PETITION UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA


FOR ISSUANCE OF APPROPRIATE WRIT, ORDER, OR DIRECTION IN
THE NATURE OF MANDAMUS FOR THE PROTECTION OF PUBLIC
HEALTH AND HYGIENE IN PUBLIC AREAS

MOST RESPECTFULLY SHOWETH:

1. That the present petition is being filed in the public interest under Article 226 of
the Constitution of India to address the serious issues of improper garbage
disposal, unsanitary conditions, and lack of adequate waste management in public
areas of [specific location or city].

2. That the petitioner has no personal interest in the litigation and is approaching
this Hon’ble Court solely to protect the health and welfare of the public at large.

3. That the petitioner submits that the Respondents, being responsible for
sanitation and waste management, have failed to maintain cleanliness in several
public areas, including markets, parks, and residential zones, thereby endangering
public health and causing immense inconvenience to the citizens.

4. That, despite numerous complaints from the residents, the Respondents have
failed to take effective steps to ensure proper garbage collection, disposal, and
sanitation measures in the affected areas. Open dumping of waste and overflowing
garbage bins have created breeding grounds for diseases, rodents, and mosquitoes,
posing severe health risks to the public.

5. That the lack of sanitation and proper waste management violates the
fundamental rights of the citizens under Articles 14 and 21 of the Constitution of
India, specifically the right to a clean and healthy environment. The inaction of the
Respondents is causing environmental degradation and infringing on the citizens'
right to a dignified life.

6. That the petitioner is filing this petition to seek judicial intervention for the
enforcement of statutory obligations regarding waste management and public
cleanliness, and to ensure that adequate resources and practices are put in place by
the Respondents to protect public health and hygiene.

PRAYER:

In light of the above, it is respectfully prayed that this Hon'ble Court may be
pleased to:

1. Issue a writ in the nature of mandamus or any other appropriate writ, order, or
direction, directing the Respondents to implement a systematic and regular garbage
collection and disposal mechanism in public areas, with a monitoring mechanism
to prevent future negligence.

2. Direct the Respondents to increase the number of waste bins and deploy
sanitation workers to maintain cleanliness in all designated public areas within
[City/Location].

3. Direct the Respondents to create awareness campaigns promoting cleanliness


and the proper disposal of waste among the citizens.

4. Grant any other relief that this Hon'ble Court deems just and proper in the facts
