AFFIDAVIT OF DESISTANCE

I, AAA (for herself and as the legal guardian of the minor, BBB), of legal age, Filipino, and a
resident of Barangay _____________, after having been duly sworn to in accordance with law,
depose and state that:

1. I am the private complainant (on behalf of my minor daughter, BBB) in Criminal Cases No.
123, 345, 567, 678 (For: Statutory Rape under Art. 26-A (1) in relation to Art. 266-B of the
RPC, as amended by RA 11648 under paragraph 1 (d) of Art. 266-A of the RPC, as
amended by Sec. 1 of RA 11648) against accused CCC, pending before the Regional Trial
Court Branch 111;

2. After careful consideration and analysis of the incidents complained of, I have realized that
there was misapprehension of facts on our part when we filed the instant complaints against
the accused;

3. Given that we could not state with utmost certainty and without doubt the liability of CCC,
in fairness to him, we are withdrawing our criminal complaints against the said accused;

4. We hereby inform the Provincial Prosecution Office of Sorsogon that we are withdrawing
our complaint for Statutory Rape in Criminal Cases No. 123, 345, 567, 678 2, entitled
“People of the Philippines vs. CCC,” pending before the Regional Trial Court Branch No.
111;

5. We likewise request the Regional Trial Court Branch 111 to dismiss the said criminal cases
against the accused;

6. We attest that we have freely and voluntarily executed this Affidavit, and that no one has
employed any force, intimidation or coercion for us to execute the same.

7. We are executing this Affidavit to attest to the truthfulness of the foregoing statements, to
desist in the further prosecution of the above-mentioned criminal cases, and for whatever
legal purpose this may serve.
