I, R.Prabhakaran.,B.C.A.LL.B.,(Advocate) having office at
No.46, Pethichettypuram, South Street, Tirupur, do hereby
solemnly affirm and sincerely state on oath as follows,
1. I am the deponent herein and the Junior Advocate
attached to the office of the counsel on record for the
Petitioners / plaintiffs in the above said Suit.
2. The above said case is posted today for IA- Counter.
3. I humbly submit that as per the instructions received from
the defendant, in the above said case and who have direct
knowledge about the entire facts of this case, has
suffering from severe fever and cold and other old aged
ailments, Due to the said bonafide reasons, the defendant
couldn’t able to appear before this Hon’ble court on today.

Hence the defendant is in need of 10 days time for the
purpose of IA- Counter in the above said case.
4. I submit that, this Petition is neither wanton nor negligent
but only due to the above stated bona fide reasons and
unless and until this Petition is allowed, the petitioner will
be put to great irreparable loss and hardship.
5. Hence, in the interest of justice, it is therefore prayed
before this Hon’ble Court that this Hon’ble Court may be
pleased to adjourn the above said suit for a period of 10
days for the purpose of IA- Counter and thus render
justice.
