Edita P. Lacno, Hon. Edward T. Campos Be it ordained by the Sangguniang Bayan of Kananga, Leyte, in session assembled that CHAPTER General Provisions ARTICLE I Short Title and Scope Section 01. Tit This Ordinance shall be known as the “Comprehensive Section 02. Scope of Application (a) This Ordinance provides for the traffic rules and regulations on all roads in ‘the Municipality of Kananga, whether national or local in classification; pedestrian rules and regulations; vehicles stops and transport terminals; the Use of sidewalks and alleys; road use by all types of motor vehicle including motorized tricycles and pedicabs, bicycles, pushcarts and other forms of conveyances, whether public or private; and general, such other rules and regulations hereafter promulgated in furtherance of an optimum utilization of— ; the road network in the Municipality of Kananga, where the context applies, the rules shall also apply to public places. (b) All the applicable provisions of R.A. No. 4136, otherwise known as the “The Land Transportation and Traffic Codes of the Philippines”, the implementing rules and regulations prescribed by the Land Transportation Commission of the Department of Transportation and Communication, are all likewise adopted in this Ordinance. ‘Section 03. Declaration of Policy It is hereby declared the policy of the Municipality of Kananga that: (a) The flow of people and goods through the road network shall be as efficient, safe, unhampered and orderly as possible for the economic and social vitality and viability of the municipality; (b) Urban road space is a scarce commodity the component of which must be allocated for the greatest good and the greatest number through judicious, fair, participatory and informed traffic management system; (© Traffic problems and issues must be resolved in a rational manner, guided by facts and shaped through consultation, collaboration and coordination with the surrounding municipalities, the Land Transportation Office, the Business Sector, and the various transportation groups operating within the municipality; (d)_ The public has the right to be informed, and to participate in the formulation of any measures that may affect their community and traveling habits. ARTICLE IT Rules of Construction Section 01.Words and Phrases. Words and phrases embodied in this Code but not herein specifically defined shall have the same meaning as found in legal dictionaries as well as in existing Laws. Section 02. Construction of Codal Provisions. In interpreting the provisions of this code, the following rules of construction shall be observed unless otherwise inconsistent with the manifest intent of the provisions or when applied they would lead to absurd or highly improbable results. a) General Rule. All words and phrases shall be construed and understood according to the common and approved usage of the language; but technical words and phrases and such other words in this Code which may have acquired a peculiar or appropriate meaning shall be construed and understood according to such technical, peculiar or appropriate meaning. b) Gender and Number. Every word in this Code importing the masculine gender shall extend to both male and female. Every word importing the singular number shall extend and apply to several persons or things as well; and every word importing the plural number shall extend, and applied, also to cone person or thing. ©) Computation of Time. The time within which an act is to be done as provided in this code, or in any rule or regulation issued pursuant to the provisions thereof, when expressed in days shall be computed by excluding the first day and ‘including the last day, except when the last day falls onSunday or Holiday, in which case, the same shall be excluded from the Computations and the next business day shall be considered the last day. d) Tenses. The use of any verb in the present tense shall include the future e) f) tense whenever applicable. The words "shall have been” shall include past and future cases. The use of the word “shall” in this code means the act being required to be done is mandatory, whereas when the word “ may "is used, it means permissive. Conflicting Provisions of Chapters. If the provisions of different Chapters conflict with each other, the provisions of each chapter shall prevail as to all specific matter and questions involved therein. Conflicting Provisions of Sections. If the provisions of different sections in the same chapter conflict with each other, the provisions of the Section which is last in point of sequence shall prevail. Section 03. Amendment and Integration of Additional Provisions. Any amendmer int on this Code may be introduced to the chapter, article or section concerned. ARTICLE IIT Definitions ‘Section 01. Meaning of Technical Terms. As used in this Code, the term: “VEHICLE” - for any means of transportation or conveyance, private or public, intended for the transporting or conveying of persons, cargoes, from one point to another of the streets within the Municipality of Kananga including those operated by manual and animal power, and other machines mechanically powered, using the streets, elther having traction or rubber tires, “MOTOR VEHICLE” — shall mean any vehicle propelled by any other than muscular power using public highways, but excepting road rollers, trolley cars, street-sweepers, sprinklers, lawnmowers, bulldozers, graders, fork lift, amphibian trucks, and cranes used on public highways, and vehicle that run only on rails or track, tractors, trailer and traction engines of all kinds used exclusively for agricultural purposes.7 ae © (D) © ®) © (H) ® Qa (K) wo (™) (N) () (P) A trailer having any number of wheels propelled or intended to be propelled by attachment to a motor vehicle shall be classified as a separate motor vehicle with no power rating. “ROAD” — means the entire surface of any way or street open to public traffic. “CARRIAGEWAY" - the part of the road used by vehicular traffic. This is something called "Roadway" in other cities, A road way comprises several carriage ways separated from one another by, for example, a deciding median or different of level. “LANE” - one of the longitudinal strips into which the carriageway is divisible which is wide enough for moving line of motor vehicles. “INTERSECTION” - the place at which two or more roads cross or intersect with one another in angle, and this includes crossings and intersecting parallel roads or highways. “STANDING” - is a situation when a vehicle is stationary for a needed time to pick up or set down persons or to load or unload goods. “PARKED OR PARKING" ~ shall refer to a situation when a vehicle has been brought to a stop or about to be stationary to park on the edge of a road or highway shoulder where parking is allowed and remains inactive for an appreciable temporary period of time. “CYCLE” — any vehicle which has at least two wheels and is propelled by a muscular energy of the person on that vehicle by means of pedal or hand cranks, “PEDICAB” — a public or private conveyance, the sidecar of which is moved or drawn manually through a bicycle; a small three-wheeled hooded vehicle that is pedaled. “CABBY” - refers to a driver of a Pedicab. “MOTORCYCLE” — a two-wheeled motorized vehicle with a saddle and steering handle, propelled by combustion of gas or gas-oil combination, used as a means of transport, and which can be attached to a sidecar to serve as a tricycle. “ELECTRIC MOTORCAB” ~ a three-wheeled vehicle that is driven by battery powered electric motor and propeller shaft driven, operated to render transport service to the general public for fee also considered as motorcab. “DOUBLE PARKING” - refers to the vehicles parked parallel to each other at opposite sides of the road or streets. "GARAGE" - shall mean any building in which two or more motor vehicles, either with or without drivers, are kept ready for hire to the public, but shall not include street stands, public service stations, or other public places designated by proper authority as parking spaces for motor vehicles for hire while awaiting or soliciting business. “PERMISSIBLE MAXIMUM WEIGHT” - the maximum weight of a load vehicle declared permissible by a competent authority in which the vehicle is registered.@ (R) ©) (U) ™) (w) ” ” @ (AA) (88) (cc) (0D) (ee) (FF) “DIRECTION OF TRAFFIC” — this refer as to whether a particular country practices a right-hand side drive, such as that practiced in other country, the Philippines adopt a keep-right policy or left-hand drive vehicle which means that a driver of a vehicle must allow incoming vehicles to pass in his left, or the driver drives his vehicle in the right lane of the road. “OWNER” - shall mean the actual legal owner of a motor vehicle in whose name such vehicle is duly registered with the Land Transportation Office. HIGHWAYS" - refer to main or national roads that connect cities, towns, etc. They also include public thoroughfares, public boulevards, driveways, but shall not include roadways upon grounds of private persons, schools, and other similar institutions. “PEDESTRIAN LANE” ~ any part of the street duly marked with parallel straight lines forming a stripe line across the street where pedestrians may Cross safely upon go signal by traffic enforcers or traffic lights. “SIGNAL” - is either by hand or any device given in contemplation of the law. “PEDESTRIANS” - all persons travelling by foot or walking the streets or sidewalks. “SIGNAGES” - refer to written traffic signs or instructions posted at specific areas. “STREETS” - refer to public or private roads within the municipality, typically with houses and buildings on one or both sides, other than those referred to as highways. These also include access roads to farms and ther agricultural areas. “STOP STREETS” — are streets where all vehicles must stop when reaching an intersection with “STOP” sign, to yield to moving vehicles on thru-streets. “CITATION TICKET” ~ is an official document issued by a traffic officer or enforcer to erring drivers, operators or pedestrians for violation of traffic rules, calling for settlement, either by payment of fees or penalty or appearance in court. “LOADING AND UNLOADING ZONES” - the places designated in accordance with this ordinance where vehicles may stop to load and unload passengers and cargoes. “TRAFFIC ENFORCER’ ~ any police officer or person duly authorized to direct the flow of traffic who may be assigned with the permission of the Chief of Police. “RIGHT OF WAY” ~ for the purpose of this code, it means priority of preference of passage. “MOTORCAB” - is a three-wheeled vehicle with the passenger cab attached to a motorcycle intended for transporting or conveying passengers and for cargoes. “ONE WAY STREET” - are streets designated and sign-posted for purposes of expediting the smooth flow of traffic and where the flow of vehicular traffic is in one direction only. “THRU STREETS” - are streets where vehicles traveling the thoroughfares have the priority of passage. All vehicles intending to cross said streets must bring his vehicle to a full stop before proceeding on, and(6) (HH) q@) (a) (KK) (Ly) when no hazard exists and the operation of the crossing vehicle can be done with safety. “PARKING PLACES” ~ are places or areas designated for parking. “DRIVER” ~ is a person who possesses a valid and genuine professional or non-professional driver's license issued by the LTO to crive or operate a vehicle and who has control of the directional and mobile power of a vehicle, “EMERGENCY VEHICLE" ~ a vehicle used in responding to emergencies, calamities, fires and public disturbances, and this includes military and police car, fire truck, ambulance, and such other used for life saving Purposes. “HORN” ~ a device emitting sound signal to warn pedestrians or other motor vehicles. “LICENSE PLATE” - refers to an aluminum or metal plate with numbers and renewal sticker, attached on the front and rear of a vehicle to serve as proof of registration with the LTO and identification of the vehicle. “LTO” — shall refer to the Land Transportation Office, the agency of the national government that governs and regulates the operation of all land transportation in the country. (MM) “MUFFLER OR SILENCER” ~ a tubular gadget attached to the exhaust (NN) —_—S (00) (PP) (QQ) (RR) (Ss) S s (uu) (ww) KY cant system of a gasoline/diesel-fed engine of a motor vehicle, motorcycle or any motorized equipment to suppress noise and lessen smoke emission caused by engine combustion. “ONE-WAY THOROUGHFARE” — a thoroughfare the same as a one-way street on which vehicles are permitted to travel in one direction only, as indicated by a traffic sign or signals. “OVERTAKE” — to pass or attempt to overtake or pass a slower-moving vehicle traveling in the same direction. “PUB” = shall refer to a public utility vehicle bus franchised by the LTFRB for use as public transport of passengers. “PUJ" — shall refer to a public utility jeepney, franchised by the LTFRB for use as public transport of passengers. “PUV” — shall refer to a PUB, PUJ, or public utility tricycle of such other vehicles used as a public conveyance to transport passengers. “RECKLESS DRIVING" - is the driving or operation of a person of motor vehicle and willfully, intentionally or unintentional fails to take such ordinary caution and care to prevent incident or accident that results to injury to person(s) or damage to another's property. “REFLECTORIZED STICKER” — a strip of self-adhesive colored plastic ‘sheet which posted or installed on the side or rear of a motor vehide emitting reflective color when focused with light. “THOROUGHFARE ~ the main road or path forming 2 route between two places used for vehicular travel, exclusive of the shoulder and footway. “TWO-WAY THOROUGHFARE” — any thoroughfare where vehicular traffic travel is permitted in opposite directions on any road or street not designated as one way thoroughfare or street.ARTICLE IV DESIGNATION Section 01. The following streets are designated as follows: a) Thru-Streets: 1. All national and provincial highways; 2, F.A Larrazabal Avenue (from national highway; extending toward Bray. Tugbong’s Ormoc-Matag-ob Highway. 3, Manuel P.Tan Street 4, All road or street that do not display STOP sign at the intersection b) Stop-Streets: 1, All street or roads intersecting national highway; 2. All streets intersecting Thru-Streets; 1 (Feliciano Ablen Larrazabal Sr. Avenue or F.A. Larrazabal Sr. Avenue) 2 (Manuel P. Tan St.) 3, Manuel P. Tan Street entering national high way (Ormoc-Tacloban City). 4, Atty. Gregorio Batiller St. crossing Isidora Quano St. and at the intersection of Buenaventura Recta Street. c) One Way Street: 1. Hall going to the Highway. hy Prohibited P f Parking: 1) Within 10 meters from the corners of all intersection of highways and any streets corners. 2) A place which may be designated by the Chief of Police and no parking sign properly posted, which may vary from time to time as the need arises. 3) All vehicles are prohibited to park on the left side of any street facing the direction the vehicles is heading (wrong parking). 4) All vehicles are prohibited to park within five (5) meters from the perimeter of fire hydrant. 5) No vehicle shall park on the main entrance of schools during class hours, services in churches, and at all times on the entrance of hospitals. 6) There shall be no double parking on any street within the town proper. 7) All vehicles are not allowed to park on any street or place not allowed by this ordinance for parking, or when it is prohibited by the police in case of emergency, or when streets or places are within the route of parades, processions and other public function. 8) No vehicle shall park on any other street not designated as parking areas. 9) All vehicles are prohibited to park within ten (10) meters from any street corner. 10.)No oversight parking on any street within the market and commercial area in the Municipality. i) Route of Public Utility Vehicles: (Jee) Van, Buses) 1, Buses and PUJs - from Palompon, turn left at Brgy. Larrazabal Avenue then take Manuel P. Tan Street to the national high way for ‘Tacloban or Ormoc bound or takes Poblacion-Tugbong road for Palompon, Villaba or San Isidro routes. 3. Route C - dominant color yellow ~ Poblacion, Tugbong (via Tabunok) ~ Montealegre — Kawayan; d. Route D = Dominant color green - Poblacion ~ Rizal -Hiloctogan — Lim- a0 vice versa; @. Route E — Dominant color black ~ Montebello - Aguiting ~ Tongonan vice versa; f. Route F - dominant white Poblacion -Natubgan — Lonoy vice versa; 2. Pedicabs or Public Utlity Pedaled Tricycle ~ all licensed pedaled public utility tricycle or pedicabs - pot-pot shall be allowed to travel along all municipal road and street within the territorial limits of the Municipality of Kananga after obtaining a valid license issued by the Municipal Government. Pedicabs shall yield to any big fast moving vehicles by driving safely towards the road shouldering and stop temporarily until the road is clear of big and fast moving vehicle to avoid road related accidents. Travelling along National Highway shall be restricted only for Pedicab operator or driver to travel from the vehicle resident or garage to the Municipal roads or streets where they are allowed to pick-up passenger. k) Loading and Unloading Zones — A driver of a truck may park his vehicle in 2 “Loading and Unloading Zone” when actually loading up or unloading down goods or materials, provided he is present at all times and attending to the same. A driver of @ public utility vehicle shall stop, pick up or unload passengers only at designated loading and unloading zones. On sections of the road where there is no prohibition against loading and unloading, he may stop to pick up or unload passengers provided it is safe to do so and will not obstruct or impede vehicular traffic flow. Municipal streets where loading or unloading of goods or materials are to be prohibited shall be identified through an enactment of an ordinance for that purpose preferably thru the recommendation of the head of the traffic enforcer or the Chief of Police. k.1) LOADING AND UNLOADING AREAS A) Public Terminal located across east-west portion of the Public Market building 8) _Rotonda (Waiting Shed) C) Walting Shed across the street of the Municipal Hall for Ormoc bound vehicles. Tan St. along the National Highway towards Ormoc City. 2) Along blind curve on both side of the higway. 3) On pedestrian lanes. 4) Within ten (10) meters on any street corner along the National Highway. CHAPTER II Traffic Rules and Regulations ARTICLE V Driving Rules and Regulations Section 01, Right-side Driving. Unless a different course of action is required in the interest of safety and the security of life, person or property, or because of reasonable difficulty of operation in compliance herewith, every person operating a motor vehicle on a highway, street, roads shall pass to the right when meeting persons ‘or vehicles coming toward him, and to the left when overtaking persons or vehicles going the same direction, and when turning to the left in going from one highway to another; every vehicle shall be conducted to the right of the center of the intersection of the highway or street and any road to that matter. ARTICLE VI Overtaking and Passing a Vehicle Section 01. Overtaking a Vehicle. The driver of any motor vehicle overtaking another vehicle proceeding in the same direction shall pass at a safe distance to the left thereof, and shall not drive back to the right side of the highway until safely clear of such overtaken vehicle, except that, on a highway, within a business or residential district, having two or more lanes for the movement of traffic in one direction, the driver of a vehicle may overtake and pass another vehicle on the right. Nothing in this Article shall be construed to prohibit a driver overtaking and passing upon the right of other vehicle which is making or about to make a left turn. ARTICLE VII Restrictions on the Manner of Driving and Speed of Motor Vehicles Section 01. Speed Restrictions. 1. Any person driving a motor vehicle on a highway shall drive the same at a careful and prudent speed, not greater nor less than is reasonable and proper, having due regard for the traffic, and width of the highway, and of any other condition then and there existing; and no person shall drive any motor vehicle upon a highway at such a speed as to endanger the life, limb and property of any person. 2. Subject to the provisions of the preceding paragraph, the rate of speed of Q any motor vehicle shall not exceed the following: “7?MAXIMUM MOTORCYCLES. TRUCKS: ‘ALLOWABLE CARS, JEEPNEYS AND. Exemptions. The rates of speed prescribed above shall not apply to the following: 1. A physician or his driver when responding in prescribed emergency calls; 2. The driver of the hospital ambulance on the way to and from the place of accident or other emergency; 3. Any driver bringing ambulance or sick person for emergency treatment to a hospital, clinic or any other similar place; 4, The driver of a motor vehicle belonging to the armed forces while in use for official purposes in times of riot, insurrection or invasion. 5. The driver of a vehicle, when he or his passenger is in pursuit of a criminal; 6. A law-enforcement officer who is trying to overtake in hot pursue of a violator of traffic laws; or criminal elements getting away from crime scene, 7. The driver offically operating a motor vehicles of any fire department, provided that these exemptions shall not be construed to allow useless or unnecessary fast driving of drivers aforementioned. Section 03. Emergency Vehicles - Exemption from Speed Limits — The driver of any emergency vehicle may, when it is expedient and safe to do so: ENF ) ona sounding siren, bell or repeated horn, proceed, pass a traffic control signal displaying a red or amber circle or a red or amber arrow or proceed contrary to the discretion or instruction of any traffic control devices;b) ona sounding siren, bell or repeater horn, drive in any direction or any part of a road or overtake or pass on either side of another vehicle; ©) stop, leave waiting or park the vehicle at any place at any time; or exceed the speed limits prescribed in this Code. Section 04, Speed Contest/Drag Racing — it shall be unlawful for any person or persons to engage in, or to aid any motor vehicle, drag racing/ speed contests or exhibition of speed, on any public or private strect upon which the Municipality has been authorized to imposed traffic regulations, except as permitted by special permit from the Office of the Municipal Mayor. The permit shall indicate, among other things, the date, time and place of the speed contest, Section 05. Giving way to Overtaking or passing Vehicle. The driver of a vehicle about to be overtaken by another vehicle approaching from the rear shall give way to overtaking vehicle on suitable and audible signal being given by the driver of the overtaking vehicle, and shall not increase the speed of his vehide until completely assed by the overtaking vehicle. Section 06. Restrictions on Overtaking and Passing. a) The driver of a vehicle shall not drive to the left side of the center line of a : highway in overtaking or passing another vehicle proceeding in the same direction, unless such left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking or passing to be made safely. b) The driver of a vehicle shall not overtake or pass another vehicle proceeding in the same direction, when approaching the crest of a grade, nor upon a curve in the highway, where the driver’s view along the highway is obstructed within a distance of five hundred (500) feet ahead, except on a highway having two or more lanes for movement of traffic in one direction where the driver of a vehicle may overtake or pass another vehicle: Provided, that on a highway, within a business or residential district, having two or more lanes for movement of traffic in one direction, the driver of a vehicle may overtake or pass another vehicle on its right hand side. ©) The driver of a vehicle shall not overtake or pass any other vehicle proceeding in the same direction, at any intersection of highways, unless such intersection or crossing is controlled by traffic signal, or unless permitted to do so by a traffic enforcer or a police officer, except on a \ highway having two or more lanes for movement of traffic in one direction where the driver of a vehicle may overtake or pass another vehicle on the U right. d) The driver of a vehicle shall not overtake or pass, any other vehicle, proceeding in the same direction, between any points indicated by placing of official temporary warning or caution signs indicating that men are working on the highway. e) The driver of a vehicle shall not overtake or pass, or attempt to overtake : or pass, any other vehicle proceeding in the same direction in any “ no — passing or over ~ taking zone” indicated by road signages or the painted single or double continuous uninterrupted yellow line at the center of a ‘two way thoroughfare or street,ARTICLE VIIT Right of Way and Signal Section .01, Right of Way. The following rules shall be observed in yielding the right of way. a) b) 4) a) b) When two vehicles approach or enter an intersection at the same time, and moving toward the same direction the driver of the vehicle on the left shall yield the right of way to the vehicle on the right, except as otherwise provided herein. The driver of any vehicle traveling at an unlawful speed shall forfeit any right of way which he might otherwise have under the provisions hereof. The driver of a vehicle approaching but not having entered an intersection, shall yield the right of way to a vehicle within such intersection of turning therein to the left across the line of travel of such first mentioned vehicle, provided the driver of the vehicle turning left has given plainly visible signal of intention to turn as required herein. The driver of any vehicle upon a highway within a business or residential district shall yield the right of way to a pedestrian crossing such highway within a crosswalk or pedestrian lane, except in an intersection where the movement of traffic is being regulated by a traffic officer. Every pedestrian crossing a highway within a business or residential district, at any point other than a cross walk or pedestrian lane, shall yield the right of way to vehicles upon the highway. The driver of a vehicle upon highway shall bring to full stop such vehicle before traversing any * through street”: Provided, that when It is apparent that no hazard exists, the vehicle may move ahead slowiy at ten (10) kilometers per hour after bringing it to a full stop. Section 02. Exemption to the Right of Way Rules ‘The driver of a vehicle entering a highway from a private road or driveway shall yield the right of way to all vehicles approaching on such highway. The driver of a vehicle upon a highway shall yield the right of way to a police or fire department vehicle or ambulance when such vehicle is being operated on official business and the driver thereof sounds audible signal of his approach. The driver of a vehicle entering a “through street” shall stop at the intersection and yield the right of way to all vehicles approaching in either direction on such “through street”. Provided, that nothing in this Section shall be construed as relieving the driver of any vehicle being operated on a" through street” or highway from the duty of driving with due regard to safety of vehicles entering such highway or street or as protecting the said driver from the consequences of an arbitrary exercise of such right of way. Section 03. Signal on Starting, Stopping or Turning. ‘The following rules be observed before starting, stopping, or turning a vehicle, if The driver of any vehicle upon a highway, before starting stopping or turning from a direct line, shall first see that such movement can be made in safety, and if any pedestrian may be affected by such movement, shall give a clearly audible signal by sounding the horn, and whenever the operation of any other vehicle approaching or following may be affected by such movement, shall give a signal plainly visible to the driver of such other vehicles of the intention to make such movement.IF the driver is merely loading or unloading a passenger or cargo in places where it Is allowed; When the motor vehicle has suffered an engine breakdown; and had been moved safely to the right-hand side curb or edge of the highway or road; When the driver is making a minor repair or changing a flat tire after moving the vehicle at a safe area nearest to the right-hand side curb or edge of the road or highway. ARTICLE XI Obstruction to Traffic Flow Section 01. Regulated Acts. No driver of a motor vehicle shall perform any act of obstructing the smooth flow of traffic; including but not limited to, the following: i 2 Loading or unloading of passengers or cargoes in places not allowed for that purpose; Parking a vehicle diagonally on the side of a roadway; Driving so slowly in the wrong lane, in cases where the road has two or more lanes; Making repair or changing a flat tire in the middle of a roadway; Leaving a motor vehicle unattended in the middle of the road or any portion thereof which causes obstruction to the smooth flow of traffic; Other unnecessary acts which may cause obstruction to the flow of traffic; ARTICLE XII Rules and Regulations on Motor Vehicle Accessories Section 01. Tires of Motor Vehicle. No motor vehicle with metalic tires shall be operated upon any public highway, and solid tires whenever used be sufficient thickness to prevent the metal rims thereof from coming in direct contact with the road. Section 02. Brakes. Every motor vehicle with four or more wheels shall be provided with dual hydraulic brake system so that in case of hydraulic line failure affecting the braking efficiency of any of the four wheels at least either the front or rear ( wheels shall retain normal braking capabilities. In the absence of such dual braking |, system, every motor vehicle with four or more wheels shall be provided with safety valve [/ |, devices of such desion and make so tat failure ofthe hydraulic braking system of the U vehicle because of leakage in the line or other parts of the system will not affect all wheels but rather render at all times effective the braking power of either the two front wheels or the two rear wheels when brakes are applied. This requirement, however, does not apply to motor vehicles equipped with pneumatic braking system. Section 03. Horns. Every motor vehicle shall be provided with a horn or signaling device in good working order. Provided, however, that no horn or signaling device emitting an exceptionally loud or disagreeable sound shall be installed or used on any motor vehicle. All authorized emergency vehicles, such as ambulance and police cars, fire trucks for emergency calls shall be equipped with a bell, siren, or exhaust whistle of a type approved by the Land Transportation Office (LTO) and no such device shall be installed or used in any other vehicle. No vehicle not classified as a “motor vehicle” shall be equipped with a horn or signaling device similar to the horn customarily used on motor vehicle. oe FSection 04, Headlights. Every motor vehicle of more than one (1) meter of projected width, while in use on any aublic highway, shall bear two (2) headlights, cone on each side, with white or yellowish lights visible from the front, which not later than one ~ half hour after sunset and until at least one — half hour before sunrise and whenever conditions so require, shall both be lighted. Additional lamps and light may be carried but no red lights shall be visible forward or ahead of the vehicle. Trucks, buses trailers, and other similar vehicles must carry, while in use on any public highway during night - time colored riding lights on each of the four corners not more than ten (10) centimeters from the top. All motor vehicles shall be equipped with devices for varying the intensity of light, and the driver must dim the headlights or tilt the beams downward whenever the vehicle is being operated on well - lighted streets or whenever such vehicle meets another vehicle on any public highway. Section 05. Tail - Lights. Every motor vehicle and trailer shall, during the above - mentioned hours, also bear on each side in the rear a lamp showing a red ight visible at least one hundred (100) meters from the rear of the vehicle and a lamp throwing a white light upon the number plate issued for such vehicle. Section 06. Stop Lights. Every motor vehicle shall be equipped at the rear with at least one lamp which shall throw a sustained bright red light visible under all conditions, even under bright sunlight, when the brake is applied. Each bus, trucks, traller, or similar vehicle shall be equipped, as its stop light at or near its rear center, with a lamp at least twelve centimeters. Section 07. Lights When Parked or Disabled. Appropriate parking lights or flares visible one hundred (100) meters away shall be displayed at a corner of a vehicle whenever such vehicle is parked on highways or in places that are not well - lighted or is placed in such manner as to endanger passing traffic. Section 08. Windshield Wiper. Every motor vehicle shall be equipped with a mechanically or electrically operated device for wiping off raindrops or other moisture form upon its front windshield Section 09. Use of Red Flag. Whenever the load of any vehicle extends more than one (1) meter beyond the bed or body thereof, there shall be displayed at every projecting end of such load a red flag not less than thirty (30) centimeters both in length and width, except that during night - time there shall be displayed, in lieu of the required red flags, red lights visible at least fifty (50) meters away. Section 10. Mufflers. Every motor vehicle propelled by an internal \ combustion engine shall be equipped with a muffler, and whenever said motor vehicle is being operated its muffler shall not emit or make unnecessary or disagreeable odor, smoke or noise, ARTICLE XIII OPERATION OF VEHICLES Section 1. Every motor vehicle using the streets of Kananga must be provided with the necessary license and registration as authorized by law. Section 2. All public utility vehicles operating within the jurisdiction of Kananga, Leyte only, shall have Police Number. For this purpose, every owner, operator or driver shall report to the Police Department in order that a number maybe assigned to the vehicle according to specifications hereunder stated wit: A. JEEPNEYS, MOTORCABS: 1. Rear (right side) ~ shall be painted in dark color over a white square field 9” long 9" wide. pee (pone2. Front (left side) — large enough to be easily read at a distance of not less than 30 meters away. 3. Inside (right front) — large enough to be easily read by passengers. B. PEDICABS: 1. Front — its shall be painted in red color over a white square field, large enough to be easily read. 2. Inside — its shall be painted in red color over a white square field, large enough to be easily read. Section 3. All pedicabs, and motor cab, shall be provided with a plate number to be issued by the Municipal Treasurer's Office upon payment of the necessary fees and charges to operate passenger or transportation business as provided in Art. XVIII. Section 4. All bicycles and push carts of any kind shall be provided with a plate number to be issued by the Municipal Treasurer's Office upon payment. ‘Section 5. Such plate numbers shall be kept clean and cared for and shall be firmly affixed by the owner or operator in a manner to be entirely visible and always legible, and shall not be wholly or partly hidden or obscured by bumpers or other parts of the vehicles or by articles of any description carried on such vehicles. i Section 6. Owners or operators of public utility vehicle shall have the registration of the vehicle carried whenever the vehicle Is operated or a copy thereof duly signed and subscribed under oath by the owner or operator, and names and addresses of owners/ operators shall be printed inside said vehicles large enough to be easily read. Section 7. Owners or operators of vehicles must know the names and addresses of the drivers, plate numbers of their vehicles and must furnish them to any Police Officers when demanded in the investigation of crimes or accidents. for their vehicles. Section 9. It is unlawful to use unauthorized license, plate number or engine number of a motor vehide. It is likewise prohibited to use police vehicle number on another vehicle not properly given or assign such number in order that the latter shall be operated within the Municipality. The owner or operator of such vehicle shall be held liable therefore. Section 10, Operators or owners of any motor vehicle when in use for the purpose of collecting garbage, trash, or the like, shall so construct the body of their vehicles in order that such matter shall not be scattered on the streets. In this connection, such work should be carried out during night time when there are less pedestrians and houses are closed. Section 11. Operators or drivers of any vehicle carrying explosives, chemicals, materials and the like, which are dangerous to the public shall, before it is operated, secure the necessary permit from the Office of the Fire Station Commander and/ or the Office of the Station Commander of the PNP. The offices concerned herein shall see to it that permission shall not be given in transporting of said materials if such will cause grave and immediate danger to human lives. If otherwise, its safe transportation should be granted only after necessary precautions has been adopted and the proper signals displayed in accordance with this code. The above paragraph shall also apply to vehicles used for the delivery of gasoline from depots to gasoline stations. Section 12. The motor power of any vehicle shall be stopped whenever the vehicle is left parked or unattended on any street. Section 8. Vehicle owners or operators shall not use the public streets a garage |Section 13. Every vehicle propelled by an internal combustion engine shall be equipped with a muffler. No unnecessary noise shall be given off or any smoke be emitted out that is obnoxious to persons. Section 14. All vehicles moving on public streets shall, before traversing a “Thru-Street”, be brought to a full stop. Whenever it has signed posted, it shall be unlawful for the driver of any vehicle to fail to stop not less than 2.5 meters from such Thru-Street if itis apparent that no dangers exist the vehicle may proceed slowly across at speed not exceeding Ten(110) kilometer per hour at the intersection. Section 15. All motor vehicles shall be equipped with wind-shield and a device known as “Wiper” for cleaning rain or moisture from such portions which comes within the driver's view. Section 16. All vehicles must be provided with adequate device for braking any vehicle with malfunctioning braking devices shall not be allowed to continue travelling unless the defect is properly fixed. Section 17. All vehicles shall not take more than the allowed passengers, or more freight or cargo in the vehicle than its registered carrying capacity. For other vehicles, the herein capacity limit for passengers should be followed: a) Motorcycle — only one rider is allowed on a motorcycle, and both driver and a rider shall wear the prescribed helmet at all time when travelling. b) Bicycle - only one person is allowed. ) Pedi cabs - only two (2) passengers are allowed. d) Motorcab — limited to its registered design and sitting capacity In connection with the above paragraph, the following are held liable for such offense. 1) For public utility vehicles, the driver and conductors shall be held liable. 2) For motor cabs, Pedi cabs and other slow moving vehicles. The one conducting the conveyance shall be held liable. For trucks and passenger automobiles for private use, the driver thereof shall be held liable. Section 18. No person having control of any vehicle shall negligently run afoul ‘on any person, vehicle or other things, nor shall such person fail to stop his vehicle in order to render assistance to a person injured or give his name and vehicle number when demanded by anybody therein Section 19. All vehicle loaded with sugarcane, trucks and trailers loaded with sand gravel, filing materials and other aggregates shall cover their load with canvass or any material in order to protect pedestrians and motorists from being hit by falling canes, rocks or sands. Section 20. Every driver of any vehicle where any of his passengers is unruly, disorderly in a manners, or one who tries to interfere in the operation of the vehicle, shall stop his vehicle upon seeing first the Police Officer and shall report the matter to him, Such disorderly, unruly or interfering person shall be held liable under this Ordinance. Without prejudice to the filling of case for violation of other existing laws. Section 21. Every driver of any vehicle who shall discover any parcel left by any passenger shall immediately deliver the same to the owner or to the nearest Police Station Section 22. It is unlawful for any person to operate or drive a vehicle going against the direction of a one-way street. AN?Section 23. No person shall impede the flow of pedestrian traffic on the sidewalk of any street by displaying wares or merchandise. ARTICLE XIV Municipal Roads — Prohibitions and Restrictions Section 1. Putting Sharp Objects, Slippery Materials or Substances on Municipal Roads, Streets and Highways. It shall be unlawful for any person or person(s) to put or strew nails, tack, glass, sharp objects, slippery materials or substances and the like on municipal roads and highways which could cause fiat tires, slippage/ skidding of the vehicle, or that could make the vehicle driver lost control or make the vehicle go wayward, resulting to accident and damage(s) to person(s) or property. Section 2. Tracking or Spilling Mud, Cement, Debris, Human and Animal Waste or Obnoxious Substance unto the Municipal Roads, Streets, Highways. = Spilling of mud, mixed cement, debris, human or animal waste and other obnoxious substance on public road which constitute hazard to the road, street or highway and health of pedestrians or nearby residents, or obscure the painted pavement markings thereon is/are strictly prohibited. In the event that mud, mixed cement, debris, human ‘animal waste or obnoxious substance is spilled or leaving of tracked into the road, reet or highway, in addition to the imposition of fine/penalty, the registered owner And/or driver of the motor vehicle or animal drawn cart, that caused the spilling or tracking, shall removed as quickly as possible the spilt material, otherwise, the removal shall be done by the Municipal Government at the expense of the registered owner/driver of the vehicle or animal-drawn cart. Section 3. Obstructing Roads — a) Apperson shall not, without the written permission of the PNP Traffic Division, drive or leave standing any vehicle on a road for the purpose of: a1) soliciting employment or doing business using the vehicle; as office or place of business; 2-2) displaying an advertisement on the vehicle; or 2-3) Offering foods for sale from the vehicle. b) A person shall not stand or place himself on a road for the purpose of: b-1) soliciting contribution or donation; b-2) display any advertisement; or b-3) offering goods for sale. ©) A person in a vehicle shall not buy or offer to buy an article from any person standing or placed on a road. 4) A person shall not bar, impede or divert the flow or direction of traffic from any road, street or highway, unless authorized in writing or except when the closure of a road or any part thereof to traffic or the direction of traffic is dictated by reasons of emergency to protect the public from any calamity, fire or other public danger. e) The prohibition contained herein shall also apply to the use of roads and sidewalks by any commercial establishment, vendors and repair shops or for personal purposes(s) of any person or individual whose residence is located ‘on the front of the road or sidewalk, Stalled vehicles on thoroughfares shall be considered as obstructing to traffic if not removed or towed.9) Owner of lots that have trees grown or planted on area along the National, Municipal, Barangay Roads whose branches growth have extended into the ‘space within the road right of way shall be compelled to cause for the proper trimming or pruning of such branches to clear the way for passing vehicles, none compliance to this provision is tantamount to obstruction of traffic by the lot owner and the same shall be subjected to the penalty under this Ordinance. The national government thru the Department of Public Works and Highways and the LGUs concerned shall cause for the conduct of periodic inspection to make sure that vehicles and pedestrians shall be safe from obstruction and hazard caused by protruding or extended tree branches within the road right of way. h) Land owner shall be compelled to cut down coconuts trees whose stem or trunk leans or bends from a vertical position towards the side of the road or street that may result to coconut fruits and coconut palm foliage hanging in the area within the road right of way that further endanger pedestrians and passing vehicles to be hit by falling coconuts or dried palm leaves. The same is true with dead coconut tree and other dead trees of any kind when the length of the stem or trunk is long enough that if it fall over to the direction of the road or street portion of the stem or trunk may hit part of the road right of way and posed imminent danger to travelling vehicles and pedestrians. Section 4. Other Restrictions on the Use of Streets, Sidewalks and Public Places. The use of streets, sidewalks, avenues, alleys, bridges, parks and public places in Kananga, Leyte for commercial and personal purposes, are hereby prohibited. Such prohibited acts shall include, but not limited to the following: i) Vending or selling of foods, magazines, newspaper, cigarettes, brooms, watches or jewelries, shoes and other footwear, and/or any other items, including the buying of gold and jewelries and money changing. ll) Conduct of shoe-shine ili) Conduct of "religious" activities, such as preaching and soliciting | alms or contributions; | iv) Doing house hold chores, such as, washing clothes, hanging clothes and bathing; vy) Unauthorized used as vehicle garage and/or vehicle repair; or for car washing business. vi) Dumping garbage; \ vil) Setting up basketball court or for use as sports area; J viii) Storing soft drinks, wine, liquor bottles or cases; ix) Drinking liquor or other intoxicating drinks and/or holding picnics or gatherings; x) Storing or piling of construction materials for sale, such as, pipes, tubings, lumber, cement and the like; . xi) Extending house/stall/store and installing roofs or awnings; xil) Installing permanent picket fence; xii) Putting plant boxes or planting shrubs and tress; and xiv) Setting up signs or signboards on or extending above sidewalks,Section 5, Illegally-Built, Unauthorized Structures - Any illegally-built or unauthorized structures constructed on roads, streets, avenues, alleys, sidewalks, bridges, parks and other public places that pose as obstruction(s) shall be demolished and removed without any prior notice. This applies electric/telecommunication/cable posts or poles, as well as, those used for signs, streamers and advertisement, other apparatus and utility boxes. Section 6. Goods, Materials and Items on Streets or Sidewalks- All items, goods, and materials found, situated, stored or stacked along roads, streets, avenues, alleys, sidewalks, bridges, parks and other public places, shall be removed and confiscated by the Municipality without any prior notice. The same shall be treated as common or ordinary garbage and shall be disposed off as such. Provided, that food ‘commodities may be given by the Municipal Government to prisoners of the Municipal Jail. The Municipal Government shall not be held liable for any damage arising from the removal, confiscation or disposal of said items. Section 7. Restrictions on Animals and Livestock’s on Roads — a) No persons owning, controlling or having possession of any livestock or animals, such as cattle, horses, swine, goats, etc. shall negligently permit any such livestock or animals to stray upon or remain unaccompanied and unleashed by a person in-charge or in control thereof upon any municipal road. \ Other Prohibitions a Section 1. In connection with the conduct of vehicles, no person under the age of eighteen (18) years shall drive or conduct any vehicle except when he or she had obtained a student permit to operate motor vehicle and shall be under the supervision of a professional driver instructor. Drivers while conducting the vehicles shall be neatly dressed, and in no case be in their under wears only. Drivers of motor vehicles when conducting the same shall wear shoes and in no case be on their bare feet or sleepers. Section 2. No licensed driver shall permit any unlicensed person to conduct his vehicle under his control nor permit another to interfere in the operation of the vehicle. Section 3. No licensed driver operating the Kananga-Ormoc and vise versa route shall permit any person to be a corductor without the conductor's permit issued by the office of the Kananga Municipal Mayor. \ Section 4. No driver of any public oassenger vehicle shall smoke while operating | his vehicle nor allow any passenger to smoke inside the vehicle at al times. Section 5. Any person driving a vehicle shall stop upon signal of any Police Officer or other law enforcement officers and shall give their license to operate a vehicle when so demanded, asking a proper receiot thereof. It is hereby made the duty of such officers to give the necessary receipt for the license where taken, Section 6. Bicycle riders are prohisited to cling to or hold on to another vehicle for the purpose to being pulled. No two bicycles shall travel side by side with drivers holding each other on the street. Section 7. No motor vehicle shall carry a load on its top without the necessary J permit from the Land Transportation Office. Section 8. No person is allowed to ride as a passenger on any pulled trailer intended for cargo nor shall such trailer be utilized for advertisement or other purposes other than for cargo. Section 9, No person shall ride on the running board, step board, wheelguard of any vehicle for any purpose including the conductor when making collection, an inspector when pursuing his duties. For this purpose, the conductor is liable in case of UV cars and the driver is liable in case of other motor vehicles.Section 10. No person shall puncture or otherwise injure the tires or any part of a vehicle. Section 11. It is prohibited absolutely to drive a vehicle over fire hose laid by firemen of the Fire Department during operation. Section 12. No person shall spit on the floor, sides steps or place the feet upon the seat ahead of them on any public vehicle. Section 13. The driver of the vehicle shall not refuse any passenger, except: a) When the car is fully loaded; b) When the passenger is drunk, except upon order of a Police Officer; c) Person known to be affected with communicable disease, or; d) When he is carrying anything obnoxious that is nuisance or will endanger the health of the other passengers in the car. Section 14, No driver or conductor of any public vehicle shall collect an amount higher than the allowed fare rate established by the Land Transportation Office (LTO), ‘as approved by the Public Service Commission (PSC) respectively. ‘Section 15. No person shall operate a vehicle when intoxicated, or under the influence of liquor. A“ Section 16, No person shall blow the horn of a vehicle unnecessarily in any place within the town nor shall blow or play music or announcement with the use of a loud speaker or amplifier in church zone, hospital zones and school zones. The announcement made or music played should be modulated in volume so as not to constitute a disturbance or annoyance to the public. It is unlawful to use air horns that emits excessively loud sound that is painful to the sense of hearing to people within the ‘town limits of Kananga. Section 17. No person shall disseminate any advertisement or any thing by using a vehicle with a public address system without its permit from the Municipal ‘Mayor, with the favorable recommendation of the Chief of Police. (\ Section 18, It is unlawful to drop or cause to be dropped leaflets, programs, | advertisement or other propaganda of any industry, business, shows, or other enterprise from any vehicle while the same is in motion within the streets of the Municipality of Kananga. The person dropping or causing the same to be dropped or the manager of the enterprise shall be held liable for violation of the anti-ittering ordinance of the town and this code. Section 19. All persons and vehicles within the hearing distance of any public announcement being made by the authorities and intended for drivers and the public shall immediately stop and the driver should stop the motors of their vehicle in order to | maintain silence so that the public can hear well. Section 20, It is unlawful for any person to operate or drive motor vehicles having a weight of TEN AND ONE HALF (10 %) TONS and above on any municipal street of the town without the written permission of Municipal Mayor with the favorable recommendation of the Municipal Engineer. Section 21. No person shall operate any motor vehicle on the public highways, of any street or road without having possession of a driver's license for the current year, nor while such license is delinquent, invalid, suspended or revoked. Section 22. Every license or duplicate thereof issued to operate public utility tricycle or pedicab shall bear a recent readily recognizable photograph of the licensee which shall be securely attached to the license. 4 ca)Section 23. No person shall operate a motor vehicle with an expired Citation Ticket. Section 24. No person shall use a siren in his vehicle for signaling or otherwise, except Police Officers, Fireman, and Hospital Ambulance. However said sirens shall only be sounded in an emergency, or when such persons are in great hurry in connection with urgent discharge of their public duties. Section 25. No person shall obstruct or maintain a stall nor shall the owner of the lessee of the building thereof allow any other person to obstruct or maintain a stall on a public street or its sidewalk as to impede or obstruct the free passage or flow of pedestrians and/or passersby thereon. Section 26. All vehicles should stop at intersections and remain immobile at their proper places during parades, motorcades and other public functions that require the use of the entire roadway. Only after the last element of the unit shall have passed by the intersection will motorists be allowed to move towards their direction of travel, Section 27, Pedestrians while crossing the roadway shall use the pedestrian lanes/ crosswalks designated for such purpose. Section 28. All vehicles approaching pedestrian lanes shall stop when there are pedestrians crossing and if there are none using the same, they should slow down, Section 29. The Police Officers, through the Station Commander, shall be empowered to remove, dismantle any illegally constructed/ displayed goods or edifices (on road or street as authorized by the Municipal Mayor. Section 30. All vehicle are prohibited to unload sand and gravel for storing purposes on the roadway. Section 31. There shall be provided to the Police Station, either by procurement or charter by the Municipal Government, a tow vehicle or towing car to remove illegally parked and other physical obstruction present on the roadway or sidewalk subject to the availability of funds. Section 32. Only two (2) persons shall be allowed on the right side front seat of the driver, likewise, no passenger is allowed on the left side front seat of the driver of any motor vehicle for hire in the Municipality of Kananga. Section 33. All people engaged in the dispatching of passengers for accommodation to vehicles for hire, must before engaging the business, first secure a Mayor's Permit to operate business. Section 34. Owners/ Operators of Gasoline Service Station shall not allow the overnight parking/ repair or to utlized sald service station as waiting station for passengers of all kinds of vehicles. It shall also be a violation of this Code to utilized service stations as canteens/snack centers where the operation of the canteen/ snack center involves the cooking of food to be served to customers. Operating of vulcanizing shops within the Service Area/ Center is likewise prohibited. Section 35. All cargo and container trucks transporting vans and other heavy equipment and cargoes shall be equipped with steel harness and other locking device which would hold the cargo firmly and securely during the transport of said cargoes. Section 36. No stool or any movable sitting device, other than what is normally provided for seating of passengers shall be allowed on any “For Hire Vehicles” for the purpose of accommodating or seating of passengers more than its allowed capacity. ARTICLE XV INSPECTION OF PUBLIC UTILITY TRICYCLE OR PEDICAB, AND MOTORIZED TRICYCLE FOR HIRE OR MOTORCAB. ee)Section 1. The Police Department in Coordination with the Muntcipal Engineer's authorized representative is hereby authorized with the periodic check-up of all vehicle for hire operating in the Municipality of Kananga for the fitness of traffic operation and public safety. Section 2. The Police Department may avail of any assistance as maybe provided by the Municipal Engineer's Office or other persons who have the knowledge of the safety and operation of vehicles. ‘Section 3. If after checking or inspecting , a vehicle is found to be unfit for traffic operation or endangers the public, then the same must be declared “UNSERVICEABLE” however, the same may be provided with the lacking parts, if any, to make the necessary replacement or repair and is then qualified for ¢ re-check-up. If found to be a good condition, the same shall be declared "SERVICEABLE” and could be ‘operated again. Section 4, Checking and inspection shall be made every six (6) months by the Chief of Police, or any of his representative and any authorized representative of the Municipal Engineer's Office, and a sticker shall be posted on the windshield of every vehicle so inspected, showing the fitness of said vehicle for operation. A service fee of Fifty Pesos (P50.00) shall be collected for every vehicle inspected payable to the \Treasurer’s Office. For the convenience of the owners of "Vehicles for Hire”, they shall _/be notified ten (10) days prior to the inspection of their vehicles. Section 5. For the purpose of checking and inspection of the vehicles as provided for in the preceding paragraph, the Station Commander and the Municipal Engineer are hereby authorized to issue implementing rules and guidelines to implement the above-mention provisions. Section 6. All people are hereby requires to obey the order of any Police Officer in the Municipality of Kananga delete in relation to the enforcement of the Traffic Code. ARTICLE XVI IMPOUNDING OF VEHICLES Section 1. All vehicles enumerated under this paragraph are liable to be impounded if found to be under any of the following conditions; a) Any motor vehicle which, for any cause, Is unable to proceed under its own power and is left unattended by responsible person for more than Two (2) hours in any street. b) A vehicle which is not properly parked in such a manner as to block or interfere with the passage of persons or vehicles. ©) Avehicle parked on any prohibited place for parking when left unattended. d) Avehicle using the public street as garage. e) Vehicles which are the instruments or proceeds of crime. f) Stolen vehicles. 9) Any motor vehicle for hire, loaded with passengers which cannot proceed towards its destination due to mechanical defect or malfunction, thereby amounting to failure to convey passengers shall be considered unfit to carry on its business and shall be impounded until such repair or correction of the motor vehicle is made; however if upon inspection by the Police Officer it is discovered that the same was at the time fit but was made only as a pretext on the part of the driver as an excuse thereof, then, such circumstances shall be considered as “Refusal to Convey Passengers” and said driver shall therefore be subject to penal liability under this Ordinance. oa)Section 2. All vehicles shall be move and impounded in the vicinity of the Police Department and kept there until the authorities order their discharge or the owner claims them by paying the impounding fees. However, vehicles designated in letters e, f, and g are not subject to impounding fees. Section 3. The following impounding fees are hereby fixed payable to the Municipal Treasurer by the owner of the vehicle impounded plus incidental expenses for the removal of the vehicle or its transfer, if any: a) For each truck or tractor for one day or a fraction thereof, One Hundred Pesos (P 100.00); b) For each jeep or four wheeled vehicle trailer, for one day or a fraction thereof, One Hundred Pesos (P 100.00); ¢) For motorcycle, motor cab, Pedi cab, scooter and like, for one day or a fraction thereof, Fifty Pesos (P 50.00); and d) For all others, such as bicycle, push-carts and delivery tricycles, and the like, for one day or a fraction thereof, Twenty Five Pesos (P 25.00) ARTICLE XVII DUTIES, POWERS AND ENFORCEMENT BY THE POLICE DEPARTMENT IN RELATION TO THE TRAFFIC CODE ‘Section 1, All members of the Kananga Police Department are hereby charge with the enforcement of this Traffic Code. Section 2. Pedestrian lanes, one-way street and other signs or marks - It is hereby made the duty of the Chief of Police to cause for the installation of all proper signages or the intended places indicating or prohibiting loading, unloading, parking, in order that the provisions of this code would be carried into effect. Likewise, the Municipal Engineer has the duty to provide the necessary signages, symbols and marks with the necessary laborer and other such materials in the installation of said signages symbol that may be needed by the Chief of Police. Section 3. In the interest of peace and order and public service, and to remedy the existing conditions found to be hazardous to vehicular traffic and to prevent congestions of the traffic in any street or to facilitate the movement of vehicular traffic, the Chief of Police or any of his authorized representative or member shall have discretion to re-route traffic, redesignate Thru Street, Two Way or One Way Streets and to Stop Streets, parking places, loading and unloading zones in emergency cases; traffic accident, during and after calamity period, in the event of an ongoing criminal activity. Section 4. All Police Officers are enjoined to issue a Citation Ticket to every driver for any violation of this Ordinance. Such Citation Ticket shall serve as temporary license to drive until a given date for the violator to report to the Office of the Chief of Police. Section 5. All members of the Police Department can order any driver operating any vehicle within the jurisdiction of the Municipality of Kananga to stop their vehicles anytime of the day or night either by signal, whistle or voice, by establishing check points, road-blocks in order to investigate and inspect vehicles in the event of sudden state of danger like armed, robbery, a surprise attack or invasion by armed rebels, or to intercept criminals pursued by authorities using the highway as escape route or any violation of this Code or other laws, and to arrest the offenders, or bring any person to Police Headquarters for further investigation as the case may warrant, ARTICLE XVIIL OPERATION AND MAINTENANCE OF MOTOR CABS AND PEDICABS FOR HIRE AND FOR PRIVATE USE IN THE MUNICIPALITY OF KANANGA /Section 1. LICENSE FOR MOTORCABS AND PEDI CABS No people shall posses, own or maintain any motor cab and Pedi cab for hire without first obtaining a license to operate from the Office of the Municipal Mayor. Section 2. LICENSE FEES There shall be paid to the to Municipal Treasurer's Office a fixed amount provided under the Municipal Tax Code as license fee payable annually during the first Thirty (30) days of the year. Provided, that any person who shall secure a new license after the expiration of the period herein provided, shall pay the fee for the whole year if paid before the beginning of the third quarter, otherwise he will pay only one half of the same regardless of the time left for the expiration of the fiscal year. Failure to pay the fees herein required, a penalty of Ten Percent (10 %) shall be imposed and in case of a new registrant, he must register his/her vehicle within five (5) days before he operates the same. Section 3. LICENSE PLATES Upon payment of fees mentioned in the next preceding section, there shall be id the sum of One Hundred and Twenty Five Pesos (P 125.00) (which may be creased depending upon the acquisition cost of plates) for the license plate which hall be in duplicate. License plates for Motorcab, Pedicab for hire or for private use ‘shall be serially arranged in numbers by the Municipal Treasurer or his duly authorized representative. In case for vehicles for hire, the owner shall place one of the plates at the back of the vehicles which must be conspicuously visible and the other on the frame of the awning of the pedicab in such a way that it will face the passengers of the vehicle. The license plates must be kept clean at all times and under no circumstances shall the numbers and colors be changed. In addition to the license plate required to be attached to the vehicle, there shall be in big numbers, a police number assigned to said Motorcab and Pedicab which shall be painted conspicuously at the back of said passenger cab, at the front and inside it. As provided under Art. XIII Section 2 (A)(B). Section 4. PROCEDURE IN THE ISSUANCE OF LICENSE ‘The Mayor or his duly authorized representative shall, upon written application and favorable recommendation of the Chief of the Traffic Division of the Police Department, approve the application for the issuance of the license no application shall be approved unless the unit is properly inspected and certified safe by the Chief of Police or any of his authorized representative and in the case of Motorcab a valid registration issued by the LTO. Section 5. EQUIPMENT AND CONDITIONS Every vehicle shall be strongly built, well balanced and neatly painted with upholstered seats, side and back-rest, provided with headlights, stop lights and signal lights, horns with waterproof top, side curtains, rain aprons, rare view mirrors, and light reflectors such as cat’s eye reflector, luminous sticker or luminous paint shall be installed or painted as the case may be. All Motorcab shall be equipped with a silencer or muffler and speed meter. The Traffic Division of the Police Station shall regulate the motor engine of Motorcab, such that these motor cabs shall not run more than forty (40) kms. per hour. Section 6. DUTIES OF OWNER a. It shall be the duty and responsibility of the Motorcab and Pedicab owners or operators having direct supervision or direct control or management of the vehicle that the driver of their respective vehicles shall be licensed.b. The vehicle owner's operator's name and respective address, licensed to operate within the Municipality of Kananga shall be painted inside of the vehicle in letters so as to be visible to passengers at al times. Section 7. NUMBERS OF PASENGERS No person operating a vehicle under this Ordinance shall load his vehicle beyond the sitting capacity provided in Art. XIII Section 17. Section 8. LOAD OR CARGO ALLOWED No person operating a vehicle for hire shall load his vehicle with more than One Hundred Fifty kilograms (150kgs) of freight in his vehide. Section 9. SUSPENSION AND REVOCATION OF OWNER’S LICENSE Any license issued to an owner or operator for Motorcab and Pedicab under the provision of this Ordinance may be suspended or revoked by the Mayor or his duly authorized representative for violation of any of the provisions contained of this Ordinance. Section 10, DEFINITION OF MOTORCAB AND PEDICAB DRIVER Any person who shall drive a Motorcab for compensation shall be deemed a professional driver and such, he shall first secure the license requires under this code refers to : Land Transportation Office (LTO). Any Person whe shall drive a Motorcab which is not for hire shall be considered a non-professional driver and shall also be requires to pay the driver's licensed required by the LTO. Section 11. DEFINITION OF PEDICAB DRIVER Any person who shall drive a Pedi cab for compensation shall first secure a Mayor's Permit to drive and must be at least 18 years of age, and which permit is renewable every year on or before the 20" of January each and a surcharge of Ten Percent (10 %) of the permit fee shall be imposed for late registration. Any other person who drives a Pedi cab which is not for hire shall also secure a Mayor’s Permit to Idrive and must be at least Eighteen (18) years of age which permit renewable every 'year on or before the 20" of February each year and surcharge of Ten Percent (10 %) shall be imposed for the late registration. Before a Mayor’s Permit to drive shall be issued to a cabby, he must first undergo a seminar on traffic rules, laws, and regulation and road courtesy to be conducted by the local police authorities. Section 12, CLEARANCE AND HEALTH CERTIFICATE No motorcab or Pedicab driver shall be allowed to operate in the Municipality of Kananga unless he first secures and Police Clearance from the Police Department in addition to the medical or Health Certificate issued by the Municipal Head Officer that he is healthy or able bodied to operate the same, Section 13. DUTIES OF MOTORCAB DRIVER The driver of motorcab shall be neatly dressed and shall wear at all times while performing his work as a motorcab driver and shall have an I.D. which shall be pinned « on the left side of his shirt. He shall be familiar with the names and locations of streets and other places in the town. He shall be familiar with the names and locations of streets and other places in the town, He shall provide himself with a hat while engaged in his occupation, or raincoat during rainy days; he shall not smoke while his vehicle is occupied or in motion and shall have in his possession his license to drive with appropriate restriction code to drive a motorcab, schedule rates and Xerox copy of the Registration Certificate of the said vehicle. He shall also attend one seminar per year on pigeonsTraffic Laws Rules and Regulations and Traffic Safety which will be conducted by the ‘Traffic Division, Kananga PNP Station, He shall further, be made to undergo a Traffic Seminar if he is apprehended for violating the provisions of this Ordinance before he can pay the corresponding fines and take possession of his driver's license. ‘The attachment or installation of any musical device or any device which produces loud and startling sound is prohibited. Section 14, DUTIES OF PEDICAB DRIVERS The driver of a Pedicab shall be neatly dressed, physically fit and shall pin his Permit of Drive 1.D. on the left side of his shirt. He shall be familiar with the names and location of streets and other places in the town. He shall provide himself with a hat while engaged in his occupation or rain coat during rainy days. He shall not smoke while his Pedi cab is occupied or in motion. He shall avoid blowing his horn except in cases of emergency. He shall undergo a seminar on Traffic Rules, Laws and Regulations and Road Courtesy per year which shall be conducted by the Traffic Division, Kananga PNP Station. He shall further be made to undergo a Traffic Seminar if he is apprehended for violating the provisions of this Ordinance. Section 15. CHARGING HIGHER RATE AND REFUSAL TO EXHIBIT DRIVER'S LICENSE AND PERMIT TO DRIVE / It shall be unlawful to driver of Motorcab and Pedicab to charge more than the rate specified by the MTO under Ordinance (Tax Code of the Municipality). It shall also be unlawful for him to refuse to exhibit his driver's license and/or permit to drive to any Police Officer when required to do so, either upon violation of any provision of this Ordinance or any Traffic Laws and Regulations now in force and those which may be promulgated in the Municipality of Kananga. Section 16. BAGGAGE OF PASSENGERS Every Motorcab, or Pedicab driver shall transport without extra charge, reasonable amount of baggage of the passenger not exceeding Twenty Five (25) Pounds provided the total weight of passengers and baggage's shall not exceed 150 kg. and he shall assist in loading and unloading said baggage’s. Section 17. REFUSAL TO CONVEY PASSENGERS It shall be unlawful for the driver to refuse passengers, or load merchandise, baggage or materials, or having undertaken to convey the same but neglects to do so, provided however that the driver of the Motorcab and Pedi cab shall be allowed the time between 12:30 to 1:30 p.m. and 7:00 to 8:00 p.m. in which to eat and rest, and such vehicles returning to the garage shall not be subject for hire during the same period. \) Section 18. PARCELS LEFT IN MOTORCAB AND PEDICAB Parcels or baggage of any kind left in a Motorcab, and Pedicab or in the custody of the driver thereof, shall be delivered under receipt to the nearest Police Station within Six (6) hours after discovery, unless sooner delivered to the owner of such baggage. Section 19. REVOCATION OR OPERATOR'S LICENSE ‘Any Operator's License or Business Permit issued under the provisions of this Code many be revoked by the Mayor or his duly authorized representative whenever the holder of said license or business permit shall have been convicted by final judgment of any of the following offences; 1. Gross immoral conduct such as soliciting or acting as agent for women of ill — repute;2, When convicted of murder or homicide, theft or robbery, abuse of chastity or any act of lasciviousness, coercion or threats, in which event, he shall be barred permanently from applying for an Operator's License or Business Permit. Section 20. RECORDS The Municipal Mayor of his duly authorized representative shall have a record of the name, signatures, addresses and numbers of license issued to Motorcab, and Pedicab drivers, and the dates of issuance and expiration of every license (except for Pedi cabs drivers which renewed their permit to drive every 20" of January every year) notify in writing the Mayor or his duly authorized representative within fifteen (15) days of any change of their address. The Mayor or his duly authorized representative, or the Chief of Police shall likewise keep a record of the names and address of the owners or operators of Motorcabs, and Pedicabs whether for private use or for hire in the Municipality of Kenanga, and the number of Motorcabs and Pedicabs owned by each, together with their corresponding license number and police numbers. Section 21. REGULATIONS ‘The Chief of Police and the Municipal Treasurer with the approval of the Mayor and the Municipal Council are hereby authorized to issue supplemental rules and regulations necessary to carry out the provisions of this Code, PROVIDED, that the Chief of Police with the approval of the Mayor and the Sangguniang Bayan shall be vested with power and duty to fix the route to which the Motor cab and Pedi cab shall be allowed to operate. ARTICLE XIX ALLOCATION OF TWENTY PERCENT (20 %) OF REVENUE FINES TO THE KANANGA POLICE DEPARTMENT'S TRAFFIC DIVISION Section 1. Twenty percent (20 %) of all revenues/ fines collected by virtue hereof shall be allocated to the Traffic Division of the Kananga Police Department for the purpose of paying the cost in the maintenance of Traffic Signs, Pedestrian Lanes, and Gasoline assigned to the Traffic Division for the enforcement of this Code and for other related for vehicle purposes, which amount the Municipal Treasurer shall hold in trust. ARTICLE XXI Miscellaneous Traffic Rules Section 01, Reckless Driving, No person shall operate a motor vehicle on any highway recklessly or without reasonable caution considering the width, traffic, grades, crossing, curvatures, visibility and other conditions of the highway and the conditions of esathe atmosphere and weather, or so to endanger the property or the safety or rights of any person or $0 as to cause excessive or unreasonable speeding in the highway. Section 02. Right of Way for Police and other Emergency Vehicles. Upon the approach of any police or fore department vehicles, or of an ambulance giving audible signal, the driver of every vehicle shall immediately drive the same to a position as near as possible and parallel to the right - hand edge of the highway, clear of any intersection of highways, and shall stop and remain in such position unless directed by a peace officer, or until such vehicle shall have passed. Section 03. itching to a Vehicle. No person shall hand on to, or ride on, the outside rear of any vehicle, and no person on a bicycle, roller skate or other similar device, shall hold fast to or hitch on to any moving vehicle, and no driver shall knowingly permit any person to hang on, to ride on, the outside or rear end of his vehicle or allow any person on a bicycle, roller skate or other similar device to hold fast or hitch to his vehicle. Section 04, Driving or Parking on Sidewalk. No person shall be allowed to rive the vehicle along the sidewalk or to park thereon. Parking should be made on the designated areas. Section 05, Driving While Under the Influence of Liquor or Narcotic Drugs. No person shall drive a motor vehicle while under the influence of liquor or narcotic drug. Section 06, Duty of Driver in Case of Accident. In the event that any accident should occur as a result of the operation of a motor vehicle upon a highway, the driver of that vehicle shall stop immediately, and, if requested by any person shall present, show his driver's license, give his true name and address and also the true name and address of the owner of the motor vehicle, No driver of a motor vehicle concerned in a vehicular accident shall leave the scene of the accident without aiding the victim, except under any of the following circumstances: 1 If he is in imminent danger of being seriously harmed by any person or by reason of the accident; If he reports the accident to the nearest officer of the law; or If he summon a physician or nurse to aid the victim. CHAPTER III Miscellaneous of Road Provisions ARTICLE XXII } Section 01. Exemption. During the Yuletide Season , town fiesta , or on the \decasion of a trade fair , the Mayor may grant a permit for the temporary use of public roads , alleys, and lanes for hawkers and peddlers provided that such permit shall not exceed fifteen (15) days. Section 02. Rules and Regulations. q No permit shall be granted by the Mayor for hawkers and peddlers to sell any article of commerce on any public road, alley or lane,. or portion thereof, except as provided in this Article The permit to be issued during the Yuletide Season, town fiesta or on the occasion of holding trade feir ( agricultural, commercial or industrial), is ‘subject to the following conditions or requirements.3. The hawking or peddling activity shall not impair or damage any private or public property, cause injury to or adversely affect the right of the person; 4. The hawking or peddling activity shall not obstruct, or cause obstruction to the ordinary flow of traffic; 5. The rules and Regulations on public safety, peace and order, zoning, health and sanitation, environmental management and other requirements under existing ordinances shall be complied with; 6. Such other requisites as may hereafter be prescribed by the authorities concerned. ARTICLE XXIII Final Provisions Section 1. Miscellaneous - Notwithstanding the provision of this Ordinance, other existing Ordinances and laws to the contrary, the Municipal Mayor is hereby given full power and authority to issue Executive Orders and rules and regulations appertaining hereto, with the end in view of making this Ordinance truly reflective of the ideals of good governance, especially in regulating the use and enjoyment of the Municipal Streets. Section 2. Separability Clause — If for any reason, any section or provision of this Ordinance is declared illegal or unconstitutional, other section or provisions hereof which are not affected thereby shall continue to be in full force and effect. Section 3. Repealing Clause — All previous issuances, ordinances, rules and regulations, provisions or parts thereof, which are inconsistent or in conflict with the provisions of this Code are hereby repealed or modified accordingly. Section 4. Effectivity — This Ordinance shall take effect upon the approval of the Sangguniang Panlalawigan Province of Leyte. CARRIED UNANIMOUSLY.
