How to Legally Mail First-
Class for Free Under
18 USC 1726
(Freedom Advocates,
Sovereigns & Self-Litigators
Edition)
This guide provides the exact steps, templates, and legal wording you need
to mail first-class for free, invoking your lawful rights under 18 USC 1726.
⚠️ Important Disclaimer: This guide is for informational and educational
purposes only. You must take personal responsibility for following the law
correctly and standing on your rights.
Step 1: Understanding 18
USC 1726
🔹 What does the law say?

18 U.S. Code § 1726 - Postage collected unlawfully“Whoever, being a
postmaster or other person employed in the Postal Service, shall collect or
receive any postage or fee on mailable matter transported in the mail of the
United States, when the same is by law exempt from such charges, shall be
fined under this title or imprisoned not more than six months, or both.”
Key Takeaways:
✔️ If your mail qualifies for an exemption, the USPS CANNOT legally charge
✔️ If a postal worker demands postage, they are violating federal law and
you postage.

✔️ You must properly invoke your exemption—this guide will show you
can be fined or even imprisoned.

exactly how.
Step 2: Determine If Your
Mail Qualifies for
Exemption
18 USC 1726 applies to
specific types of mail,
including:
✅ Legal Notices, Affidavits, and Court Filings
If you are exercising your constitutional right to petition the government, you
may qualify for free mailing.

Example: Sending a Notice of Default, Affidavit of Truth, or Administrative

Process Letter to government officials.

✅ Self-Litigators & Sovereign Capacity Mailing

If you are representing yourself pro se in court or acting as a Private Attorney
General, your mail may be exempt.

✅ Mail Sent in “Official Capacity”

Sovereigns, state nationals, and those operating under constitutional and
common law jurisdiction can send lawful notices without postage when
acting in an official legal or judicial capacity.
Step 3: Prepare Your Mail
for Postage Exemption
How to Format Your Envelope (EXACT Wording to Use)

Keep in mind the colors need to be exact (have a color printer for this).

You can get cheap envelopes at the dollar tree, (that is where I get mines).

For the certified and return receipt, create a USPS online account and have them mail you a
bulk for free.

Please make sure you get the correct labels depending on your printer (Ink Jet or Laser), you
will need “Avery Label No.5163 ”
Step 4: How to Hand
It to the USPS Clerk
(What to Say)
1️⃣ You can drop it off inside the mailbox, but also can hand
2️⃣ Hand the letter directly to the postal clerk
it to the post office counter.

3️⃣ Say This Exact Phrase:

“I am invoking my lawful rights under 18 USC 1726. This mail
is exempt from postage charges.”

4️⃣ If They Seem Confused, Politely Hand Them This Script:

“Federal law under 18 USC 1726 prohibits USPS employees
from charging postage on mail that qualifies for exemption.
This matter is transmitted in the discharge of official duties,
and I am lawfully invoking my exemption under this statute.
Please process this mail in accordance with federal law.”
Step 5: What to Do If
the USPS Refuses to
Accept Your Mail
📌 If the clerk rejects your mail, do the following:
✔️ Step 1: Calmly ask for their written explanation of why
they are refusing it.
✔️ Step 2: Request to speak with the Postmaster or
Supervisor.
✔️ Step 3: If they still refuse, tell them:

“Under 18 USC 1726, any postal employee who unlawfully
collects postage on exempt mail is committing a federal
offense and can be fined or imprisoned. Please put your
refusal in writing for my legal records.”
✔️ Step 4: If they refuse to put it in writing, document the interaction:
• Date
• Time
• Location (post office address)
• Names of employees involved

✔️ Step 5: File a formal complaint with:

• The Postmaster General
• The USPS Inspector General
• The Postal Regulatory Commission
📜 Legal Case to Reference:
• Haines v. Kerner, 404 U.S. 519 (1972)
◦ Meaning the USPS must not obstruct legal correspondence with
unnecessary fees.

“Pro se litigants are entitled to have their pleadings liberally construed.”
Step 6: How to Respond If
USPS Returns Your Mail &
Demands Postage
🚨 If your mail is returned with a demand for postage, follow these steps:
✅ Step 1: DO NOT add a stamp—this waives your right to challenge their
✅ Step 2: Attach a printed copy of 18 USC 1726 to the envelope.
