(Order dated 28 December 2018)

Both ACCUSED, by and through the undersigned counsel, to


this Honorable Court most respectfully alleges that:

1. On 27 October 2017, both ACCUSED filed a Demurrer to


Evidence after an oral motion to file the same has been granted in
open court considering that the Prosecution has already rested its
case on 19 October 2017;

2. The Honorable City Prosecutor Dencio G. Somera Jr. was


furnished a copy of said Demurrer to Evidence via private courier
(LBC). Upon verification with the latter’s online tracking system, a
transaction report was generated indicating the actual receipt by the
authorized representative of the City Prosecutor’s Office and which
report is hereto attached as Annex “A” hereof;

3. The undersigned made further verification with the Office


of the City Prosecutor’s of Caloocan City and it was confirmed that
Ms. AMY CRUZ, which name appeared as the authorized
representative in the online tracking system, is an employee of the
OCP Caloocan City assigned at the Receiving Section thereof.
