Terms of Service

Welcome to Shaders. These Terms of Service ("Terms") govern your access to and use of the Shaders platform, including our website (shaders.com), design editor, component libraries, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breach.

You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian.

2. Plans, Purchases and Payment

Free Tier: Free accounts can use Shaders for personal projects, prototypes, and evaluation purposes, including access to the design editor, basic presets, and the npm package. Commercial or production use requires an active Pro or Team subscription, or a Single Item License covering the specific collection or section used. Collections and sections we designate as "free" may be used commercially with a free account, as described in the License Agreement.

Pro Tier: We offer recurring and lifetime Pro subscriptions. Pro subscriptions provide access to features available at the time of purchase, including the design editor, code and video export, premium presets and sections, priority support, and Discord community access. New features added after your subscription purchase may require separate payment or an upgraded plan.

One-Time Purchases (Single Collection / Single Section): Individual collections and sections may be purchased outright for a one-time fee, without a subscription. These are digital goods delivered immediately upon successful payment. Access is granted to the purchasing browser and/or account, and is governed by the Single Item License in our License Agreement. Purchases can be made before creating an account; you are responsible for claiming a guest purchase by using the claim link emailed to you or by creating an account, so that it can be permanently associated with you. We may remove items from the public catalog at any time, but purchasers retain access to items they have already purchased.

All payments are processed securely through Polar, our merchant of record. By providing payment information, you authorize us to charge the applicable fees to your payment method. Prices are subject to change with notice for new purchases.

Pricing and Discounts: We reserve the right to offer promotional pricing, discounts, and special offers at our sole discretion. Prices paid at the time of purchase are final. If you purchase a subscription or item at one price or discount level, and we subsequently offer a different price, promotion, or discount, you are not entitled to a refund, credit, or price adjustment to match the new pricing. All sales are final at the price agreed upon at checkout, regardless of future pricing changes or promotional offers.

Refunds: Subscription fees are generally non-refundable except as required by law or at our sole discretion. For recurring subscriptions, you may cancel at any time and your access will continue until the end of your current billing period. One-time purchases of individual collections and sections are non-refundable — all sales are final (they are digital goods delivered immediately upon payment), except as required by law or at our sole discretion. If a one-time purchase is refunded (whether required by law, granted at our discretion, or resulting from a chargeback), the associated Single Item License and access to that item are revoked.

Automatic Renewal: Recurring subscriptions automatically renew unless canceled before the renewal date. Lifetime subscriptions and one-time item purchases do not renew.

3. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Use the Service or deploy Shaders components on websites or applications containing adult content, pornography, or sexually explicit material
  • Use the Service for illegal activities, promotion of violence, hate speech, or harassment
  • Infringe on intellectual property rights of Shader Effects or third parties
  • Attempt to reverse engineer, decompile, or access the source code of the Service
  • Use the Service to distribute malware, spam, or harmful content
  • Interfere with or disrupt the Service or servers
  • Create accounts through automated means or using false information
  • Share your account credentials with others
  • Use the Service in a manner that competes with Shader Effects' business

We reserve the right to suspend or terminate accounts that violate these Terms without notice or refund.

4. User-Uploaded Content

The design editor allows you to upload images, videos, and other media assets for use in your shader effects. You are solely responsible for all content you upload and must ensure you have the necessary rights and permissions to use such content.

You may not upload content that:

  • Infringes on copyrights, trademarks, or other intellectual property rights
  • Contains nudity, pornography, or sexually explicit material
  • Depicts violence, gore, or disturbing content
  • Promotes illegal activities or violates any laws
  • Contains hate speech, harassment, or discriminatory content
  • Contains malware, viruses, or malicious code
  • Violates the privacy or publicity rights of others

We reserve the right to remove any uploaded content that violates these Terms or that we determine, in our sole discretion, to be inappropriate or harmful.

Liability Disclaimer: Shader Effects is not responsible for user-uploaded content and assumes no liability for any content uploaded by users. You agree to indemnify and hold us harmless from any claims arising from your uploaded content.

5. Intellectual Property

The Service, including all software, design assets, presets, components, documentation, and trademarks, is owned by Shader Effects, Inc. and protected by copyright, trademark, and other intellectual property laws.

Your subscription, Single Item License, or free-account access grants you a limited, non-exclusive, non-transferable license to use the Service according to your plan or purchase and in compliance with our License Agreement.

Your Content: You retain ownership of any content you create using the Service. However, effects created using our presets are subject to the restrictions outlined in our License Agreement.

By using the Service, you grant us a limited license to host, store, and process your content solely to provide and improve the Service.

Data and Content Retention: You are solely responsible for maintaining your own backups of shaders, projects, and any media you upload to the Service. We do not guarantee against loss of shaders, projects, or uploaded media resulting from account deletion, subscription downgrade or cancellation, technical failure, or any other cause, and we are not liable for any such loss.

6. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

7. Third-Party Services

The Service integrates with third-party services for authentication, payment processing, analytics, and other functionality. Your use of these services is subject to their respective terms and privacy policies.

We are not responsible for the practices, availability, or content of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

We do not warrant that the Service will meet your requirements, be error-free, secure, or continuously available. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHADER EFFECTS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Shader Effects, Inc. and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of third parties.

11. Termination

You may request account deletion at any time by contacting us at legal@shaders.com. Upon termination, your access to Pro features will cease, though previously exported code remains licensed per our License Agreement.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We are not obligated to provide refunds upon termination for cause.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware and, where applicable, the State of Florida, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware or Florida, and you consent to the jurisdiction and venue of those courts.

Arbitration: For disputes involving less than $10,000, you agree to resolve the dispute through binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt out within 30 days of account creation by emailing legal@shaders.com.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription for a prorated refund of any prepaid fees.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and License Agreement, constitute the entire agreement between you and Shader Effects regarding the Service and supersede all prior agreements and understandings.
