CONTRACT AGREEMENT
This CONTRACT AGREEMENT made on the _23 rd day of _October__2015
between:
The DEPARTMENT OF HEALTH - CHD for Eastern Visayas with postal address at
Government Center Palo, Leyte, Philippines, duly represented in this act by
CARL O. PARTUZA, Director IV, hereinafter referred to as the “PROCURING
ENTITY”
KEMPEE L. PETRONIO
And
Proprietor
ESPG BULIDERS, a company incorporated under the laws of the Philippines,
with postal address Brgy. 77 Apitong, Rodrigo Duterte Ave., Tacloban, City
represented by Kempee L. Petronio, hereinafter called The Contractor.
WHEREAS, the Procuring Entity is desirous that the contractor executes the
upgrading of PNP8 Infirmary Hospital (Camp Kangleon) under IB No. 2011-10 ,
conducted on September 26,2011, as per BAC Resolution No. 2011-45,
hereinafter called The Works and the Procuring Entity has accepted the price
proposal amounting to Three Million Pesos by the Contractor for the execution
and completion of such works and the remedying of any defect therein.
NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

1. In this agreement, words and expressions shall have the same meanings
as are respectively assigned to them in the Conditions of Contract
hereinafter referred to.
2. The following documents shall be attached, deemed to form and be read
and construedas part to this agreement, to wit:
a. General and Specific conditions of the contract;
b. Drawings/plans;
c. Specifiations
d. Invitation to bid
e. Bid Form(Duly signed bid prices in the Bill of Quantities, Detailed Estimates
and Cash Flow by Quarter and Payments);
f. Eligibility Requirements, Documents, and/or Statements;
g. Performance Security;
h. Cash Deposit Certificate issued by a licensed bank;
i. Notice of Award of Contract and winning bidder`s “Conforme” thereto
3. In consideration of the payments to be made by the Procuring Entity to the
Contractor as hereinafter mentioned, the Contractor hereby covenants with
the Procuring Entity to execute and complete the Works and remedy any
defects therein in conformity with the provisions of the Contract all respect.
4. The Procuring Entity hereby covenants to pay the Contractor consideration
of the execution and completion of the Works and remedying of defects
wherein, the contract price or such other sum as may become payable
under the provisions of this contract at the time and in the manner
prescribed in the contract.

Upon receipt of this notice you are responsible for performing the services under
the terms and conditions of the Agreement and in accordancewith the implementing
schedule or within One Hundred Fifty calendar (150) days from receipt of this notice.
Please acknowledge receipt and acceptance of this notice by signing both copies
in the space provided below. Keep one (1) copy and return to us the other copy.
