3. Further, it is submitted that M/s RS Infra vide their office letter dated
09.04.2025 (Page-10) and M/s Silica Infra Pvt. Ltd. vide their office
letter dated 09.04.2025 (Page-11 ) has requested for extension of due
date of bid submission.
4. BoDs approved the agenda/memorandum for opening/extension of

before issuing 2 no. corrigendum then the detailed case be
submitted by the concerned Chief Engineer for consideration and
decision of the whole time Director.
III. A Case for issuing more than 2 no. corrigendum for extending bid
or opening of the tenders will be put up by the concerned Chief
Engineer for consideration and decision of the Whole Time
Directors.

A. In case of 3 or more no. bids:


As per prevailing practise, there are certain cases in which the
due date of online bid submission was extended by concern
Chief Engineer tender after receiving of 3 or more bids by
considering the request of the other firms/bidders for increasing
participation and competition :-

i. Recently in EPC-D-121, the due date of online bid submission was


extended by 7 Days after receiving of 3 Nos. Bids by considering the
request of the other firms/bidders after approval from CE/PD&C
HVPNL, Panchkula (Page-13 to 15 ).
ii. Recently in EPC-D-123, the due date of online bid submission was
extended 7 Days after receiving of 4 Nos. Bids by considering the
request of the other firms/bidders after approval from CE/PD&C
HVPNL, Panchkula (Page-12 ).
iii. In QDP-1440, the due date of online bid submission was extended by 7
Days after receiving of 4 Nos. Bids by considering the request of the
other firms/bidders after approval from CE/P&M HVPNL, Panchkula
(Page-16) .
iv. In QDP-1465, the due date of online bid submission was extended by
15 Days after receiving of 4 Nos. Bids by considering the request of the
other firms/bidders after approval from CE/P&M HVPNL, Panchkula .

B. In case of 2 no. bids


If 2 no. bids received then WTDs of HVPNL in circulation was
requested to take further action like in EPC-D-122 in which
WTDs, HVPNL was requested to consider and approve the
opening of said tender enquiry with 2 no. bids. (Page-17 to 18 ).

From the above, it is clearly evident that in case of 3 or more no.


bids received in the tender enquiry, the decision is to be taken by
concern Chief Engineer. Moreover, in case of 2 no. bids the
decision is to be taken by WTDs, HVPNL.
In view of the circumstances mentioned above, the due date of
online bid submission may be extended by 5 days from date of
issue of corrigendum to increase the participation of bidder
against subject cited tender enquiry.

Further corrigendum 1 issued to increase the participation of
bidder with due date of bid submission till 21.04.2025.
Accordingly, the bids (PQQ template + Technical template)
were opened through e-tender on 28.04.2025 after obtaining
approval from competent authority and the following three no.
bidders have submitted their bids:-

3. The Technical bids of aforesaid 3 No. bidders were scrutinized


and pre-audited and observation were conveyed to all the
bidders. The reply to the observations were received from
respective bidders. Based on the available documents and
reply/clarification received from the bidders, SPC in its
meeting held on 16.05.2025, after due deliberations decided to
open the price bids of all the responsive bidders. Further, the
Technical Evaluation of all the bidders on HEW portal was done
on 22.05.2025.
Accordingly, price bid for bidders for EPC-D-126/PD&C were
opened online on 30.05.2025.

4. Merit-cum-Comparative Statement:

A. The Merit-cum-comparative statement (Page-20) of the prices


quoted by 3 no. qualified bidders for above work against
subject cited e-tender inquiry was prepared as per schedule -1
and got pre-audited. The prices quoted by the bidders for said
lines for supply, F&I, erection and civil works including GST @
of 18% and all taxes /duties /levies/ cess etc. is tabulated as

From the above, it is evident that M/s K Ramachandra Rao
Transmission & Projects Pvt. Ltd, Hyderabad is lowest L1 bidder.
The rates quoted by L2 & L3 bidders are within 5% of rates of L1
bidder.
Finance department Govt. of Haryana vide Endst. No.
14/29/2023-6FA dated 26.05.2023 has circulated notification of
amendments in negotiation policy in respect of procurement of
Goods/Stores (Fixed Purchase & Rate Contracts), Turnkey and
Services. Relevant portion is as under:-
“The price discovery for cases related to procurement of goods
& stores (both fixed purchase and rate contract), Turnkey and
services may be generally determined based on the rates quoted
by L1 bidder if quoted rates are found to be reasonable by the
intending department/ organization, and negotiation, if any, held
with the lowest bidder.

A. However, negotiation could be held up to four number
of such bidder(s), in addition to L1 bidder in cases
where there are bidders falling within 5% of the L1
bidder. In cases where the L1 bidder refuses to
further reduce his offered price and any of the four
bidders come forward to offer a price which is better
than the price offered by L1 bidder, the bidder whose
price is accepted becomes the L1 bidder.
However, in such a situation, the original L1 bidder
may be given one more opportunity to improve upon
the discovered price. In case, the original L1 bidder
further improve upon the price discovered during the
negotiations, he would be treated as L1 bidder.
B. In cases where there is no bidder within 5% of the L1
bidder:-
B. L2 bidder will be invariably called for negotiation in addition to
the L1 bidder.
C. L3 bidder will also be called, if it is so decided by the Minister-
in-Charge, in addition to L1, L2 bidders.”

5. Competency
The total purchase proposal on the basis of lowest rate quoted
b y M/s K Ramachandra Rao Transmission & Projects Pvt. Ltd,
Hyderabad is to the tune of Rs. 5310.23 Lacs, which falls
within the competency of High Powered Works Purchase
Committee.

6. Reasonability of Rates:-
i. This being a turn-key project having specific scope of the
work involving design, supply of various type of
equipment, erection, testing and commissioning, can’t be
compared with any other project having different scope of
work.
ii. The original estimate as prepared at the time of floating of
bid was amounting to Rs. 4276.40 Lakh. The updated
estimate is of Rs. 4328.07 Lakh by applying IEEMA
circulars & CACMAI circular of March, 2025 for tower
material & conductor respectively and same got pre-
audited (Page-19).
iii. The rate received from M/s K Ramachandra Rao
Transmission & Projects Pvt. Ltd, Hyderabad against
instant tender enquiry EPC-D-126/PD&C, has been
compared with the updated estimate as under:-

side as compared to the estimated cost. There is a scope of
negotiation with bidders, which as per policy guidelines
/instructions can be held.

7. Validity : The offers are valid upto 29.08.2025.


8. Keeping in view of above, SPC in its meeting held on
05.06.2025 (Page-21 to 23) after due deliberations decided to
recommend to the Whole Time Directors, HVPNL to consider
and approve as under:-
“To place the purchase proposal for Creation of 220 kV & 132
kV transmission lines related to 220 kV GIS S/Stn. IMT Phase-
III, Rohtak on Turnkey basis against tender enquiry no. EPC-D-
126/PD&C before the High Powered Works purchase Committee
for consideration, negotiation and decision.”

9. As per office order no. 52/EG-98 dated 10.03.2025, file may be


sent to office of Sr.AO/EA&R routed through Director/Finance,
HVPNL, Panchkula for financial scrutiny of above proposal
before submission of memorandum to WTDs, HVPNL for
consideration and approval please.
