DIFFERENT TYPES OF VISA

1. H1B

H1 B Visa
• The H-1B is a non-immigrant visa in the United States under the Immigration and Nationality Act, section.

• It allows U.S. employers to temporarily employ foreign workers in specialty occupations.

• Initial approval is for 3 years, which can be extended for increment of up to 3 years, Total stay is limited to 6 years.
• Any time spent outside of the country does not count, even if the person leaves and reenters the U.S. with an H-1B visa.

• An exception to maximum length of stay applies in certain circumstances

OPT - Optional Practical Training


• Is a period during which undergraduate and graduate students with F-1 status who have completed or have been pursuing their
degrees for more than nine months are permitted by the United States Citizenship and Immigration Services to work for at most
one year on a student visa towards getting .
• Standard OPT is available for a cumulative maximum of 12 months per educational level.

• A one-time extension of 17 months (for a total of 29 months) is available to certain STEM degree recipients.

EAD - employment authorization document


• An employment authorization document (EAD, Form I-766), EAD card, known popularly as a "work permit", is a document issued
by United States Citizenship and Immigration Services (USCIS) that provides its holder a legal right to work in the US.
• It is valid for 2 years
Green Card
• A green card is issued to all permanent residents as proof that they are authorized to live and work in the United States.
• If you are a permanent resident age 18 or older, you are required to have a valid green card in your possession at all
times.
• Current green cards are valid for 10 years, or 2 years in the case of a conditional resident, and must be renewed before
the card expires.

• A green card is an official ID card for a lawful permanent resident of the United States. It serves as proof that its holder is
an immigrant who has been authorized to live and work in the US permanently.

• Issued by the United States Citizenship and Immigration Services (USCIS), a green card contains its holder's name, date of
birth, sex, alien number (A#), country of birth, card issue date, card expiration date, fingerprint, special codes, and anti-
counterfeiting features.

• A green card is valid for 10 years from the date it was issued.

• A conditional green card, based on marriage or investment, is valid for 2 years but can be converted to a regular green
card if the condition is later removed.

TN – Trans National Visa


• The TN visa was created under the North American Free Trade Agreement between Canada, U.S. and Mexico.

• Under this visa, a Canadian citizen may work in a professional occupation in the U.S

• Both Canadian and Mexican citizens can be admitted to the United States in TN status in increments of up to 3 years.

• Extensions of stay may also be granted in increments of up to 3 years.

• The applicant must be a citizen of Canada or Mexico;

Political Division and Time Zones
• US is divided politically into following zones
• East, West, North, South, Mid-East and Mid West.
• Due to its huge land area, US is divided into given time zones

1. EST  Eastern Standard Time.


2. CST  Central Standard Time.
3. MST  Mountain Standard Time.
4. PST  Pacific Standard Time.

• In terms of time difference, EST is 1 hour ahead of CST, 2 hours ahead of MST and
3 hours ahead of PST.
• For example New York (EST) will be 1 hour ahead of Chicago,IL (CST), 2 hours
ahead of Arizona(MST) and 3 hours ahead of California (PST).
Payment / Tax Terms
There are three tax terms which are prescribed in US Recruitment.
1. W2
2. 1099
3. C2C (Corp to Corp).

W2
When a person is paid in form of W2, the employer automatically withholds a part of his pay and pays all the
necessary taxes on his own as per the required norms of Federal Government.
These Taxes include Federal Income Tax, State Income Tax, Social Security and Medicare Tax.
• It is further classified in two parts
• W2 Salaried
• W2 Hourly

W2 Hourly
In this, the employer pays the on an hourly basis.
This means that the candidate will be billed for full 880 hours (8 hours a day * 5 days a week * 22 days a
month). There are no benefits or minimal benefits provided with this type of payroll.
The candidate is eligible for overtime.
1099
• When a person is paid in 1099 payrolls, all money earned by the candidate is paid on an untaxed basis.
• Our company will not responsible for any state and federal taxes.
• It is then the responsibility of the candidate to file and pay the appropriate taxes.

Corp to Corp or Corporation to Corporation.


• This is a payment term which is applicable for H1B Consultants.
• In this pay term the Employer Company has to take care of the Taxes and the accommodation of the
consultant.
