                                   EMPLOYMENT CONTRACT
This employment contract made this 2nd day of February, 2005 as per the provisions of the
Employment Act, 2007, Laws of Kenya and the provison that appertain to employment relation with
the Constitution of Kenya.
                                                  Between
Kenya Red Cross Eldoret of P.O Box 1207-30100 Eldoret, Kenya herein after referred to as the "the
employer" which expression shall where the context so admits include its executors, personal
representatives and assigns, on the other hand.
                                                   And
Jane Chepchirchir, ID. No. 8349574 of P.O Box 1097-30100 Eldoret, Kenya hereinafter referred
to as the "the employee" which expression shall where the context so admits include his/her
representatives and assigns, on the one hand
WHEREAS the Employer desires to obtain the benefit of the services of the Employee as a Human
Resource and the Employee desires to render such services on the terms and conditions set forth.
1. COMMENCEMENT DATE
The employment of the Employee is for a period of Five (5) years and shall commence on the 2nd day
of... February..... 2005.
2. RENEWAL
 a. The renewal of this Employment Contract will be determined by the performance of the Employee
 b. The Employee who wishes to renew his/her Employment Contract will request for such renewal
three (3) months before expiry of the contract that is in force. The Employer, shall consider the
application for renewal and communicate to the Employee before the expiry date.
3. SALARY
The Employee will be paid on a monthly basis at an amount of Kshs. 153,799.26/- per month. The Employer
upon execution of the contract shall decide mode of payment.
4. STATUTORY DEDUCTIONS
The Statutory deductions shall include the following:
    a) PAYE
    b) NHIF
    c) NSSF
     d) Housing Levy
5. DUTIES OF EMPLOYEE
Duties and the responsibilities of the employee will include:
    Recruitment and Hiring: I was responsible for attracting, screening, and selecting qualified candidates to
    fill job openings. This includes creating job descriptions, conducting interviews, and managing the
    onboarding process.
    Training and Development: Designing and implementing training programs to enhance employees' skills
    and knowledge, ensuring continuous professional development.
    Performance Management: Overseeing performance appraisal systems to evaluate employee
    performance, provide feedback, and identify areas for improvement.
    Employee Relations: Handling employee grievances, mediate conflicts, and foster a positive work
    environment to maintain high morale and productivity.
6. EMPLOYMENT
The Employee agrees that he/she will at all times faithfully, industriously, and to the best of his/her skill,
ability, experience, and talents perform all the duties required of his/her position in compliance with all
Employer policies, procedures, rules and any Employer announced regulations, both written and oral, as
from time to time.
These duties and responsibilities may be amended from time to time at the sole discretion of the ~
Employer, subject to a formal notification of the same being provided to the Employee without causing
termination of this agreement.
7. HOURS OF WORK
The hours of work shall be ...... 8:30 am...... to... 4:30 pm as shall be set out by the employer from time
to time but in any event shall at all times be in compliance with the provisions of the Labour Act and
the Employment Act.
The Hours of work shall only be the hours worked at the Place of work and incase of absence from
work without justifiable reason, the employer may deduct the missed hours from the salary.
8. LEAVE
      a) Sick leave: The employee shall be entitled to a sick leave of not less than 7 days     after two
consecutive months of work with full pay. In case of Incapacity to work due to sickness, the Employee
shall be entitled to a sick pay of half the salary with deductions to half the weekly amount.
    b) Paternity leave: The employer shall effect and necessitate possible grounds for maternity leave
in accordance with the employment Act 2007. A male Employee shall be entitled to two (2) weeks
paternity leave with full pay.
    c) Leave of Absence: The employer shall have the discretion for approval and duration of unpaid
personal leave which shall be at the discretion of the management of the employer.
    d) Annual Leave: On completion of every Twelve (12) months of service, the Employee shall be
entitled to a paid leave of One Month in accordance with the provisions of the employment Act, 2007.
NB: The employee should apply for the above leave and proceed upon approval of the leave.
9. PROCEDURE FOR LODGING GRIEVANCE
The Employer is most anxious that legitimate grievances raised by the Employee are expeditiously and
fairly resolved and if the Employee has a grievance relating to his/her employment should discuss it
with the Employer.
10. SUMMARY DISMISSAL
a) The Employer purposes that it will not become necessary to dismiss the Employee, however, it must
be understood that there are certain breaches of Rules for which, after the facts have been ascertained,
the Employee may be summarily dismissed or suspended, without pay, pending further investigations.
In such an event, an Employee will be afforded a full right of representation of his case to the
Management of Kenya Red Cross before a final decision is made. Continued failure to adhere to
normal Kenya Red Cross requirements, including time keeping, absence from work for 10 continuous
working days without valid reasons, attendance, intoxication at place of work, job performance,
confidentiality in relation to all the Kenya Red Cross affairs and general conduct will result in the
Employee being subject the following procedure:
      a) The Employee will receive an oral warning.
      b) The Employee will receive a first formal written warning advising that continued failure to
             improve on the specific aspect of performance will lead to disciplinary action.
      c) The Employee will receive a final formal written warning.
      d) The Employee will be suspended for a fixed period, without pay.
            e) The Employee will be dismissed in the event of it becoming absolutely clear that no,
               or insufficient, improvement on the aspect of performance is forthcoming.
At all times the Employer will abide by procedural fairness under current employment legislation when
dealing with dismissal.
11. TERMINATION NOTICE
   a) The Employer may terminate the engagement of the Employee by giving him/her one (1) months'
notice in writing or paying him/her one (1) month's salary in lieu of such notice.
   b) The Employee may likewise terminate his/her engagement by giving the Employer one (1) months'
notice in writing or by paying the Employer one (1) month's salary in lieu of such notice.
12. LIABILITY
Should the Employee's conduct, actions or failure to act lead to any monetary loss or otherwise, the Employee
shall bear the liability and the means to rectify the loss to the extent of indemnifying the employer.
It is recorded that for the purpose of this agreement, conduct shall include sabotage, conspiracy, engagement
between the employee and third parties, gross negligence, fraud and/or unlawful conduct; and while these are
only indicative examples, they do not comprise an exhaustive list.
13. CHANGE/ALTERATION TO TERMS OF EMPLOYMENT
Change in the Regulations of Employment affecting the employee will be brought to the Employee's attention
through a letter or memorandum.
