STATE P.M.B 1005 Motto: “Immunity in unity, Dispensing and Therapy” ~ CONSTITUTION PREAMBLE SECTION 1 SUPREMACY OF THE CONSTITUTION 1. The Constitution is the supreme document of the Students? Association of ‘the pharmacy Technician and its provisions shall be: binding on the Tepresentatives and members of the Association. The Students’ Association shall not be governed nor shall any person or group of persons take control of’ ‘the Association except in accordance wv “with the provisions of this Constitution. SECTION 2 THE NAME OF THE ASSOCIATION The name of the association shall be known as “National Association of Pharmacy Technicians Student (NAPTS). SECTION 2.1 MOTTO OF THE ASSOCIATION “Jmmunityin unity, Dispensing and Therapy” SECTION 3.1 MEMBERSHIP 1. Alll registered students of the Department of pharmacy technician shall be members provided such a student has duly registered as a student with the Association and paid the prescribed membership fees/dues to the i f Association, i i ‘2/Page 2 2 Honorary membership shall be conferred on persons who are not, and have never been students of the Department, who by the interest they have shown in the affairs of the Association are deemed fit for the honor, This shall be on’ the recommendation of the Association Executive Council and approved by two third members of the Association Senate, Life membership shall be conferred on the members of the association who have been outstanding in their service to the association, > Department. This shall be on the recommendation of the Executive Council and approved by two third majority of the Senate 4. All ordinary members of the Association shall pay an annual membership fee of two thousand naira (N2,000) for 100 level and (81.000) for returning students only | or such amount that shall be determined or approved from time to time. $. The grand patron, patron and matron shalll be elected on the recommendation of the Association Executive Council and approved by a two third majority of the Senate. All registered members of this Association must have a copy of this 6. constitution in subject to any fee apply SECTION 3.2 RIGHTS AND PRIVILEGES OF MEMBERS fe i i i {. All registered members are entitled to all the rights and freedoms as set out in this Article and the extant laws of the Federal Republic of Nigeria irrespective of race, gender, age, religion, nationally, and ethnicity provided that, in enjoying such rights, the rights of other people are not infringed up on. : i A. B. ‘Members shall have the right to the Association Constitution on payment of prescribed fees. Members shall have equal privilege of using the facilities and services of the Association. Members shall haye the right/freedom to seek information from the three (2) arms of the Association. Members shall have the right to freedom of expression and opinion. Members shall have the right to report all cases of harassment, abuse and i intimidation from fellow members and the Department, to the officers of the Association. Members shall have the right to vote and be voted for at the Association’s Elections, except otherwise stated in this Constitution and subject to Electoral Guidelines. Members shall have the right to petition any officer of the Association who abuses his/her office and power. This petition shall be forwarded to the ASsociation’s Senate through the Clerk. SECTION 4 GOVERNANCE OF THE ASSOCIATION . } | The authority and powers of the Association shall be vested in, and exercised by the two (2) arms as established by this Constitution. THE EXECUTIVE COUNCIL - THE STUDENTS REPRESENTATIVE COUNCIL (SENATE) SECTION 4.1 THE EXECUTIVE COUNCIL COMPOSITION ‘The Executive Council shall consist of the President, ‘Vice President General Seeretary Assistant General Secretary Treasurer Financial Secretary Director Academic Director of Social Director of Welfare I Director of Welfare II Practical Coordinator I Practical Coordinator If Director of Sports _ Public Relation Officer I Public relation Officer II Pyovost Marshal 5|Page ‘Officers of the Executive Council shalt be elected on the basis of individual ¢andidacy by all members of the Association in a general election of the | Congress QUORUM i |. For any meeting of the Executive Council a quorum shall be formed when there are two third members of the Council present at the meeting. No motion shall be passed unless by a two third majority of members present. a SECTION 5 DUTIES OF OFFICERS THE PRESIDENT ‘The President shall: Be the’ Executive head of thé Association Be responsible for the overall coordination of the activities and efficient ty functioning of the Association. 3. Have power to form committees to enhance the proper running of the Association, subject to the ratification by two/third majority of the Senate. 4. Summon, through the Secretary, all meetings of the Executive Council i and the congress meeting over which he shall preside. “Se, In conjunction with the Senate President summon a joint meeting of the two arms of the Association when the need arises. | 6. Be signatory to the Association Account, 1 Co-ordinate all National Association of Nigeria Students ey -related activities on campus, 8. __ Present the ‘Annual Budget of the Association to the Senate for approval. VICE PRESIDENT ‘The Vice President shall: 1, Assist and advice the President in all his/her official duties and shall act in the absence or incapacitation of the President. w Carry out such other activities and functions that may be delegated to himvher from time to time by the President, 3. Automatically become the President if the post becomes vacant bef the expiration of tenure of the President. “Be the Chaitinan/Cheisperion of the Year One (1) Orientation Planning Committee. 5. Be in charge of the academic welfare of the students. GENERAL SECRETARY ~ The General Secretary shall: 1. Be the head of the Association's Secretariat 2. Convene, at the instance of’ the President, all Executive and Congress meetings of the Association, Keep the recotds of the Associdtion. Compile and present report on the activities of the Association on a per semester basis to the Senate. This shall be in consultation with the President and Executive Council. a ees 3: i | 1 Carry out such duties as may be assigned to him/her from time to time by the President/Executive Council. “ASSISTANT GENERAL SECRETARY The Assistant General Secretary shall: 1 #* Assist the General Secretary in all his/her duties and shall act in his/her absence. 2. Camy out any other duties’ as may be assigned to him/her by the President/Executive Council ‘ : 3. Bethe Steietary ofthe Year One (1) Orientation Planning Committee TREASURER ‘ 1 w The Treasurer shall: Receive all Association monies collected by the Director of Finance, Secretary or other sources. Deposit all monies so received in the Association's account within 48 hours after such receipt. Be responsible for the disbursement of the approved expenditure of the Association. Bea signatory to the Association's account Be ‘responsible for keeping an. impress as may be approved by the Executive Council from time to time. Submit all receipts, payment vouchers and the account balance of the Association to the Executive Council on monthly basis. Be the Chairman/Chainperson of the Sports Committee of the Association, 3. Present to the Executive Council Programme of sporting activities for each atademie session. | PUBLIC RELATION OFFICER I ‘The public relation officer shall: 1 Be the Chairman/Chairperson of the Publicity Committee and a member of the Association's Editorial Board. Make press releases on behalf of the Association as approved by the Executive Council/President; and shall make copies of such release available to the Dean of Student Affairs Be responsible for the production of the Student Association's Almanac, Periodicals and Stickers. PUBLIC RELATION OFFICER It Hé/slie shall act for the PROT in his/her absence PROVOST MARSHAL - The Provost shail: . 2. Be in charge of maintaining peace and order during Executive Council, joint sessions, or Congress meetings of the Association, Work closely with the Chief Security Office (C.S.0) of the Reeenents in the dliaingd of his duties, be - | 1 3. Be in-charge of any property seized or confiscated from any erring . officer, member or other relevant bodies. SECTION 6 7 | i 1 LEGISLATIVE COUNCIL (SENATE) ‘The ‘Student Representative Council herein referred to as “The Senate” shiall be ‘vested with the legislative powers of the Association. COMPOSITION - The Senate shall comprise of three(3) Student’s Representing 200level and two(2) student representing 100level from the various classes. There shall be Senate President Deputy Senate Piesident Senate Clerk -The Senate President shall be elect during General Election ‘The Senate shall after the General Elections conduct an in-house election to elect the deputy senate president and senate Clerk, QUORUM FOR SENATE MEETINGS ‘|. For any meeting of the Senate, a two third majority of the total members of the Senators shall form a quorum. 2. No motiohjshall be passed into law unless by a two third majority of the total members of the Senatots: SECTION 6.1 ~ POWERS OF THE SENATE ‘The Senate shall have powers to: 7 1. Confer honorary and life membership on any deserving person in line with the provisions of this Constitution. Elect the Patrons/Matrons of the Association Constitution Blect the Staff Adviser of the Association, whose tenure shall be two years in the first instance, with a maximum tenure of four years. Approve the budget and other decisions of the Executive Council Formlly approve the appointment of a Legal Adviser to the Association ‘Approve the appointment of any Committee of the ‘association Summon any officer(s) of the Executive Couneil to account for their stewardship. Repeal or amend Standing Orders. Declare vacant the seat of a member of Senate who is absent for three consecutive meetings, without notice to the Senate President. Perform such other duties as may be conferred on it by other sections of this Constitution, The “Senate shall hold a special seating to approye the budget of association to be presented to it bythe Exenutive « ‘amt hig *< SECTION 6.2 DUTIES OF OFFICERS OF THE SENATE _ SENATE PRESIDENT ie The Senate President shall: be i Preside over the meetings of | the Senate, w Be a member of the Executive Council! and shall be elected at the Annual General Elections. 3. DEPUTY SENATE PRESIDENT The Deputy Senate President shal: : 1. Act as Senate President in the absence of the Senate President. However, where the Senate: President and the Deputy Senate President are « absent, the Senate shall elect one of its members to act as Senate President. *CLERK . ” The Clerk shall: . ' Perform all the secretarial duties of the Senate. : 3, Receive all proposed motions of the Senate 2 Forward any motion received to the Senate President within 48 hours. 4. Make public resolutions of the Senate within 48 hours from the day such resolution were passed. SECTION 7 POWERS OF CONGRESS wiPage The Congress shall be the highest decision making organ of the Association, The Congress shall be convened at least once every semester. Quorum ‘fer Congress - Quorum for Congress shall be deemed to have been constituted when at least hundred (100) students from the department present. - The Congress shall ratify the budget and all key decisions of the Executive and Senate of the Association. The Congress MUST approve all key decisions that affect the generality of the students such as Students’ A’ssociation dues and levies, approval of budget, declaration of protest against the department or government at any level, etc. ‘An approval of any key decision by Congress shall be by two-thirds majority vétes cast accredited members at a Congress duly convened. All Such-decisions and actions not approved by the Congress shall be termed unconstitutional and’ illegal: such unconstitutional and illegal action(s) shall constitute gross misconduct. The Congress shall receive a detailed statement of account of stewardship from the Executive at the end of tenure of office. SECTION 8 REMOVAL AND RESIGNATION 1 4. « The Executive Council or any member of the Council shall not be removed! from office excep| by the vote of two third majorities of the entire mbinhers of the Seakie for stated misbehavior, inefficiency and incapacity. No Executive Officer of the Association shall be removed except on the basis of gross misconduct, that -has been established by a Panel of Investigation. Such removal shall be ratified by Dean of Student Affairs. Any Officer who has been removed from office may appeal, if he/she feels the reason for the removal is contrary to the provision of the Constitution In the case of resignation or removal of the President, the Vice President shall be'sworn in as President by the Senate President within 24 hours. The Senate President shall in tum notily the members of the Association within 48 hours. ; ‘All resignation shall be submitted to the Senate President who shall notify the members of the Association within 48hours. ‘Any officer(s) who has resigned or has beon removed from office shall ciation’s property in his/her possession handover or submit all As within 48hours. In the event that there is no Executive Council, the Senate President shall - summon within 48 hours a General Meeting of the Senate to elect a Caretakér Government which shall hold office for a period not exceeding 15 | Pace ‘government, the Senate’ shall extend the time for another period not excesding three (3) mnths. Removal of tlie Senate President, Deputy Senate President and other officers of the Senate shall be by a motion, supported and approved by two third majorities of the members ofthe Senste- Stich removal shall be conimunicated to the President within 48 hours. . 10. Any removal by the Senate shall be communicated to the affected ‘Association Official through the Dean of Student Affairs. SECTION 9 : ‘TENURE OF OFFICE | 1 “Ths tenure of office of all elected Officers of the Association shall be one ‘Academic Session. 2, The Legislative (Senates) Council shall form the Association’s Electoral Committee four (4) weeks before the: expiration of the tefture, for.the purpose of conducting fresh elections. .SECTION 10 MEETINGS 1g The Executive Council shall meet at least once (i) in a month. ‘Emergency raetngs may be convened when necessary. 2. The meeting of the Senate shall be held not more than twice (2) ina month, except in the case of emergency. The resolutions of the Senate shall be made known to members of the 3. [Association within 48 hours by publications on Notice Boards and an approved Social Media platform. 7 4. Sub-committees may meet at théir discretion. 5. A general meeting ofthe Association (Congress Mecting) shall be called at least once (1) in every semester. SECTION 11 ACCOUNTABILITY OF ASSOCIATION OFFICERS 7 | 1. Alfofficers of the dssociation shall be individually or jointly responsible for any acts of commission or omission perpetrated in the performance of their duties. 2. All offices shall be financially accountable for expenses incurred on behalf of the Association. ‘All officers must produce an annual report and account of stewardship to the Congress, without prejudice. 4, The Annual Report and account of stewardship of officers shall be presented at the first Congress of the Association after the elections. SECTION 2 | AUDIT OF ACCOUNT 1. Accounts of the Association shall be audited every semester by the Finance and Audit Committee of the Senate. i‘ 2, Auditors will be entitled at the Association’s cost to a refund of all expenses incurred by it and to any fee or honorarium approved by the Senate in respect of the ‘discharge of their duties. The Audit Committee shall have power to require the Trustee to submit to them at a stated place, period and time, the accounts and records of the Association in their custody. 4. The Audit Committee shall have power to require the Executive Council » of the Association and any other officer or member of the association to submit’ to them written reports on any issue affecting the affairs of the Association, based on the auditors’ terms of reference. { | 5. Auditors appointed or invited by the Senate shall be given written terms of reference and the conditions of their appointment. ~ 6. The Audit Committee's report shall be, submitted to the Senate President and’ such audited account shall be sent to the Dean Student Affairs for information and necessary action 7. The Audit Committee's teport and statement of account shall be published on Notice Boards SECTION 13 COMMITTEES | i I 1. The Executive Council shall have powers to set up a Committee to be approved by the. senate. This shall be widely advertised and shall not duplicate the standing Committees. SECTION 14 ELECTIONBYE ELECTION OF THE ASSOCIATION, 1. The General Election of the Association shall hold in every Second Semester in a session in the week during the Students’ Association Week ‘ on a date to be fixed by the Dean of Student Affairs and Electoral Committee. ete a |) , Vacancies occurring in any of the elections shall be filled in a bye election to be conducted within 3 weeks after the general election. Subject to the provisions of this ‘section, elections for the Association shall be carried out iy the way and manner set down in the electoral regullions and guidelines. . SECTION 15 ELECTORAL REGULATIONS/GUIDELINES 1, There shall be an Electoral Committee for the Association which shall consist of representative(s) from each Class, The leadership of the Students’ Association (legislative) after consulting the Dean of Student Affairs shall appoint the Electoral Committee Members. The Dean, Student Affairs shall advice the Association on the appointment of Electoral Committee Chairman/Chairperson and Secretary from among {he Blectoral Committee members. The members of the Armed Forces in the Department and other security personnel shall be in charge of the security during the elections. The conduct of the General Election and bye elections.of the Association shall be vested in the Electoral Committee. Election shall be by secret ballot executed by the physical casting of the ballot paper Election shall be held within twelve (12) days but not earlier than three @) days after the dlose of nomination. Blection petition shall fet filled to the Electoral Committee not later than seveni(7) days after elections, 19| Page ‘The Electoral Committee. shall have. the power to make rules and reguldtions to ensure orderliness’ and good conduct in elections and during tlectioneering campaigns. Any‘ candidate who contravenes any section of any rule made under any section(s) of these regulations and guidelines in this Section shall have his candidacy nullified, The Association shall be responsible for all expenditure pertaining to the conduct of the election. Any candidate vying for the position of the Senate.President must have served as a Senator. ecuckanrard FOR ELECTION 1 Any person who wisheS to contest for any position of leadership in the Students Association must be a valid registered student for not less than six (6) month. And in the following year when he/she is expected to handover, a student who does not handover properly will face a disciplinary action by the Department. He/she who wishes to contest for any position of leadership must resign from any position held in the Department. Written’ notice of any motion to amend the. Constitution, with the suggested amendment stated in precise terms and signed by the movers and seconded, arid sent to the Senate President through the Clerk, 2. The Senate President shall ensure a copy of the proposed amendment is pasted on the Notice Boards within 48hours of its receipt. 3. A.copy of the proposed amendment of the Constitution shall be presented tothe Dean of Student Affairs. i 1 - 4. _ No amendment to this Constitution shall be valid unless it is passed by a two third majority of the entire membership of the Association's. Senate Such amendment (s) shall become operative following the approval of the Senate. 5. This constitution is liable to be amend after three (3) years except otherwise when necessary.
