ORDER: In the reference s 1st to 7th cited Government have permitted the various Cellular and Tele services, Telecom Companies to install land based installations i.e., towers, base transreceiving stations, mobile network equipment, etc, and also roof top towers, shelters and antennas etc., duly exempting them from obtaining the building permission requirements and land use stipulations. In the reference last read above the Honble High Court quashed these memos in the larger public interest. All the Cellular Companies and Tele services, and Telecom Companies and all other Companies are therefore directed to obtain permission from the concerned local authority for their existing installations and also proposed installations i.e., towers, base transreceiving stations, mobile network equipment, etc, from the concerned local authority. All the Commissioners of Municipal Corporations, Municipalities, and Vice Chairmen of Urban Development Authorities in the State shall accord permission to all the existing installations and proposed installations, both land based and rooftop installations, as per rules, subject to fulfilling the following conditions by the applicants : namely: i). The applicant shall obtain necessary approval of the Air Traffic Controller, Airport Authority of India. ii). The applicant shall take special precaution for fire safety and lightening etc. iii). The applicant shall furnish a legally valid undertaking that they are solely responsible for any damage to the building and for public safety. iv. The applicant shall furnish NOC from the surrounding building owners, and also from the concerned building owner in case of rooftop installations. All the Commissioners of Municipal Corporations and Municipalities and Vice Chairmen of Urban Development Authorities in the State are further
2 directed to inspect all such land based and rooftop installations with in their jurisdiction and in case any such structure is found endangering the building or the lives of the residents, action shall be taken, in accordance with law to remove such structures.
