CONSTITUTION AND BY-LAWS


OF THE

Philippine Institute of Civil Engineers - St. Mary's College


of Tagum Inc. - Student Chapter (PICE - SMCTI - SC)

PREAMBLE

We, the Civil Engineering Students of St. Mary's College of Tagum Inc., Province of Davao del
Norte: imploring the aid of God in order to establish an organization that shall uphold and promote the
mission, vision, goal and objectives of the college department and adopt the rules and regulations of the
PICE National Chapter, do hereby ordain and promulgate this constitution.

ARTICLE 1
NAME

This organization shall be officially known as the Philippine Institute of Civil Engineers in Saint
Mary's College of Tagum Inc. - Student Chapter, otherwise referred to as PICE SMCT - SC.

ARTICLE II
DECLARATION OF PRINCIPLES AND OBJECTIVES

Sec. 1 - General Objective


The Philippine Institute of Civil Engineers in St. Mary's College of Tagum Inc. - Student
Chapter (PICE SMCTI - SC), seeks to develop knowledge, leadership and sense of responsibility
among civil engineering students through service to the group as well as to the community.
Sec. 2 - Specific Objectives
a) To foster harmonious relationship among club members and other members of the
community.
b) To develop the Ignacian Marian civil engineering students academically through peer
counseling and tutorial classes.
c) To generate funds to financially support activities of the club.
d) To provide services to the college department and the community according to the
capability of the club members
e) To affiliate the club to other civil engineering organizations and coordinate with them
through joint projects.

ARTICLE III
STRUCTURE

The organization structure of the Philippine Institute of Civil Engineers in St. Mary's College
of Tagum Inc. - Student Chapter (PICE SMCTI - SC) shall be composed of the following:

ARTICLE IV
MEMBERSHIP

Sec. 1 - Qualifications
a) He/She must be a bonafide first year to fourth year civil engineering student of St.
Mary's College of Tagum Inc. with good moral character.
b) Two classes of membership shall be recognized by the club;
1) Regular member. He/She is a member who satisfactorily fulfilled the
qualifications.
2) Honorary member. He/She is considered member of the club until 2 years after
his/her graduation.
Sec. 2 - Attendance
a) A member can only be allowed a maximum of three (3) unexcused absences per
semester in a regular club meeting.
Sec. 3 - Fees and Dues
a) First year and Second year members shall pay the twenty pesos (20.00Php.)
membership fee upon enrollment.
b) Third year members shall pay an amount in conformity to the national membership fee
for new members every beginning of the school semester. Other fees shall be nominal
only to meet the administration cost of the club.
c) Fourth year members shall pay an amount in conformity to the national membership
fee for old members every beginning of the school semester. However, transferees of
the said year levels will pay the national membership fee for new members.
d) Every member shall pay monthly dues worth of fifteen pesos per month (15.00 Php.)
or seventy-five pesos (75.00 Php.) per semester.
Sec. 4 - Renewal of Membership
a) Regular members shall renew their membership every beginning of the school
semester.
b) Terminated member shall pay new membership as a sanction.
Sec. 5 - Termination of Forfeiture of Membership
Membership shall be automatically terminated upon:
a) Failure to renew his/her membership in the club.
b) Gross violation of this constitution.
c) Gross violation of the school rules and regulations.
d) Termination of this club.
Sec. 6 - Civil Engineering students (from third up to fourth year) shall have an annual
registration fee for the National Civil Engineering Students Chapter.

ARTICLE V
RIGHTS, PRIVILEGES AND DUTIES OF MEMBERS

Sec. 1 - Right to express opinions and direct suggestions to the officers.


Sec. 2 - Right to redress grievances.
Sec.3 - Right to know the proceedings and minutes of the officer's meeting.
Sec. 4 - Right to know the details of any club activity.
Sec. 5 - Right to vote and run for any elective positions of the club.
Sec. 6 - Right to vote in an impeachment proceeding against any officer of the club.
Sec. 7 - Right to join and participate in religious activities and spiritual practices without
affecting his/her academic standing.
Sec. 8 - Privilege to peer counseling on the academic subject that he/she has difficulty.
Sec. 9 - Privilege to borrow and use the club's engineering instruments.
Sec. 10 - Privilege to participate in any club activity inside or outside the school community.
Sec. 11 - Duty to maintain the academic standards of the school and the club.
Sec. 12 - Duty to maintain a good moral standing in the community.
Sec. 13 - Duty to serve, attend and participate in regular meetings of the club and other
general activities.
Sec. 14 - Duty to understand, feel and live up with the preamble and with the constitution of
the PICE SMCT-SC.
Sec. 15 - Duty to actively support all PICE SMCTI-SC activities.
Sec. 16 - Duty to abide all rules and regulations of the club and the college.

ARTICLE VI
ELECTIONS OF OFFICERS

Sec. 1 - The PICE - SMCTI - SC shall have the following officers.


a) President
b) Internal Vice President
c) External Vice President
d) Secretary
e) Treasurer
f) Auditor
g) Public Relations Officer
h) Business Manager 1
i) Business Manager 2
Sec. 2 - All officers shall be elected by secret balloting.
Sec. 3 - Qualified members can only be elected without their presence.
Sec. 4 - Officers may also be re-elected only once to same elective position.
Sec. 5 - In case of vacancy in any elective position, a special election shall be held. If none
then the program head and the adviser will appoint for that vacant position.
Sec.6 - Engineering students from first up to fifth year shall exercise the right to vote during
the election of PICE Officials.

ARTICLE VII
OFFICERS

Sec. 1 - Qualifications of Officers


a) He/She must be a BSCE student of SMCTI.
b) He/She must have been a full pledged member for PICE SMCTI – SC.
c) For president, he/she must be a bonafide fourth year civil engineering student of
SMCTI.
d) He/She must have a WPA of atleast 85% for the President, and 80% for all other
elective positions.
e) He/She must show leadership potentials and academic excellence.
Sec. 2 - Functions of Officers

a) President:
The President shall preside over the regular and special meetings of the club and
directs all activities towards the attainment of objectives and goals. He/She shall represent
the club at any function, meeting or assembly. He/She shall create committees as the need
arises. He/She shall make a written report and accomplishments of the club every end of
the semester. He/She has the authority to disseminate tasks, if possible, for the betterment
of the organization.
b) Internal Vice President
The Internal Vice President shall assume and discharge all duties and functions of
the President.
c) External Vice President
The External Vice President shall assume the duties of the Internal Vice President
in the event he assumes the duties of the President.
d) Secretary
The Secretary shall be the official custodian of all papers and records of the club.
He/She attends to the serving of notice of meetings of the club. He/She take the minutes
of every meeting. He/She shall perform such other duties and function as may be assigned
to him/her by the Board.
e) Treasurer
The Treasurer shall have the custody of all the club funds and shall maintain all
necessary records. He/She shall report on the club's financial status at each meeting of
the club and shall hold all records available for all inspection by any club member.
He/She shall receive and disburses funds for an in behalf of the organization, provided that
no disbursement shall be made without the approval of the president and provided further,
that the funds are disbursed for official purposes only. He/She shall make a written financial
report before the end of semester.
f) Auditor
The auditor checks the account or conduct an audit of the organization. In case of
treasurer's absence, he/she shall hold the records available and report it to the body for
inspection. The auditor shall assist the treasurer in collecting funds and fees and account
the disbursed for official purposes only.
g) Public Relations Officer
He/She shall promote good relationships between the club and the general public.
He/She shall disseminate information on plans, programs, policies and important activities
of the club through the various media outlets and keep records of the disseminated
information.
h) Business Manager
He/She shall attend to all business transactions or dealings the club may engage.
He/She shall prepare the financial groundwork's relative to social activities programs and
seminars. He/She shall perform such other related duties and functions as the board may
assign to him.

ARTICLE VIII
TENURE OF THE OFFFICE

The elected officers shall serve a term of one school year, but if he/she was found deficient
on his/her position, he/she shall be put on probation.
ARTICLE IX
IMPEACHMENT

Sec. 1 - Any PICE SMCTI - SC officer /member shall be impeached on the following
grounds:
a) Negligence of duties.
b) Violation of school rules and regulations as defined in the student handbook.
c) Gross violation of this constitution and by-laws.
Sec. 2 - Any club regular member may initiate the impeachment proceedings against any
club officers. An officer may be impeached by 2/3 vote of all regular members.

ARTICLE X
RESIGNATION

Sec. 1 - Any member of the PICE SMCTI - SC who desires to resign must file a formal
letter of resignation which must contain at least one valid reason for his/her
resignation addressed to the president and to the moderator one week before the
said resignation.
Sec. 2 - The resignation shall be approved by the PICE SMCTI – SC Moderator.
Sec. 3 - All functions, papers and documents of the resigning officer shall be turned over
to the PICE SMCTI - SC temporarily until such time that the position has been
filled.
Sec. 4 - If the President wants to resign, he/she shall submit his/her resignation paper to
the PICE SMCTI - SC Moderator subject for approval of 2/3 votes of the students
present during the general assembly.

ARTICLE XI
MEETINGS

Sec. 1 - General regular meeting of the club shall be every last Friday of the month unless
being called by the office of the Dean of Student Affairs. Special meetings may be
called anytime by the president.
Sec. 2 - There shall be a regular meeting of the club officers before a general regular
meeting.
Sec. 3 - Fifty percent plus one of the total membership numbers shall constitute a quorum
for meeting and 2/3 of the regular members for major decisions.
Sec. 4 - On every meeting for major decisions, at least one BSCE instructor shall be
present together with the club moderator.

ARTICLE XII
MODERATOR / ADVISER

Sec. 1 - The PICE SMCTI - Student Chapter shall have one moderator which shall
be chosen by the club members or appointed by the program head. They must be
a licensed civil engineer and a faculty member in SMCTI and a regular PICE
member.
Sec. 2 - The moderator shall serve as the liaison between the club and the school
administration. He/she shall attend all meetings if deemed necessary. The club
preserves the rights of the Moderator to render advise/advises to the club officers
on case of difficulty matters that cannot be settled by the officers but official
decisions shall be presented and shall be approved by the members of the club.

ARTICLE XIII
BEI (BOARD OF ELECTION INSPECTORS)

Sec. 1 - The board of election inspectors shall be composed of the following persons;
a) Election officer to be appointed by the moderator prior to the election.
b) Three engineering representatives, one every year levels; appointed by the moderator
(from third up fourth year).
c) One engineering instructor shall be the adviser of BEI.

ARTICLE XIV
REPUBLIC ACT NO. 11053, ANTI-HAZING ACT OF 2018

Sec. 1 - All forms of hazing shall be prohibited and no initiation rites is required in PICE SMCTI –
SC Club. (Sec. 5 of Anti-Hazing Act of 2018).
Sec. 2 - PICE SMCTI – SC Club Moderator shall also be assuming the duties of Faculty Adviser
(Sec. 8 of Anti-Hazing Act of 2018).
Sec. 3 - The faculty adviser shall be responsible for monitoring the activities of PICE SMCTI – SC
(Sec. 8 of Anti-Hazing Act of 2018).
Sec. 4 - In case of violations of Anti-Hazing Act of 2018, the faculty adviser is presumed to have
knowledge of and consented to the commission of such violation and shall be held, after
due notice and summary hearing, accountable therefore (Sec. 8 of Anti-Hazing Act of
2018).

ARTICLE XV
REPUBLIC ACT NO. 11313, SAFE SPACES ACT

Sec. 1 - Students who are found to have committed acts of gender-based sexual harassment will
be automatically terminated as a member of PICE SMCTI – SC.

ARTICLE XVI
REPUBLIC ACT NO. 9165, COMPREHENSIVE DANGEROUS DRUGS ACT OF 2002

Sec. 1 - PICE SMCTI – SC members will be obliged to participate in drug tests whenever the school
conducts random drug tests among students.
Sec. 2 - PICE SMCTI – SC will require for fourth year students to undergo drug tests before their
On the Job Training (OJT) Practicum.
Sec. 3 - Students who are found out possessing, using, and other acts violating the Comprehensive
Dangerous Drugs Act of 2002 will be automatically terminated as a member of PICE
SMCTI – SC.

ARTICLE XIV
AMENDMENTS

Sec. 1 - This constitution may be deemed by 2/3 vote of the members in meeting specially
called such purpose.
Sec. 2 - The amendments shall take effect immediately upon ratification by the majority.

ARTICLE XV
EFFECTIVITY

This constitution shall take effect immediately upon the approval of the majority of the
members of PICE - SMCTI - SC and the administration.

PICE Logo and Interpretation

At the center are two oval roads locked together tells the historic creation of PICE, where the
Philippine Society of Civil Engineers (PSCE) which were group of civil engineers working for government
sectors and Philippine Association of Civil Engineers (PACE) for private sector engineers, joined together
as one. In addition, 1937 was the year that Philippine Association of Civil Engineers was created. The
Philippine Institute of Civil Engineers that was patterned as, and enclosed in a diamond symbolizes how
the profession of Civil Engineers is precious and valuable to our society. Lastly, the logo is pigmented by
two colors: Blue that is usually the color of a neat suit that symbolizes professionalism which was the first
PICE Core Value; and Orange, that we usually see in traffic cones and reflectorized suits which epitomizes
the importance of safety in a Civil Engineers work.
