The narrative lists Nicholas Ricciardi as the teacher that inappropriately fouched The Victim. The inappropriate touching is described in the narrative as "tickling" The Victim around the belly button area. The Victim has since told her mother about the touching and also described behaviors of Ricciardi towards her as, sharing food privately with her and touching and rubbing. When The Victim's mother attempted to gain more information from her, The Victim has been reported to "Shut down,” and does not want to talk about it. Since The Victim's mother’s learning about the touching, she has noticed a change in behavior from The Victim. These behavioral changes have been described as being afraid to sleep alone in her room, constantly needing to have the room lighted and not dark. Atone point, when The Victim's mother was helping her shower, The Victim disclosed to her mother that, "Mr. Ricciardl i¢ a bad man and that he has hurt her.” The Victim again did not elaborate when her mother asked her for more information. The Victim's mother has reportedly contacted the school about that information and she was told by the Head of the private school, Jonathan Berger, that they would be conducting their own investigation and would be contacting their legal team. The Victim's mother also reported to DCF that she had spoke with a few female teachers from the school, who in fear of retaliation of losing their jobs, preferred to be anonymous for this report. It should be noted that although they will be redacted for this report and following supplements, their names are known to me. They will be known in succession as, "Teacher #1, Teacher #2, elc.” The Victim's mother spoke with Teacher #1 and Teacher #1 verbally stated to The Victim's mother that she has seen Ricciardi tickle The Victim below her belly button area. The Viclim's mother also spoke with Teacher #2, who reportec to her that when Teacher #2 had given Ricciardi a hug to congratulate him cn is Ricciardi had placed his hand on her buttocks area, which was unwanted. Teacher #2 also did not want to report this incident for being in fear of losing her job. With all of that information, The Victim's mother removed all of her children from the school. On 12/17/24, | was able to speak with The Victim's mother on the phone, about this incident at length. Much of the information found within the 737 form was explained to me verbally, The Victim's mother reported that The Victim's sister, who also attends the school, has seen Ricciardi inappropriately touching The Victim. At this point, | explained the options that The Victim's mother had in terms of proceeding with a criminal investigation. | informed her that | would like to have a forensic interview (Fl) set up for both The Victim and The Victim's citer. The Victim'e mother stated che would be willing to have that done and I explained to her that it would be done by a non-biased, indepe ident institution called Klingberg Child Advocacy Center (KCAC). The Victim's mother stated she understood. | was also informed that The Victim's mother has had e-mail conversations with Jonathan and Ricciardi, which were later forwarded to me, printed and forwarded to the Records Division for retention. Within the conversation between her and Ricciardi, on 11/24/24, she stated, “Mr. R, (The Victim's sister) mentioned to us in passing that she saw you tickling (The Victim) in the cafeteria. We spoke with (The Victim) who affirmed this. | know (The Victim) is a fun spunky girl who loves to joke around. Ve wouldn't want someone else to take advantage of (The Victim)'s trusting nature.” In Ricciardi's reply e-mail tc The Victim's mother, he simply stated, "Heard and understood... Thanks for bringing this to my attention. Appreciate it. - Nick" After speaking with The Victim's mother, I contacted the KCAC and scheduled a tentative Fl date of 12/31/24 at 1300 hours for both The Victim and The Victim's s ster. | then contacted DCF worker David Salce to inform him of that date. While speaking with David, we exchanged information for thie incident, however, both of our information was largely the same. Ashort time later, | received another e-mail from The Victim's mother. Within the e-mail was a forwarded e-mail which was from Jonathan to all the students’ parents explaining that as of 12/17/24, Ricciardi had been placed on a leave of absence until further notice. ‘On 12/48/24, | met with Jonathan at the Solomon and Schecter Day School. | introduced myself and explained my reasoning for being at the school. Jonathan stated he understood and we subsequently went to his office to discuss this incident. | explained to Jonathan that | réceived the 737 form and | explained my investigation to him. | asked Jonathan to give me his thoughts and view on this incident and he subsequently did. Throughout our conversation, it was learned that Teacher #1 had seen Ricciardi tickle The Vietim and on another occasicn, Teacher #1 observed Ricciardi touch another child's, "Waistline" during spiritweek. Jonathan also stated, "We spoke with the teacher pretty clearly and he understood that, that had to stop and we hoped that was the end of the matter." Then, during the school's spirit week, a child wore a monkey costume which had a belt affixed to it and a tail attached to the belt. Ricciardi was observed by Teacher #1 to have said words to the effect of, "That's a cool belt,” and then touch the side waistline of the child where the belt was affixed to the costume. As a cumulative result of Ricciardi’s touching of The Victim in a tickling manner, failing to listen to the prior request by administration to stop that behavior and again touching the waistline of another child, the decision was made by the school to place Ricciardi on a leave of absence. | then asked Jonathan how Ricciardi's demeanor was when he was told he was going to be placed onto a leave of absence. Jonathan stated Ricciardi appeared upset and stunned. It should be noted that Jonathan confirmed that the allegations of Ricciardi tickling The Victim were not contested by any party from the school, to include Ricciardi himself. After speaking with Jonathan, | attempted to contact Teacher #1 via telephone, but | was unable to speak with her and a voicemail was left requesting a call back. A short time later, Teacher #1 called me back and we spoke about this incident at length. Throughout my conversation with her, she explained that she witnessed Ricciardi tickling children on multiple occasions, tut that she believed the tickling to not be of a sexual nature. | asked Teacher #1 if she witnessed any other inappropriate activity by Ricciardi within the schoo! and she stated no. On 01/06/25, | attended a forensic interview for The Victim at the KCAC in Hartford. Present in the interview room was The Victim and the Interviewer, Alexandra Heftye. The interview was both audio and video recorded by the KCAC. The Victim first provided information that Ricciardi had shared a cucumber with her in the school's cafeteria on the first day of school. Then The Victim provided the same information within the 737 form in regards to her being tickled on the stomach area by Ricciardi and described the tickling as, "Hard and it hurt." The Victim also stated that she did not like the tickling. As the forensic interview progressed, The Victim became withdrawn and no longer was comfortable talking about her experiences at school. As a result, the forensic interview ended shortly thereafter. After the forensic interview was complete, | was provided with a USB drive which contained the audio/video recording of the entirety of the forensic interview. | was also given a large piece of easel paper, which was used by Alex to write down the things that The Victim had said. These items were later entered into the Evidence room. Once The Victim's forensic interview was complete, The Victim's sister subsequently began a forensic interview. Present in the interview room was The Victim's sister and the Interviewer, Alexandra Heftye. The interview was both audio and video recorded by the KCAC. During the interview, The Victim's sister was asked to describe what she had seen while at school. The Victim's sister stated that on an unknown day at school, she, along with The Victim, were in the cafeteria eating lunch. At some pont during the lunch period, The Victim's sister looked over her shoulder and observed The Victim being tickled by Ricciardi. It should be noted that The Victim's sister stated that The Victim's back was facing The Victim's sister. Throughout the rest of the forensic interview, nothing of evidentiary value was disclosed and it ended shortly after. After the forensic interview was complete, | was provided with a USB drive which contained the audio/video recording of the entirety of the forensic interview. | was also given a large piece of easel paper, which was used by Alex to write down the things that The Victim's sister had said. These items were later entered into the Evidence Room. A short time later, Ricciardi reached back out to me and I spoke with him as to why | was calling him. | informed him that | was made aware of the incidents at the school and | asked him if he would be willing to speak with me, in person, either at his residence, at Police Headquarters, or at a focation of his choosing. Ricciardi asked me if he was under arrest and | informed him that he was not under arrest at this time, nor was there an active warrant fer his arrest. Ricciardi sounded apprehensive and explained that he would call me right back with his decision. On 01/13/25, after not hearing from Ricciardi for several days, | called Ricciardi to see if he had made a decision on whether or not to meet with me to discuss this incident. Ricciardi answered my phone call and | asked him what he decision was. Ricciardi stated, “1m just gonna plead the fifth." Based on the facts and circ.mstances for this incident, | completed an arrest warant application for Ricciardi, charging him with violation of one count of each of the following: CGS 53-21; Risk of Injury/Impairing the Morals of a Child and CGS §3a-181; Breach of Peace in the Second Degree. The arrest ‘warrant charges Ricciardi with violation of one count of each of the following: CGS 53-21; Risk of Injury to, or Impairing the Morals of a Child and CGS 53a-181; Breach of Peace in the Second Degree. With those charges, the arrest warrant carries a $40,000.00 court set surety bond. With the arrest warrant in hand, |, along with Detective Sergeant Hopkins, Detective Dudzinski and Officers Albini and Chin, proceeded to Ricciardi's residence to serve him with the arrest warrant, We subsequently arrived at Ricciardi's Manchester residence and were met by Ricciardi's father. | asked if Ricciardi was home and he proceeded out of the house. | explained to him that there was a warrant for his arrest and | instructed him to place his hands behind his back. Ricciardi complied and he was placed into handcuffs by Officer Chin, Officer Chin then conducted a search of Ricciardi and found no weapons or contraband. Ricciardi was then placed into the rear of cruiser #5, seat-belted and transported back to Police Headquarters. Upon arrival to Police Headquarters, Ricciardi was booked and processed for violation of one count of each of the following: CGS 53-21; Risk of Injury to, or Impairing the Morals of a Child and CGS 53a-181; Breach of Peace in the Second Degree.
