c. Termination Procedure for Remaining 2012 Round Applications that were not Successful

Resolved (2025.09.14.05), the Board directs the ICANN President and CEO, or his designee(s), to implement the following termination procedure for remaining applications from the 2012 round of the New gTLD Program that were not successful:

Except for applications impacted/involved in ongoing independent review process (IRP) proceedings, an applicant for a remaining application with the following statuses will be sent a final notice with its application status: "Will Not Proceed", "Not Approved" and "Applicant Support (Not Approved)."

The notice will provide the applicant a final opportunity to withdraw its application from the Program within 90 days of the applicant's receipt of the notice to be eligible for a refund according to the Applicant Guidebook Refund Schedule or relevant Board resolution establishing the refund.

If withdrawal is not completed and a valid refund request has not been provided within that 90-day timeframe, the applicant will be considered to have forfeited any eligibility to receive a refund associated with the relevant application.

If the applicant has not withdrawn their application within the 90-day timeframe, ICANN will move the application to withdrawn status.

Resolved (2025.09.14.06), the Board confirms that should any of the applications that are currently impacted/involved in ongoing IRPs no longer be impacted, the same termination procedure will apply for those applications.
