Observed no food manager certification is expired.

§228.31. Responsibility. 228.33 (a) Except as specified in subsection (b) of this section, the permit holder
shall be the person in charge or shall designate a person in charge and shall ensure that a person in
charge is present at the food establishment during all hours of operation where food or drink is
manufactured, produced, processed, prepared, served or otherwise manipulated. (b) In a food
establishment with two or more separately permitted departments that are the legal responsibility of the
same permit holder that are located on the same premises, the permit holder may, during specific time
periods when food is not being prepared, packaged, or served, designate a single person in charge who is
present on the premises during all hours of operation, and who is responsible for each separate permitted
food establishment on the premises.
A certified food manager is required, within 10 days.
A citation will be written for a repeat offense.

Observed missing thermometers Provide thermometers within 10 days. Thermometers shall be provided,
accurate, and accessible. §228.112. Utensils and Temperature and Pressure Measuring Devices. (a) Good
repair and calibration (3) Ambient air temperature, water pressure, and water temperature measuring
devices shall be maintained in good repair and be accurate within the intended range of use. Note: A
working thermometer shall be placed at the door in the warmest spot of the cooler with a reading of 41°F
or less. 228.108. Utensils, Temperature Measuring Devices, and Testing Devices (b) Food temperature
measuring devices. Food temperature measuring device shall be provided and readily accessible for use
in ensuring attainment and maintenance of food temperatures as specified under Subchapter C of this
chapter (relating to Food).

Observed equipment not in use needs to be removed. Storing maintenance tools. Maintenance tools such
as brooms, mops, vacuum cleaners, and similar items shall be:
(1) stored so they do not contaminate food, equipment, utensils, linens, and single-service and single-use
articles; §228.186
(2) stored in an orderly manner that facilitates cleaning the area used for storing the maintenance tools.
Maintaining premises, unnecessary items and litter. The premises shall be free of: (1) items that are
unnecessary to the operation or maintenance of the
establishment such as equipment that is nonfunctional or no longer used
