RULES & REGULATIONS

Interpretation:
In these rules, the following words and abbrevations shall have the meanings given to them,
unless there is anything contrary in the subject or context:
(a) Unless otherwise contrary to the context, the expressions ‘Society’ will mean the
Association namely “Insert Name” constituted under these rules.
(b) "Insert Abbreviation of Society’s name (if any)" shall mean the “Insert Name”
(c)"Central Government" shall mean the administrative ministry of the Government of India
concerned with any Ministry ( if any)
(d) "Delhi Administration" means the administration of Union Territory of Delhi.
(e)"General Body" shall mean the general body of the CATS. “Governing Body" shall mean
the governing body of the abbreviation of Society’s Name.
(f)"President" shall mean the President referred to in these rules.
(g)"Director" shall mean the Director of Insert Name appointed under the rules.
(h)"Chairman" shall mean the Chairman of the governing body of the Insert Name.
(i) "Secretary" shall mean the Secretary of the Insert Name appointed in accordance with the
rules and regulations of the Society.
(j) ‘Executive Committee’ will include all the office bearers and executive members.
‘District Association’ will mean any association formed by rice millers of a concerned district
mutually or under any statute.
(k) “General Body” means all the members of the society shall/will constitute the General
Body.

Extent:
The Association’s activities will be spread over whole of National Capital Territory of Delhi
and will also include interactions with GOI relating to matters concerning our State. The
Association may be affiliated to “Insert Name” and/or with any other Association upon
payment of usual subscription, if any subject to prior approval from the Executive Body.
Membership:
General Body of Abb. Name shall consist of all members of the Governing Body set up
under Clause No1 of these rules and such other persons who may be nominated by the
President from time to time.

A person shall cease to be a member of the governing body, or of the society if he :-
(i) resigns, (ii) becomes of unsound mind, (iii) becomes insolvent, (iv) is convicted of a criminal offence
involving moral turpitude,
Membership will be restricted to the Insert Name and will be issued in the name of the Insert
Name Unit functioning in the National Capital Territory of Delhi upon application in the
prescribed format along with Annual Subscription as may be applicable from time to time.
The screening of the application forms will be done by the screening committee consisting of
President, Secretary and Treasurer or may be decided by the Executive Committee.
Abb. Name shall function' notwithstanding any vacancy in its Body and no act or proceedings
of the Abb. Name shall be invalid merely by reasons of such vacancy or any defect in the
appointment of any of its members.
Annual Subscription:
Initially, the Annual Subscription of the members will be (Insert Amount) for subject to
revision from time to time with the approval of the Executive Committee. The Annual
Subscription will start on Insert date every year.
OR
FEES and SUBSCRIPTIONS

(a) Each member including tenants, floor wise, shall have to pay a Annual subscription and
admission fee as per the rates decided by the General Body and the RWA Management Committee
from time to time. Each House Owner ir-respective of him residing anywhere shall pay the Annual
Subscription.

b) The rates of Admission fees and monthly subscription shall be reviewed by the Executive
Committee on the Necessity but, certainly once every year and in case of upward revision, it shall be
ratified by the General Body.

(c) Any Notifications received from Delhi Authority in regard to RWAs, after the date of adoption of
these By-Laws by the General Body, will come into effect immediately without any need of adopting
the same in a RWA Meeting.

(c) Fees and subscriptions once paid shall not be refunded, except in case of a tenant vacating the
House/ Floor within the same financial year, refunded on pro-rata basis.

Register of members:
A membership register will be maintained and kept in the registered office. It will contain the
full details of the members and persons authorized to represent that organization. The same
may be made available at Website (if any) with periodical updates.
Powers of executive committee in respect of membership:
The executive committee may alter the membership fee by at least 3/4th majority in a
meeting specially convened for this purpose. It may also frame rules or prescribe procedure
for admission and/or omission of members. The committee may prescribe for payment of
annual subscription from the members by passing a unanimous resolution.
Financial Year of the Society:
(v) his employer refuses to grant him permission to serve on the Governing Body, (vi) goes abroad for a
continuous period exceeding one year, (vii) is removed by the President of the Society.
The financial year of the Association will close on 31st March every year as per existing
Government of India norms and will be followed as per Government of India norms as may
be prescribed.
Office Bearers:
The Office Bearers of Abb. Name will be as mentioned below:
i) Chairman.
ii) President.
iii) Vice President.
iv) General Secretary.
v) Secretary/s.
vi) Treasurer
vii) Joint Secretary/s.

Executive Committee:
The Executive Committee would consist of all the above Office Bearers and Executive
members from different regions, preferably an office bearer of the district association as and
when elected or as may be decided by the Office Bearers.
All the above will be elected on all National Capital Territory of Delhi Basis in accordance
with the election rules and bye-laws framed by the society.
Additional Executive members may be appointed by the Executive Committee as and when
felt necessary.
Working period of Executive Committee:
The period for executive committee and office bearers will be of two years only. The
executive committee must hold the elections within this period. In default, …..
Powers and Functions of Executive committee:
The Executive committee shall exercise following powers and perform the functions given
below:
1. To manage, supervise and control the general and day to day affairs of the society.
2. To do everything in order to achieve the objects of the Association.
3. To protect, preserve and maintain the records, accounts and properties of the society.
4. To do the duties assigned to it in these Rules or by the resolution of General Body
meeting.
5. To do all such acts and exercise all such powers which may be necessary for compliance of
any statutory requirement or for the progress of the Association.
6. To appoint and dismiss working staff of the Association and to fix their remuneration.
7. To take all necessary steps, consistent with the objects and in the best interest of the
Association and to realize the arrears of subscription.
8. To write off any irrecoverable arrears of membership subscription.
9. To delegate, subject to such conditions as they think fit, any of their powers to the
subcommittee and to frame, alter and repeal any bye laws or rules for regulating the
proceedings of such sub committees.
10. To affiliate and / or to enter into arrangement upon such terms and subject to such
conditions as the committee may decide upon with any other Association or Organization
having their objects similar to those as set out in the memorandum of Association.
Meetings of Executive Committee:
The Secretary will be entitled to call meeting of Executive Committee according to the
requirements of the Association or on the direction of President or on requisition by 1 /3rd of
the Members of Executive Committee. At least one meeting must be convened within a
period of three months.
Extra Ordinary General Meeting:
The Secretary, on his own or on the direction of the Chairman/President or on the requisition
of 1 / 10th of the total members, shall call upon Extra Ordinary General Meeting after giving
a ten days’ notice to the members. The quorum for not being less than 30 members.

Vacancies in the Executive Committee:


Any vacancy occurring in the Executive committee will be filled in by the Executive
Committee itself. In case of Post of President, Secretary or Treasurer, the Executive
Committee will make temporary working arrangement for a period of 3 months only and in
the meanwhile new elections will be arranged as provided in these rules under the head
election. The vacancy may arise by resignation, death or termination of membership.
Proceedings of the Society
1.A annual general meeting of the society shall be held at such time, date and place, as may
be determined by the President.
2.At such annual general meeting the governing body shall submit the annual report and the
audited accounts of the society, together with the auditor's report thereon.
3. The President may convene a special general meeting of the society, whenever he thinks
fit.
4. At all special general meetings no subject other than those stated in the notice as the case
may be shall be discussed except when specially authorised by the President.
5. In case of vacancy of the seat of President, the general meeting of the society shall be
called by notice under the signatures of the Secretary and any other officer authorised in this
behalf by the Chairman of the governing body.
6.Every notice calling the meeting of the society shall state the date, time and place at which
such meeting will be held and shall be served upon every member of the society not less than
fifteen c days before the appointed day for the meeting.
7. Any inadvertent omission to give notice to or non-receipt by any member shall not
invalidate the proceedings at the meeting.
8.The President of the CATS shall preside at all meetings of the society. If he is not present at
any meeting, the Vice-President of the society shall preside at that meeting. In case the Vice-
President of the society is also not present, then a member shall elect from amongst those
present to be the Presiding Officer. (alter it accordingly)
9. No business shall be discussed at a meeting of the society whilst the chair is vacant except
the election of a Presiding Officer. (change it accordingly).
10. Seven members of the society present in person shall form a quorum at every meeting of
the society.
11. All disputed questions at meetings of the society shall be determined by a majority of
votes of the members present and voting.
12. Each member of the society shall have one vote. In case of equality of votes, the President
shall have a casting vote.

Functions and Powers of various Office Bearers:

Chairman: The Chairman will generally preside over the meetings whenever the Chairman is
available. The Chairman may also represent the Association before any forum as may be felt
necessary in his opinion.

President: In the absence of Chairman, the President will preside over the meetings of
Executive Committee as well as of general body. The President can advise the Secretary to
call the meetings as and when required. The President will be entitled to supervise the affairs
of the Association and may issue necessary direction to other office bearers for successful
implementation of the resolutions passed in the meeting. The President may sanction
expenses up to the limit of Rs. 25,000/- (change accordingly) (other than the expenses for
conducting meeting) as and when requested by the Secretary.
Vice-President: In the absence of Chairman and President, Vice President will be entitled to
preside over meetings and exercise the powers of President. Vice President will have the
powers of President, which may be specifically delegated to Vice President.

General Secretary: General Secretary will be the main functionary of the Association, having
all the powers to act, sign and represent the Association before any forum. All the decisions
taken by Executive committee or General Body will be implemented by General Secretary in
a best possible way. The Secretary will look after day to day affairs. The General Secretary
will be the appointing, controlling and administrative authority. It will be General Secretary’s
prime duty to see that all efforts are made to achieve the objects of the Association. General
Secretary may spend up to a limit of Rs. 25,000/- (change accordingly) without sanction of
the Executive committee. General Secretary shall have full control over the funds, property
and employees of the Association. General Secretary will convene the meetings and keep
proper record of the minutes. It will be General Secretary’s duty to comply with the statutory
requirement and to see that nothing is done against the interest and object of the Association
and beyond the Rules framed hereunder. General Secretary will be at liberty to take outside
professional help as may be necessary.
Treasurer: The Treasurer will be responsible for proper upkeep of funds and accounts.
Treasurer will ensure that cash in excess of Rs. 25,000/- (change accordingly) is deposited in
a bank account opened with any suitable Branch of a Nationalized Bank to be decided by the
Executive Committee. The account will be operated by the Joint Signatures of the Treasurer
along with the signature of either President or Secretary. In case Treasurer is absent or unable
to sign due to some physical difficulty, the Executive Committee may authorize the President
and Secretary to operate the Bank account under their joint signatures as a temporary measure
subject to a maximum period of 3 months. (change accordingly).The Treasurer will ensure
that no expenses are made beyond the budget or powers of the Office Bearer Concerned.

Audit: The accounts of the Association will be got audited every year preferably within a
period of 3 months from the end of the Financial Year by a Chartered Accountant.

Executive Members: Members of the Executive committee will have the right to attend and
vote in the meetings of the executive Committee. They will be entitled to inspect the
accounts, Registers and other records maintained by the Association, after giving 7 days’
notice to the Secretary. No Office Bearer or Executive Member shall be entitled to avail any
travel allowance for attending the regular meetings except in special cases where outside
State traveling is involved subject to approval by the President and/or Secretary.

Chief Executive Officer: A Chief Executive Officer of the Association may be appointed by
the Executive Committee who will be paid appropriate emolument and will discharges such
duties as may be assigned to him by Executive Committee.
SOURCE OF INCOME:
(i) Admission fee,
(ii) subscription
(iii) Donation and special contribution.
The income of the society received from all sources will be utilised only for the promotion of
the aims and objects.

Elections:
The elections of the Office Bearers of Association shall generally take place in the month of
September (change accordingly) in every alternate year before the expiry of two years and the
new office bearers will take charge from the previous office bearers after expiry of their 2
years tenure. For this purpose, an Election Committee shall be constituted by the executive
Committee, which shall consist of minimum 3 and maximum 7 members. The elections shall
be by Voice Vote or secret ballot process of election or as will be decided by the Election
Committee. Form of nomination, procedure, and other Rules may be framed by the Executive
Committee or on its authorization, by the Election committee. The Election committee may
permit postal ballot too with the unanimous resolution of the election committee. The process
and procedure for postal ballot will also be decided by the Election committee. The decisions
of the Election Committee will be final. There will be no interference in the functioning of
the election committee by anyone. It will not be subordinate to executive committee or office
bearers of the Association. Every Office bearer and member will cooperate with and comply
the directions of the Election committee. Expenses of election will be sanctioned by the
Chairman of the Election committee who will be nominated by the Executive committee.
Election and other Disputes:
In case of any dispute regarding election, a petition may be moved at least by the signatures
of 30% of the members of the Association to a body of Ex-Presidents, Chairman and
Secretaries which will be known as “Dispute Redressal Committee” and the Committee will
hear the matter after giving opportunity to the parties concerned. The decision of Committee
will be final and binding on the members. This Body will act as arbitral tribunal. This
committee will also be entitled to hear and decide every kind of disputes, between the
members, its Office Bearers and functioning of the Association.

Applicability of Societies Registration Act:


In case of any matter not provided in these Rules, the Societies Registration Act and Model
Rules and bye laws framed there under will be applicable and followed.

Dissolution:
The Association may be dissolved any time by a Resolution passed by not less than 3/4th
majority of the total strength of members and such resolution has to be passed in an extra
Ordinary General Meeting convened for the said purpose. On dissolution of the Association,
the assets may be donated to any other society or association as the members may decide, but
in no case any member or Office Bearer will be entitled to retain the assets.

Alteration of Rules :
1. The Rules of the Society may be altered at any time on the recommendation of the
Governing Body by a resolution passed by a majority of the members of Society present at
any meeting of the Society.
2. These Rules shall cone into force when approved at a meeting by the Society which shall
have been duly convened for the purpose.
3. All provisions contained in the Societies Registration Act : XXI of 1860 (Punjab
Amendment Act) 1957 as applicable to the Union Territory of Delhi shall apply to this
Society including Section 4, 6, 12, 12A and 13 and 14.
