completing training programs and meeting all other prerequisites of the
governing code, specification as applicable:

1) Certificate of Completion of the specific training program.

2) Certification to perform a specific task or function.

3) Qualification in the specific task or function.

5.5.2 The documentation of training and orientation of safety personnel assigned to the project is prepared by

6.0 HSE MEETINGS AND AUDITS

6.1 Construction Equipment safety Inspections

Prior to WORKS, all equipments shall be inspected by OWNER Representative(s) and also by CPECC,
satisfied for operation and must meet all OWNER’s safety specifications and regulations. The requirement
applies to equipment owned by the contractor and user, as well as that which is rented, whether rented bare,
with operator or, operator-and-maintained. This section provides the initial inspection requirements which
are applicable to that equipment.

6.1.1 Cranes

Refers to Section 4 of Part IV, Crane Safety Inspection. The annual inspection items shall be applied as the
initial inspection requirements.

6.1.2 Passenger Automotive Vehicles

Passenger automotive vehicles shall include all automobiles, pickup trucks, vans, and buses. The required
safety equipment or functions and the operational standards are as follows:

(1) Two headlights required, one on each side with high and low beams. Both shall be fully operational.

(2) Two red taillights and two red stoplights, one on each side and fully operational; the stoplights shall be
activated at the start of depressing the brake pedal. The taillights shall be activated when either the parking
lights or headlights are turned on. Each vehicle shall also have operational direction signal lights front and
rear.

(3) Service brakes and hand-or foot-operated parking (emergency) brake. Service and parking brakes
shall be adequate to control movement, to stop, and to hold the vehicle under all conditions of service.
Service brakes shall be so designed as to be in approximate synchronization on all wheels and to develop
the required braking effort on the rear wheels first. Required stopping distances on a dry, smooth, level
road upon application of the service brakes: within 9 m at 12.5 kph (within 30 ft at 20 mph).

(4) Speedometer, fuel gauge, and horn in proper operating condition.

(5) Vehicles with a windshield shall be equipped with an operable windshield wiper and windshield washer,
at least on the driver's side.

(6) Inside rear-view mirror. Outside rear-view mirrors may be substituted for the inside rear-view mirrors,
but there shall be one side of the vehicle which provides an unobstructed rear view for the driver.

(7) Safety glass in windshield, side, and rear windows.

(8) Power-operated starter.

(9) Seat and shoulder belt for driver and each passenger in the front seat; seat belts for each rear seat
passenger. Seat belts shall be anchored to the frame of the vehicle in an approved manner.

(10) Head restraints for the driver and one passenger in the front seat.

(11) Pick-u p truck only: a tailgate is required with a positive latching system and a permanently attached
restraining mechanism which permits the tailgate to be lowered to a horizontal position only.

(12) Buses only: there shall be a secondary or emergency exit at the rear of the bus; the emergency exit or
door shall also be capable of being opened from the outside.

6.1.3 Air Compressors

Air tanks in excess of 0.045 cu m (1.5 cu ft) and 1.05 kg/sq cm (15 psi) internal or external pressure shall
be inspected internally and externally and certified as safe to operate at the required pressure. A copy of
the inspector's certificate shall be immediately available. Inspectable air tanks, for which there is no
certification to operate, shall be inspected after arrival at the job-site and prior to being placed into service.
A certified inspector is a person who has been certified by a government agency as competent to inspect
unfired pressure vessels which are subject to the requirements of the ASME Boiler and Pressure Code,
Section VII, Division I, Pressure Vessels.

Each compressor shall be inspected, and the inspection shall be recorded on SSD-E1-101, Equipment
Inspection Report (Exhibit 2 in Part IV). Any condition classification of "poor" on any item of the inspection
except "paint" shall preclude the use of the compressor until the condition is repaired or protected in such a
manner as to prevent damage to the compressor and injury to personnel. A copy of the equipment
inspection report shall be immediately available at all times. Each compressor shall be re-inspected
annually.

6.1.4 Welding Machines

Each welding machine shall be inspected between the time it arrives at the job-site and the time it is put
into service. The inspection shall be recorded on SSD-E1-101, Equipment Inspection Report (Exhibit 2 in
Part IV). Any condition classification of "poor" for any item of the inspection except "paint" shall preclude the
use of the machine until the condition is repaired or protected in such a manner as to prevent damage to
the welding machine and injury to personnel. A copy of the Equipment Inspection Report shall be
immediately available at all times. Each welding machine shall be re-inspected monthly.

6.1.5 Pumps (Excluding Fractional Horsepower Pumps)

Each pump shall be inspected and the inspection shall be recorded on SSD-E1-101, Equipment Inspection
Report, in a manner similar to that required for welding machines, except for the specific items of inspection
which shall be those listed for pumps on the report form.

6.1.6 Vibrators (Excluding Pneumatic, Hand-Held Pumps)

Each vibrator shall be inspected and the inspection shall be in accordance with the specified items and
recorded on SSD-EI-101, Equipment Inspection Report.

6.1.7 Food Preparation Equipment

Each powered or pressured item of equipment used in the preparation of food shall be inspected at the time
of initial installation and at least every six months thereafter. The inspection shall include and examination
of all parts that touch food to determine that they are free of any apparent foreign matter that may
contaminate the food, that all connections are tight, gas lines are adequately supported, no electrical wiring
is exposed, and all required guards are in place.

The inspections shall be recorded on SSD-EI-101, Equipment Inspection Report, in the section titled "Other
Equipment".

6.1.8 Equipment Not Listed

Other equipment not listed herein may be added to the list of equipment that must be inspected. The
frequency of inspection may be established by Project Management.

6.2 Safety Meetings

Comprehensively planned, regularly scheduled, and competently managed safety meetings comprise one
of the most effective means by which the contractor and user can instruct employees regarding safe work
practices.

The time, place, subject, and manner of delivering a message are critically essential to effectiveness of
these meetings. Midweek and mid-morning or mid-afternoon are the least disruptive times for such
meetings. The place must be reasonably comfortable and relatively quiet (shaded, enclosed). Principal
topics must be appropriate for current work and hazards. Concise, half-page typed statements of principal
topics should be issued to foremen. The agenda should be prepared, typed, and issued to participants in
foremen and staff safety meetings.

6.2.1 Craft safety Meetings (Tools Box Safety Meetings)

Craft safety meetings shall conform to the following guidelines.

(1) The minimum frequency of the meetings is weekly.

(2) The subject shall be pertinent to the work currently being performed.

(3) The subject material shall be typed, reproduced, and distributed to each foremen/(crew) supervisor at
least one work day before its scheduled use.

(4) The meetings shall be conducted by each foreman/supervisor with his crew at the designated time,
using the subject material furnished.

(5) The meeting shall provide employees with the opportunity to ask questions or to make suggestions.

(6) The actual meeting time must be of at least 10 minute duration.

6.2.2 Foremen’s Monthly Safety Meetings

The foremen/ (crew) supervisor monthly safety meetings shall conform to the following guidelines.

(1) The subject material shall be pertinent to the work currently being performed.

(2) The following basic items shall be included with the subject of each meeting,

(a) Review of doctor cases since the last meeting, identifying the principal accident causes and crafts
involved, including accident prevention actions that were and shall be initiated by responsible individuals.

(b) Review of the most frequently noted serious, non-serious, and repeated safety violations, including
corrective action required by responsible individuals.

(3) The subject material shall be typed, reproduced, and distributed to the foreman at least one week
before the meeting. Additional copies shall be available at the time of the meeting.

(4) Group discussion on methods of correction, prevention, and improvement shall be encouraged.

(5) Bona fide safety complaints shall be discussed and, if at all possible, resolved.

(6) Foremen/ (crew) supervisors shall be selectively assigned to two groups, each meeting at different
times, in order to ensure that adequate supervision remains in the field and at the workplace.

(7) Attendance at these meetings shall be mandatory.

(8) The actual meeting time shall not exceed 20 minutes, except in unusual circumstances with the prior
approval of the manager or superintendent.

6.2.3 Contractor and User Monthly Staff Safety Meeting

Contractor and user monthly staff safety meetings shall generally conform to the following guidelines.

(1) The subject shall be pertinent to work currently being performed.

(2) The following basic items shall be included with the subject of each meeting.

(a) Review of doctor cases since the last meeting, identifying the principal accident causes and crafts
involved, and including accident prevention actions that were and shall be initiated by responsible
individuals.

(b) Review of the most prevalent serious, non-serious, and repeated safety violations, including corrective
actions required by responsible individuals.

(3) Group discussion on methods of correction, prevention, and improvement shall be encouraged.

(4) Bona fide safety complaints shall be discussed and, if at all possible, resolved.

(5) The actual meeting time shall not exceed 30 minutes, except in unusual circumstances with the prior
approval of the project manager.

(6) These safety meetings must include top supervisors from all departments.

7.0 REPORTING

All safety meetings are to be minuted and fowarded to OWNER Representative in two days after they have
been held.

All emergency drills are also to be forwarded to the OWNER Representative in two days after they have
been held.

All safety audits are to be reported to OWNER Representative monthly, with action points listed.

All accidents and incidents related to the operation shall be reported to OWNER representative, within
twenty four (24) hours in the event of :

(1) Any loss of or damage to material or equipment supplied by either the OWNER or CPECC.

(2) Any personal injury to any OWNER or CPECC Personnel, CPECC agents or sub-vendors.

(3) Any injury to any third party.

(4) A near miss incident.

A full detailed report via telex or fax sent to OWNER within twenty four hour (24) hours and an Accident or
Incident Report filled out by the CPECC purchase agreement Administrator immediately.

8.0 SAFETY TOOLS AND EQUIPMENT

The use of correct, properly designed and serviceable tools and safety equipment is required. All working
personnel should be taught the proper and correct way of using safety tools and equipment.

(1) Fire-Fighting Equipment

Fire-Fighting systems are to be checked and tested periodically.

All fire extinguishers are to be checked and certified semi-annually.

Fire extinguishers and fire hose stations are to be prominently marked.

Fire water pump to be inspected, serviced regularly and maintained in operational mode at all times.

Alarm system to be tested during every drill.

Fire axes are to be strategically located.

(2) First Aid and Survival Equipment

Adequate number of first-aid boxes and resuscitation units are to be placed at strategic points.

First aid boxes are to be inspected regularly and stocks replenished.

Prescription drugs are to be certified by druggist and kept under lock. Drugs can only be
administered with the consent of the Party Chief or the Safety Officer.

All protective equipment is to be of types manufactured to standards and approved by OWNER.

Safety shoes must be worn by all personnel at operation areas.

Hard hats are to be provided for personnel working nearby operation areas.

Face shields, eye goggles or welding shields as appropriate are to be provided in the vicinity of
rigfloor, shale shaker and mudtank.

9.0 EMERGENCY EQUIPMENT AND PROCEDURES

9.1 Emergency Procedure

9.1.1 Scope

This procedure is designed to enable the management of CPECC to control the coordination of an
emergency occurring at one or more of the construction site locations. It will come into operation once the
senior CPECC person or the person who raises the alarm, decides they need additional support and
resources from OWNER.

For the purpose of this procedure emergencies are defined as the following:

Fire - Explosion - Oil Spill - Chemical Spill - Accident - Traffic Accident - Oil or Gas Leak.

NOTE: The Clients classification (GUIDELINE ONLY AT THIS TIME SUBJECT TO CONFIRMATION AND
DISCUSSION) of an emergency and its category are in section 5. of this procedure and should be complied
with at all times.

9.1.2 Objectives

To have a plan in place and to respond to any emergency as quickly as possible with all personnel aware of
their duties and role if they are in the emergency response team. To bring any emergency under control as
soon as possible and return the site to normal operations.

9.1.3 Application

To the work site areas of the project including the office location, camp facilities, storage yard. Note also by
category of incident as identified by OWNER Safety Regulations.

9.1.4 Responsibilities and Duties

9.1.5 Definitions

Classification of an Emergency:

Category 0:

Minor fires, hydrocarbon spillage, leaks and injury which can effectively be dealt with by personnel on the
spot.

Plans should include:

1) Communications procedures.

2) Means of dealing with the incident.

3) Maintenance of unit in a safe condition.

4) Closing off the area in the event of toxic or flammable gas escape.

5) Reporting and controlling procedure.

Category 1:

An event greater than a minor incident not hazardous to human life or operations but calling for the support
of other personnel, together with trained fire fighting personnel.

Plans should include:

1) Call-out of appropriate personnel.

2) Warn appropriate departments.

3) Regard for possible escalation.

Category 2:

An incident of major proportions calling for involvement of all emergency services ill addition to those
mentioned above. An incident not immediately hazardous to life or property but could do so if not controlled.

Plans should include:

1) Call-out of fire and safety services to a previously arranged schedule.

Category 3:

An emergency of disaster proportions causing or threatening death, injury or disruption to large number of
people and calling for immediate action by all emergency services.

Plans should include:

1) All the considerations mentioned for other categories.

2) Smooth but rapid build-up of resources.

3) Alerting of local hospitals.

4) Arrangements to supplement and support local resources by pre-arranged mutual aid schemes or
more distant resources.

Definition of a Major-Incident.

Any incident classified as Category 2 or Category 3 will be considered a major incident and will be dealt
with under the Major Incident Procedure.

Declaration of a Major Incident:

Situations as outlined in (Category 2 or 3) above wi1l require an immediate response by Fire and Safety
Division. Superintendent/Manager Fire and

Safety, his deputy or any departmental/divisional head, will invoke the major incident procedure through fire
and safety control room.

Alternatively, it may be initiated immediately after information makes it apparent that a disastrous situation
exists or is threatened.

9.1.6 Ensure Readiness

At all times to provide a quick response, nominated personnel as per the emergency response plan, must
ensure that personnel under their control, are familiar with their duties if an emergency incident occurs.

Make sure lists of call-out personnel are updated and checked and any substitutes made, are clear, to all
parties concerned.

9.1.7 Reporting

Following any emergency and to comply with Client requirements, we must inform them of any emergency.

Follow their guidelines on, who to contact, where and by what means.

Events of emergency must be recorded and records kept.

Forms (ERP1-10) must be used for the record and to assist with personnel identification.

9.2 Emergency Response

CPECC shall where applicable at its own expense provide adequate first aid, fire fighting, life saving and
other safety equipment and shall maintain this equipment in a professional manner and where appropriate
re-certify as dictated by legal and industry standards. CPECC shall keep up-to-date records of all said
equipment, including equipment location plans.

10.0 ACCIDENT REPORTING AND INVESTIGATION

10.1 Scope

This procedure covers the investigation and reporting of all types of Accident / Incidents. It details the
interface between the Safety Security Department and other parties concerned.

10.2 Application

This procedure is applicable to all CPECC personnel and their subs working on Company
Project/Contracts.

10.3 Objectives

10.3.1 To ensure that all accidents, property damages and near misses are properly reported in accordance with
CPECC Procedures and OWNER Safety Regulations.

10.3.2 To ensure that all accidents, identify shortcomings or non-compliance with safe systems of work procedures
and identify corrective actions to prevent a reoccurrence.

10.3.3 To involve line management in the review of accident information in order to obtain their recommendations
for improving safety performance..

10.3.4 To inform Management, Project Director /Project Manager, of all major events (Accident , Property
Damages and Near Misses) in order to exchange thoughts and experience in order to prevent similar
accidents/incidents.

10.3.5 To provide information to the Safety Security Department on current trends in losses and injuries to
personnel in order to present the facts and provide information for management action.

10.4 Definitions

Accident

Any unintentional or unplanned event or condition which has or could have resulted in injury to a person
and loss or damage to equipment, plant or property..

Incident

An event which, under slightly different circumstances, could have resulted in harm to people, damage to
property or loss to processes .It refers also to an event which may or may not result in a loss.

Fatality A death resulting from a work injury regardless of the time intervening between injury and death.

Permanent Partial Disabilities

Any work injury which results in a complete loss, or permanent loss of use , of any member or part of the
body or any permanent impairment of functions of parts of the body, regardless of any per-existing disability
of the injured member or impaired body function.

Permanent Total Disabilities

Any work injury which incapacitates an employee permanently and results in termination of employment.

Lost Time Accident (Lost Work Days)

Any day after the initial day of injury that the employee’s inability, because of injury or job related illness
prevents him/her to be present during his/her normal work shift, (except on holidays/vacations etc.).

Near Miss

An event which did not, but could have, resulted in harm to people, damage to the company or third party or
the environment.

Event

Is the circumstances leading to any of the following: ACCIDENT / INCIDENT / DAMAGE / NEAR MISS /
FIRE / POLLUTION and LOSSES.

Corrective Action

It is the identified actions which should be undertaken to rectify or dispose of a safety non-conformance,
failure in systems or work practice.

Action Party

Is the party responsible for taking identified action.

Target Date

Date set by which time the Corrective Action should have been completed.

10.5 Procedure

CPECC shall follow OWNER Safety Regulations, regarding investigating and reporting of accidents and
incidents.

Following any accident that causes a fatality or damage to CPECC, Client or sub property the event must
be immediately and briefly reported to appropriate:

Project Director

Project Manager

Legal department

Safety Security Manager

and at the same time CPECC will take the following actions:

Complete the OWNER Safety Report Format as requested.

10.5.1 Completing the Form SSD Doc.7/AIIR

10.5.1.1 Immediate Supervisor in charge of person / area involved is responsible for investigating the event and
completing all parts of the Report Form S.S.D.Doc.7/A.I.I.R.except parts BTU and V.

10.5.1.2 Upon completion of the report, Supervisor shall forward the completed form to his Project Manager/ Deputy
Project Manager to review and discuss the completed parts of the report, in particular parts M and N.

10.5.1.3 Supervisors responsible for completing the Form have the right to seek any advice / information from others
regarding parts N,O and P of the Report Form.

10.5.2 Reviewing the Completed Form

10.5.2.1 The responsibility for reviewing the completed form falls with either the Project Manager or Deputy Project
Manager. He should complete Part T.

10.5.2.2 He shall discuss whether or not the immediate action taken by the supervisor in order to prevent
re-occurrence of similar accident (part M) is suitable and sufficient.

10.5.2.3 If “YES” he shall close out the report and forward to Safety Security Department for information and further
distribution.

10.5.2.4 If not satisfied with the immediate corrective action taken, he shall list corrective action(s) still required,
identifying Action Party and Setting a Target Date for rect-ification..

10.5.2.5 He is also responsible for monitoring and updating Safety Security Department on the progress of
corrective action.

10.5.2.6 He is responsible also for forwarding the completed Form to the concerned party as per (U) “distribution”
ad-hearing to the time scale detailed in section 6.3

10.5.3 Time Scale and Distribution

10.5.3.1 Class A

Accidents/Incidents falling under Class A must be reported by the fastest means (FAX) within a time scale
not more than 2 hours, to all the following management:

Security Manager.

Following that and in less than 24 hours, the accident/incident investigation report form SSD Doc.7/AIIR
must be completed as per section 6.1 and 6.2 above and sent to the appropriate Managers (Project/Safety),
who will review and further distribute the report as detailed in Part (U) of the report form.

On receipt of the report the Project director shall determine the seriousness of the accident, he will decide if
the matter should be referred to an “accident investigation committee” and if so will summon a committee
which shall include as permanent members the following personnel:

Project Director/Project Manager/Deputy Project Manager/Construction Manager/Safety Security


Manager/Safety Engineer.

10.5.3.2 Class B

All accidents incidents falling under Class B must be reported using Form SSD DOC7/AIIR.It must be
completed as per section 6.1 and 6.2 above and Safety Security Manager, appropriate Project Manager
and Legal Department within 24 hours of the incident’s occurrence.

Project Manager involved is responsible for further distribution of the report (if necessary).

10.5.3.3 Class C

All Accidents /Incidents falling under Class C must be reported using the Form S.S.D.Doc.7/ A.I.I.It must be
completed as per Sections 6.1 and 6.2 above and reach Safety Security Manager appropriate Project
Manager and Legal Department (for damages/ losses incidents) within 48 hours of the incident occurrence.

10.5.3.4 Class D

For near Misses (Dangerous Occurrence) Form S.S.D.Doc.7/A.I.I.R..must be completed as stated in 6.1
and 6.2 of this procedure and forwarded to Safety and Security Manager for evaluation of corrective action
taken and further distribution if necessary.

The report should reach Safety and Security Department within a maximum of one week from the incident
occurrence.

10.6 General Instruction-Guidance

10.6.1 Where witness statements are taken these will be written on Form S.S.D Doc.

7/WS and witness statements shall be attached and sent along with the Report Form.

10.6.2 Where an accident involves more than one injured person a separate sheets to the Report Form.

10.6.3 Supervisor should also attach sketches, photographs and /or additional sheets to the report if necessary.

10.6.4 In case of fire/explosion the report must be completed as stated in Section 6.6.1& of this procedure, also
the Safety Coordinator must keep a record of any fire fighting equipment used.

11.0 ALCOHOL/ DRUG POLICY

CPECC shall strictly prohibit the consumption of alcohol and drug at all work sites and residential
accommodations.

CPECC shall abide by the statutory rules, laws and the decrees of the State of Kenya in relation to the
handling holding and consuming alcohol or any other intoxicating substances.

No employees or visitors shall enter into the company premises or shall not work for the company under the
influences of alcohol and or prohibited drugs.

If anyone found violating the rules shall immediately be terminated from the company and such cases shall
be referred to the enforcement authorities of the government of Kenya.

CPECC is to conduct alcohol and/or drug tests on its personnel, agents or Subs while on premises owned
or controlled by OWNER where reasonable cause exists. Any person who refuses to cooperate with any
such search shall be removed and not permitted to return.

CPECC shall require its personnel, agents and Sub to submit to medical evaluation on alcohol or drug
testing where cause exists to suspect alcohol or drug use.

CPECC shall maintain strict discipline and good order among its personnel, agents and Subs, and shall not
permit any of them to engage in activities which OWNER deems contrary or detrimental to OWNER’s
interests. If OWNER request that any personnel of CPECC or of Subs be removed from OWNER’s
property or Work site pursuant to this purchase agreement for any reason CPECC shall accede to such
request and shall provide a replacement acceptable to OWNER at no additional cost to OWNER.
