DECLARATION OF HEIRSHIP
WITH SPECIAL POWER OF ATTORNEY
KNOW ALL MEN BY THESE PRESENTS:
We, CLARITA SOMBILONA DE LA NOCHE, widow, LYRA GRACE
DE LA NOCHE JAVIER, married, PEARL JOY DE LA NOCHE PADRONIA,
married, DEXTER JOHN S. DE LA NOCHE, married, and MARK BRIAN S.
DE LA NOCHE, married, all of legal ages, and residents of Brgy. Alangilan,
Bacolod City, Philippines, hereinafter referred to as “HEIRS”, do hereby declare
as follows that;
1. I, CLARITA S. DE LA NOCHE, is the surviving spouse of the decedent
OLIMPIO TACADAO DE LA NOCHE JR. who died on June 4, 2020, at
Bacolod City, Philippines
2. We, LYRA GRACE DE LA NOCHE JAVIER, PEARL JOY DE LA
NOCHE PADRONIA, DEXTER JOHN S. DE LA NOCHE, and MARK
BRIAN S. DE LA NOCHE are the surviving children of the decedent
OLIMPIO TACADAO DE LA NOCHE JR;
3. We are the only surviving and lawful heirs of the decedent OLIMPIO
TACADAO DE LA NOCHE JR.;
4. The decedent OLIMPIO TACADAO DE LA NOCHE JR. died intestate,
without leaving any Last Will and Testament, and without leaving any
debts or account whatsoever;
5. During his lifetime, the decedent left several personal properties owned in
common with his wife, among others are the following bank accounts,
hereto attached as Annex “A” and made an integral part hereof:
1. PHILIPPINE NATIONAL BANK (PNB) LACSON BRANCH under
Account No. 307710073727 with an existing amount of P8,667.41 as of
June 24, 2020;
2. PHILIPPINE NATIONAL BANK (PNB) LACSON BRANCH under
Account No. 013077600001619with an existing amount of P101, 694. 93
as of June 24, 2020
6. It is in the very best interest of the Heirs hereto to adjudicate unto
themselves the OWNERSHIP, TITLE, and INTERESTS over the above-
described bank accounts;
7. For and in consideration of the foregoing premises and invoking the
provision of Section 1, Rule 74 of the Rules of Court, the above-named
HEIRS have agreed to settle extrajudicially and to this effect adjudicate the

same unto ourselves OWNERSHIP, TITLE, and INTERESTS over the one-
half (1/2) of the decedent in the above-described bank accounts, share and
share alike.
8. We agree to publish this instrument in a newspaper of general circulation
in the City of Bacolod, province of Negros Occidental once a week for
three consecutive weeks.
9. We, We, LYRA GRACE DE LA NOCHE JAVIER, PEARL JOY DE LA
NOCHE PADRONIA, DEXTER JOHN S. DE LA NOCHE, and MARK
BRIAN S. DE LA NOCHE, do hereby authorize and do hereby constitute
CLARITA SOMBILONA DE LA NOCHE, to be our true and lawful
Attorney-in-Fact to withdraw all the amounts on the above-mentioned
Bank Accounts on our behalf, and to sign any document necessary to carry
into effect the powers herein conferred.
10. This instrument was executed out of the parties’ free will, without force,
and intimidation or violence upon their person, and that they have no
more claim, or demand against each other in connection with the
adjudication of the above-described Bank Account
IN WITNESS WHEREOF, the parties have hereunto affixed their signatures
