Dear Sir,
Pursuant to clause 19.3.1, 19.4 and Schedule H of EPC Contract for the above-
mentioned Project, the Application for Stage Payment Statement No. 17 (SPS-17) for the
period up to May’2025, is hereby submitted in the form set forth in Schedule O, for your kind
Certification and subsequent payment.

In reference to the above-cited subject and Policy Guidelines issued by NHAI. The
EPC contractor had submitted the SPS-16 upto 30th April 2025 with all supporting
documents as per clause 19.4 of the Contract Agreement. The Authority’s Engineer has
recommended 90% of the amount as part payment of SPS as per clause 19.5(i) of the
Contract Agreement. The SPS 10% amount is balance in respect of Authority’s Engineer
recommendation 90% of the amount as part payment against the SPS-16.
Therefore, we request to release the balance gross 10% amount of Rs. 2,81,60,547/-
(Rupees Two Crore Eighty-One Lakh Sixty Thousand Five Hundred Forty-Seven only)
against our SPS-16.
In view of the above, we are requesting to kindly recommend and release the balance
payment as soon as possible to speed up the project and timely completion of work.

Dear Sir,
We refer to the above subject matter and cited correspondences.
In order to resolve the issue of certain items of works included in the COS-I
proposal, a video conference was held under the chairmanship of NHAI RO (U.P
East) on 29/05/2025, which was attended by the PD NHAI, AE & the Contractor.
Subsequently, the Authority, vide its email dated 30.05.2025, has directed the
Contractor to submit its revised COS-01 proposal based on the above VC meeting
dated 29.05.2025.

1. Accordingly, the Contractor considered the followings while working out its
revised COS proposal based on the discussion held during the above video
conference dated 29/05/2025 -
(i) The rate of Backfilling with sandy soil behind wall of SVUP, as available in
the Project, has been considered as Rs.339 per Cum, as recommended by
the AE vide its letter dated 05/04/2025 referred at ref (6) above.
(ii) The Slope of Embankment of Main Carriageway (MCW), considered as
1:1.5 in place of 1:2 as recommended by AE vide its letter dated
05/04/2025 referred at ref (6) above.
(iii)The thickness of BC (30mm) and GSB (150mm) has been considered for
Connecting Road as recommended by AE vide its letter dated 05/04/2025
referred at ref (6) above, in line with other Service Road of the Project.
(iv) Embankment slope protection of MCW (additional work due to
introduction of Connecting Road under COS) has been considered based
on the design requirement of CA as per the instruction of the Authority
during VC meeting dated 29/05/2025.

(v) Behind the SVUP wall, “150mm dia perforated PVC drainage pipe wrapped
with geotextile” has been considered as per the approved drawing to
serve the drainage purposes. Therefore, Filter Media behind SVUP has
not been considered.
(vi) Metal Beam Crash Barrier (MBCB) of MCW at the location of the
Connecting roads has not been considered as per the instruction of the
Authority during VC meeting dated 29/05/2025.
(vii) The Labour Cess @ 1% is applicable for the Subject COS as explained by
the Contractor vide its dated 31/03/2025 referred at ref (8) above.
Therefore, Labour Cess @ 1% has been considered for the Subject COS,
based on the discussion held during the VC meeting dated 29/05/2025.
(viii)Revised Change of Scope proposal (i.e. COS-I) is worked out based on the
SOR of Ballia Circle of U.P PWD (w.e.f., 01/09/2021) with updation of basic
rate through WPI as on Project Base Date i.e. August 2022, as requested
by the Contractor during the VC meeting dated 29/05/2025.

2. Keeping in view the parameters mentioned in Para (1) above, the Contractor is
submitting herewith its revised COS proposal for an amount of
Rs.34,65,19,404/- (including GST@18% and Labour Cess@1%) as per
enclosed Annexure-1 for approval of the Competent Authority.
3. The Contractor has drawn a realistic work programme for construction of the
items included in its above revised COS proposal based on the standard
engineering practice (refer enclosed Annexure-2).
Upon perusal of the programme, it may kindly be observed that the Contractor
shall need a minimum time period of 275 working days for construction of items
included in the revised COS proposal, in addition to the time period stipulated for
completion of the subject Project as per the Contract Agreement. It is imperative
that the Contractor shall be entitled for suitable Extension of Time (EOT) for
construction of the items included in its revised COS proposal as above and the
Contractor shall submit its application for EOT in due course of time.

In view of the position explained above, the Contractor hereby request the
AE/Authority to approve the revised COS proposal of the Contractor as submitted
above in order to enable the Contractor to take up the works included in the
revised COS proposal and complete the Project as planned.

Dear Sir,
We refer to the above subject matter and cited correspondences.

With reference to the letter of the Authority’s Engineer dated 05.06.2025, referred at Sl (1)
above, the Contractor submits the followings for kind consideration and appreciation of the
Authority please:

a. Construction of Utility Duct:

1. The Contractor, vide its letters dated 12.04.2025 and 07.05.2025, referred at Sl (2) and
Sl (5) above, has categorically stated that Clause 7.2.8 of Schedule-B of the Contract
Agreement clearly directs construction of Utility Duct in the project as per provision of
Clause 2.16 of IRC: SP:84-2019.

2. Also, Clause 2.16 of IRC:SP:84-2019 refers to IRC-98 i.e. “Guidelines on


Accommodation of Utility Service on Roads in Urban Areas” and Clause 2.1.1 of
IRC:98-2011 states that “these guidelines are intended for use by the Authority
responsible for roads in the Urban Limits vested with powers to regulate the location,
design, installation and maintenance of public utility services laid or proposed to be laid
within the right of way of urban roads………

3. In view of the above provisions of the Contract Agreement, the provision of Clause 2.16
of IRC: SP-84-2019 and Clause 2.1.1 of IRC:98-2011 are included in Clause 7.2.8 of
Schedule-B of the Contract Agreement and therefore, is an integral part of the Contract
Agreement only.

4. It is also pertinent to state that the subject project is a Greenfield project and there is no
designated built up areas along the Project Highway as per Schedule-B of the Contract
Agreement, therefore the Construction of Utility Duct in the entire project length does not
arise, as per above provisions laid down in the Contract Agreement.

5. Further, the AE, in its above letter dated 05.06.2025, has referred to Clause 1.4 of the
Contract Agreement which states that “The Agreement shall prevail over other
documents forming part hereof or referred to herein” and contended that the provisions
of the Contract Agreement supersedes those of IRC: SP:84-2019 or any other
referenced documents.
As explicitly brought out by the Contractor through its letter dated 07.05.2025, referred
at Sl (2) above, Clause 7.2.8 of the Contract Agreement is a part of Schedule-B of the
Contract Agreement only and Clause 7.2.8 directs construction of Utility Duct in the
project as per provision of Clause 2.16 of IRC: SP:84-2019. Thus, the contention of IE
as stated in Para (5) above does not apply in the instant case.

6. Also, the AE, vide its above letter dated 05.06.2025, referred at Sl (1) above has
contended that “the Green Field Highway section of NH-31 which is being constructed is
being built bypassing the urban area (Town/block/villages). After the road is built, the
area will develop and the population will be on both sides of the road. This utility duct
will be very important at that time. After the road is built, it is natural for the area to
develop and this work cannot be done at that time.”.

In this connection, it is imperative to state that the Scope of Work to be executed by the
Contractor under the subject contract is clearly defined in Schedule-B and Schedule-C
of the Contract Agreement and the provisions of Schedule-B has been clearly explained
in Para (1) and (2) above. If, in the opinion of the AE, the construction of the utility duct
is intended to cater for future population needs, then such requirement ought to have
been explicitly included and mentioned in the definition of the Contractor’s Scope of
Work for the project at the bidding stage only. Therefore, the intention of AE for creating
the liability of construction of Utility Duct in the entire project length by the Contractor by
misinterpreting or assuming the provisions of the Contract Agreement is not tenable at
this stage of the project and therefore, not acceptable to the Contractor in any manner.

b. Construction of Median Drain:

1. The Clause 6.1 of Schedule-B of the Contract Agreement specifically addresses the
provision of Median Drain and states as follows:
“Lined drain shall be provided in the centre of the median as per section 2.10 of
Schedule-B, the Contractor shall design the median drain based on site/design
requirement mentioned in the Schedule D with approval from the Authority Engineer.”
2. Clause 2.10 Provides for development of different sections of the Project Highway as
per the TCS provided in the Schedule-B of the Contract Agreement and Note (6) of
Clause 2.10 of Schedule-B states as follows:

“Fig. 2.4A, Fig 2.4B, Fig 2.4D and Fig 2.4E are modified figures of Fig 2.4 of IRC SP-
84-2019.

3. The Contractor refers to the Annexure-II (Schedule-B) Typical Cross Sections, wherein
the Note for Fig. 2.4A, Fig 2.4B, Fig 2.4D and Fig 2.4E, specifically states that “Note:
DETAILS OF DRAIN SHALL BE AS PER 4.4.11 OF IRC: SP:42-2014”.

4. Clause 4.4.11 OF IRC: SP:42-2014 “Guidelines for Road Drainage” provides that
“……..When there is divided carriageway with a raised central median, disposal of
surface water of super elevated section requires elaborate arrangement…”.

5. In light of the above provisions, it is evident that the Median Drain, to be provided for
super elevated locations only as per IRC:SP:42-2014, is a direct invocation of the
Contract Agreement and accordingly, the Contractor has carried out the design of
Median Drain at super elevated locations based on the site requirement.

6. The AE, vide its letter dated 05.06.2025, referred at Sl (1) above, has drawn reference
of NHAI Policy Guidelines NHAI/Policy/guidelines/Misc./2020 No.18.48 dated
08.07.2020, which states that “It has also been mentioned that the contractor shall
develop the full sustainable drainage plan for entire project as per the site requirements
and according to the circular – NHAI/policy guidelines/Misc/2020 no 18.48 dated the 8th
july2020. Any increase shall not constitute of change of scope.”
Upon perusal of Para 2 (i) Under Construction Projects of the above Circular, it may be
observed that the contention of AE as above does not emerge from this concerned of
the said circular. To the contrary, the circular directs that new drainage plan if required
shall attract Change of Scope.
However, it is pertinent to state that the Contractor has developed the Median Drainage
Plan as per provision of the Contract Agreement only and therefore, reference of this
Circular does not apply in the instant case.

7. Clause 4.1 (xi) of the Contract Agreement states that “The contractor shall perform
the works in conformity with the project requirements and other requirements
and standards prescribed under or pursuant to the Agreement and Good industry
practice”.

8. As explained by the Contractor in Paras b(1) to (4) above, the Contractor has prepared
the Median Drainage Plan as per project requirement only as prescribed under the
Contract Agreement and therefore, there is no failure on the part of the Contractor in this
regard and the contention of AE of attracting Clause 10.6 of the Contract Agreement
does not arise.

In view of the contractual position explained above for construction of Utility Duct and
Median Drain for the subject project, the advise of the AE to Authority, vide its above letter
dated 05.06.2025, referred at Sl (1) above, is does not emerge from the provisions of
Contract Agreement as explained above and therefore, is not acceptable to the Contractor.
It is also important to state that the Contractor, vide its letter No. NKC/HO/GB/PKG-III/2025-
26/045 dated 26.05.2025, has nominated Smt. Stuti Narain Kacker, IAS (Retd.) as its
Nominee DRB Member and therefore, request the Authority to kindly nominate its Nominee
DRB Member for formation of DRB so that the above matter of provision of Utility Duct and
Median Drain in the entire Project Length may be referred to DRB for resolution of the
issues.

The Contractor has received the Mobilization Advance for 10% of the Contract Price
for an amount of Rs. 66,03,40,000/- as against the submitted Bank Guarantees for an
amount of Rs. 72,63,74,000/- (i.e., 110% of the Mobilization Advance of Rs. 66,03,40,000/-).

The Authority/AE has already released the Mobilisation Advance Bank Guarantee after
recovery of Rs 34,09,25,570/- from the respective SPS’s i.e. upto SPS No.13 (90% certified),

In this connection and as referred to the subject cited above, we may mention that after
recoveries of the advance upto SPS No.17 (90% Certified) for the month of May- 2025, the
balance amount of Rs. 15,16,75,699/- (Rs 66,03,40,000/- minus Rs 50,86,64,301/-) is to be
recovered further from subsequent SPS’s for which Bank Guarantee worth Rs
16,68,43,269/- being 110% of the balance advance amount of Rs 15,16,75,699/-, is required
to be held by the Authority.

In view of the above situation, we would like to draw the kind attention of the Authority to the
provision of NHAI’s Circular No. NHAI/ Policy Guidelines / Release of BG of Mobilisation
Advance in EPC & HAM/2018 No. 3.1.24/2018 dated 1 st October 2018 which states that
“(i) As the advances got recovered from the running bills/stage payments, the BG for the
amount equivalent to the amount of advance recovered may be released on the request of
the Contractor/Concessionaire and (ii) The Contractor/Concessionaire would be liberty to
either submit a substitute BG for the residual amount or multiple BGs for such residual
amount in replacement of the existing BGs” (copy enclosed).

In view of the position explained above and since the Bank Guarantee of Rs 16,68,43,269/-
is to be retained by the Authority for the balance mobilization advance of Rs 15,16,75,699/- ,
the Contractor would therefore request the Authority to release the BG No.
07361G0PG2330301 Dt.01.11.2023 of Rs 18,15,93,500/- valid upto 01-08-2025
mentioned at Sl. No. (3) of the above table and remaining Bank Guarantee valuing to Rs
18,15,93,500/- (which is higher than the requirement amount of Rs 16,68,43,269/-)
mentioned at serial no. (4) of the above table, may kindly be retained till recovery of the
balance mobilization advance amount of Rs 15,16,75,699/- from further SPS’s by the

a) Eco-friendliness: One rake can transport approximately 4000 tons of ash,
effectively replacing 100–120 trucks per day. This significantly reduces the carbon
footprint and supports green construction practices.
b) Smooth, Uninterrupted Supplies: Given the frequent road congestion in
Aurangabad Via Bhojpur district, especially near Dumrao, RCR mode ensures a
reliable and consistent supply chain to your project, bypassing road bottlenecks.
c) Local Administrative Restrictions: As you are aware, the local administration in
Aurangabad often imposes sudden bans or stoppages on ash-loaded trucks, which
disrupts delivery schedules.
d) Environmental & Safety Concerns: Due to rising concerns over vehicular accidents
and pollution, both the District Administration and State Pollution Control Board are
increasingly reluctant to permit further road-based ash transport.
By adopting the RCR model, we can mitigate all the above challenges while ensuring timely,
bulk delivery of ash in line with the demands of your nationally important infrastructure
project.
In view of the above, we request the Authority to process the letter to NTPC Nabinagar
(NSTPS) of pond/fly ash for M/s NKC PROJECTS PRIVATE LIMITED for the above-
mentioned project.

Dear Sir,
A memorandum of understanding has been signed between NHAI, PIU, Azamgarh
and BRBCL (A Joint Venture of NTPC Ltd. And Ministry of Railways) on 03.08.2024 for
Supply of 200000.0 Cum of Pond Ash to be lifted by Authorized Transporter/ Contractor of
NHAI PIU Azamgarh within a period of 4 Months, i e up to 17.07.2025.

Subsequently, BRBCL has issue the services purchase order no. 4000347160-062-2015
dated 28.11.2024, wherein it is stated that the duration of the service period upto
19.07.2025.

In this connection, it is to bring to the kind knowledge of Authority that the above Pond Ash is
to be transported from an approximate distance of 205.09 Kms and the road passes through
several market places and Mela areas such as Ballia, Haldi, Bairiya and Ramgarh Market
which is extremely crowded every day having two lane road, causing delay on
transportation.

In view of the fact explained above and considering the monsoon contractor therefore
request the Authority to kindly take up the matter with BRBCL for extending the validity of
MOU/Service Purchase Order for transportation of balance quantity of for further period of
four (4) month upto 19.11.2025, So that the supply of pond ash can be continues for suppler
completion of project.
