Carrying of OFC line on Highway bridge shall be

remains availabale for inspection and repairs etc.

f The excavation shall be protected by flagman,signs and Agreed


barricades and red tight during night hours.
g If required a diversion shall be constructed at the Agreed
expenses of agency owning the utility line
2.3.2 Laying of OFC line through CD works and method of
laying
On approches,the OFC line mains shall be carried along
a line as close to the edege of the right of way as
a possible up to a distance of 30 mtr from the bridge and Agreed
subject to all other stipulations contained in the
Ministry's guidelines issued with letter
NO.NH-HI/P66/78 dated 19.11.1976
3 Draft license Agreement signed by two witness (Model Agreed
Format enclosed as per Annexure-II)

performance Bank Guarantee in favour of NHAI has to


be obtained @ Rs. 100/-per running meter(parallel to
4 NH) and Rs.1,00,000/- per crossing of NH for a perod of Agreed
one year initially (extendable if required till satisfactory
completion of work) as a security for ensuring / making
good the excavated trench for laying the water supply
pipe line by proper by proper filling and compaction,
cleaning debris / loose earth produced due to execution
of trenching at least 50m away from the edege of the
right of way. No payment shall be payble by the NHAI to
the licensee for clearing debris/loose earth.

Affidavit/Undertaking from the applicant to be


5 submitted in the non judicial stamp paper in the Enclosed
following format.

5.1 Not to damage to other utilities,if damaged than to pay Enclosed


the losses either to NHAI or to the concerned agency.

damages/recover the claims by way of invoking of Bank

5.7 Traffic movement during laying of OFC line to be Enclosed
managed by the applicant.
5.8 If any claim is raised by the concessionaire then the Enclosed
same has to be paid by the applicant.

Prior approval of the NHAI shall be obtained before


5.9 undertaking any work of installaton , shifting or repairs Enclosed
or alteration to the NH ROW.

Expenditure, if any incurred by NHAI for repairing and


5.10 damage caused to the National Highway by the laying, Enclosed
maintenance or shifting of the OFC line will be borne by
the agency owning the line.

Laying of OFC line will not have any deleterious effectes


5.11 on any of the bridge components and roadway safety Enclosed

Permission of laying OFC cable line will not be treated as


5.12 a right of ownership of the portion of the land on which Enclosed

Ministry of Road Transport and Highways irrespective of
