Samy lashed out loud

Samy Vellu labelled Utusan Malaysia as a 'racist' publication which went against the 1Malaysia concept espoused by Prime Minister Najib Abdul Razak.

"I don't know how much of Umno's intervention is involved. But it is usual for Utusan to act like the big brother and hit everyone flat and they feel happy about it...," said Samy Vellu.

"I don't know if this Umno leadership would stoop down to this level (of masterminding such a report)... in any case, whatever Utusan has done is not going to disturb us," he added.

Samy Vellu stressed that MIC members and the Indian community do not believe the news that appear in the daily.

"I give you an example, the cow-head incident, we all condemned the demonstration thinking that it will bring about racial misunderstanding and brew trouble in the country

"But that news, they don't carry. They carry news in support of the cow-head demonstration, they are determined to do something that is detrimental to others rather than what is true," he said.

"Secondly, as and when you give them some news, the news must be to their taste and not the truth, then only they will publish.

"Nowadays, I don't call their reporters anymore because we feel it is sort of a very racial paper which does not contribute to national interests," he added.

Samy Vellu also lashed out at Mahathir. He said it was Mahathir who excelled in the art of 'destroying deputies'.

Samy Vellu said while he had one deputy for 25 years, Mahathir had four during his 22-year tenure.

"Who really destroyed the deputies? He is a master in destroying his deputies. I don't destroy any deputies," he stressed.

Samy Vellu was also asked to comment on whether a MIC leader who came into power riding on the support of Umno would be subservient to that party and not be effective in defending the Indian community.

Training his guns on Subramaniam, the president said: "He is already subservient to Mahathir, I don't know to what extent he is subservient to Umno... he needs somebody to push him forward. He can't stand on his own legs."

"Is this the type of leadership that the Indian community needs... a community that is suffering from poverty and just attempting to come up... it needs a leader who can talk and bring about change," he added.

The longitudinal cracks are not a negligible problem of torsion during construction.

The lack of transverse reinforcement is a safety risk for the final stage.

The calculated safety factor is far below 1.0.

Internal redistributions of forces and alternative load paths due to yielding of the reinforcement, intensively cracking and plastification of compression zones of the concrete prevented a collapse so far.

The structure is not stable.

Emergency and safety measures should urgently be undertaken. deformation measurement and installation of strain gages at transverse reinforcement is recommended.

Please inform your client about our serious concerns.

The above is the letter from the German Consultant to our Malaysian authority.

Did you all know how serious it was at that time in 2004? This letter was written to our govt in August 2004.

The Government did not treat it as a matter of crisis. It took the govt until February 2006 to decide to take action. They didn't care about preventing the possibility of catastrophic failure as reported by Dr Robert L. Vollum of Halcrow. They don't care about thousands of people that will be dead of this catastrophic failure occurs.

Only after Dr Wahid was appointed as the Director-General of PWD did he pushed for the repair and remedial work to be completed within 3 months.

The group of JKR engineers together with the workers worked 24 hours each day for more than 90 days. They work in 2 shifts - 12 hours each shift to meet the target set by PWD.

They did complete the repair works, all within 3 months. Samy Vellu was surprised how they managed to do it. But he never said a word of appreciation until today.

These pictures were taken at 3am in the middle of the night.

Each night the German senior engineer from Leonhardt, Andra & Partner (LAP) together with the JKR senior management and JKR engineers would meet at the project site to discuss the works schedule, the details and the problems encountered. More than 90 litres of grout was pump into the concrete beams to grout the understrength porous concrete.

Where were you at 3am? Were was Samy at 3am? You may be surprised that the D-G of JKR was there most of the nights (i.e. early hours of the morning around 3am) with the workers at MRR2 site.

These are the people who work 24 hours a day for 90 days to repair the MRR2. They completed the works in 90 days.

What were the recognition for these people?

Why was the govt not thankful and appreciative of their commitment, contribution and sacrifices.

They were living for 3 months without spending time with their family members. They had to abandoned their wife, children and parents so as to ensure that the MRR2 repair works are completed within the 3 months.

And at the end, there was not even a word of thanks from the Works Minister Samy Vellu nor from the Prime Minister and Deputy Prime Minister. Today, all of them lives in obscurity after serving the nation.

The PM and DPM showed tremendous concerned for Saiful; but they didn't even cared for the a group of people who had sacrificed for the nation - these were the heroes who work hard to prevent a catastrophe from occurring.







Note:

The flyover is safe. Only Pier 28 has some problem with the plastic straps which are used to encased the grouts used to seal the pre-stressed wire-ropes which provides the necessary reinforcements to strengthen the crossbeams which had failed. The repair for the defective works are in progress and the consulting engineers from LAP have inspected the defects and recommended the necessary repair.

Incidentally, Pier 28 was the first Pier that was repaired in 2006. As such, there may had been some initial problem due to the learning process as the repair contractor is not experienced in this methodology of structural strengthening works. Immediately after observing the contractor's weakness, JKR utilized a team of senior engineers to closely monitor the quality of works and ensured that the remaining works meets the strict specified requirements.

Sunday News: Of Virgin, Sakthi & Bowing Windfall

Paris: In 2006, an Engineer in his 30s, named as Mr X, married Ms Y, a student nurse in her 20s.

The wedding night party was still under way at the family's home when the groom came down from the bedroom complaining that his bride was not a virgin. He could not display the blood-stained sheet that is traditionally exhibited as proof of the bride's 'purity'.

Mr X went to court the following morning and was granted an annulment on the grounds that his bride had deceived him on "one of the essential elements" of the marriage.

The annulment served to send young Muslim girls running to hospitals to have their hymens restored. The operation is in increasing demand from Muslim women who fear the consequences of being unable to prove their virginity.

Datuk Seri Samy Vellu declared that MIC might have lost seats in the elections but not its Sakthi (power). Samy said this in his speech at the Selangor MIC annual general meeting yesterday.

"Are we dead because we lost the seats? We have only lost this once. Only we can speak on behalf of Indian community," Samy declared.

"Today, the young people are scolding us, asking what MIC has done. You cannot sit in your bedroom and scold us all the time. Get out of your bedroom and see our work," Samy challenged the Indians.

He then turned to Dr Subramaniam, who was talking to vice-president Datuk S. Veerasingham, and said: "Subramaniam listen. Veerasingham, don't talk to him. Always talking stories."

Selangor MIC Youth chief P.Subramaniam in his speech at the AGM said Dr Mohd Khir Toyo's decision to award brooms to civil servants had led to many voters voting the opposition. He also claimed that Khir Toyo was the reason for MIC's failure in the state.

Prime minister Abdullah brought cheer to the politicians of Sabah yesterday, instituting measures to tackle long-standing issues and pouring in more money to develop the state.

Abdullah also announced the formation of a high-powered committee headed by Najib to deal with the problem of illegal immigrants.

He also announced the immediate abolishment of the Federal Development Department (FDD) in Sabah and its functions to be handled by the state.

Abdullah pledged an additional RM1 billion for development.

The state had been allocated RM18.4 billion for development under the Ninth Malaysia Plan.

He told a press conference after a meeting with state leaders that Najib was the right person to head the committee on illegal immigrants.

Pandithan dies

Indian Progressive Front (IPF) president MG Pandithan passed away this morning after a protracted bout with leukemia.

In a statement today, Samy Vellu said he is deeply sad over Pandithan’s demise.

"We are shocked by his death and wish to extend our condolences to his family. Pandithan was a great leader who had the people in his heart.

"He worked tirelessly for the Indian community and had achieved many successes. He is looked upon as a people’s leader with the qualities of a statesman," he added.

The MIC president said Pandithan will be remembered for his sacrifices and deeds as a leader of the people.

"I will miss him a lot because he’s not only a leader of a mass-based party, but he was also my friend," he added.

Khir toyoed Samy; Samy koyoed Thir

Ex-Selangor MB Dr Mohd Khir Toyo today exposes Samy Vellu and claimed that Samy was the chief culprit behind the controversial demolition of the Kampung Rimba Jaya Hindu temple near Shah Alam - he now claims that MIC president S Samy Vellu had instructed him to do so.

“Samy Vellu called me on the night of Nov 15 and told me that Hindraf (Hindu Rights Action Force) people had infiltrated the temple and that it must be demolished that night itself,” alleged Khir.

Now that he is no longer MB Khir Toyo is more daring to expose all the misdeed and wrongs of his fellow colleagues rather than taking the full blame himself.

We should hear more of many other hidden agendas and actions from a new Maverick.

However, Samy Vellu refuted Khir Toyo's claim. Samy Vellu also pointed out that during the demolition exercise, enforcement officers had only targeted the temple and not the houses.

"This showed their hatred for the temple," he stressed.

The MIC president also disclosed that he telephoned Khir several times and politely asked him not to demolish the temple since it was Deepavali time.

"But he kept saying that a court order had been obtained. So I thought this man is not going to listen.

Asked why the former menteri besar was so adamant in wanting to demolish the temple, Samy Vellu said that Khir "wanted to prove a point."

He said when Abdullah had asked Khir about the matter, the latter once again cited the court order as an excuse.

"I am surprised by his statement. How can I tell him to demolish a temple which was already demolished?" Samy asked.

"It was under his order that more than 500 enforcement personnel from the local authorities from various districts came to demolish just one temple.

"If all local authorities were to send enforcement officers to Shah Alam, who could have given such a directive except him," Samy said.

"I told him 'You are not only destroying your political career, you will also destroy my political career if you continue with the demolition'.

"He just said 'no, no such thing'."

MIC demand Hindrafs' release

The MIC has demanded the government to explain how the five leaders of the Hindu Rights Action Force detained under the ISA had pose a threat to the nation’s security.

MIC Youth chief S.A. Vigneswaran said the five should be released immediately if the authorities could not come up with any justifiable answer.

"If their detention is simply because of their involvement in street demonstrations, the government should release them immediately.

Otherwise, why is it that Umno organized demonstrations and demonstrators are not detained under ISA?

Vigneswaran said MIC's call for the release of the five did not mean the MIC condoned street demonstrations.

He explained that the MIC initially supported action against the Hindraf group. However, he said the Indian community went against the MIC and also the BN.

So MIC had no choice but to do what it must do now to stay relevant to the Indians.

Samy feels dejected; he saw it coming!

MIC president S Samy Vellu feels 'dejected' that MIC has been given the Human Resources Ministry instead of the Works Ministry.

Below is an abstract of an interview with Malaysiakini at the MIC headquarters in Kuala Lumpur yesterday:


"I feel very dejected. Although I know it is the prerogative of the prime minister. Previous prime ministers, even (current prime minister) Abdullah Ahmad Badawi has always thought about party seniority ... for the ministry."

"I think it is the work of the 'backroom boys' ... I know, I am definitely sure, it is these 'backroom boys' at work.

"I was never against Hindraf at any time. Originally, they portrayed themselves as working for the community, I said, 'Okay, anybody can work for the community, it is better for the community'.

"But in any case, it is not Waythamoorthy's order which (motivated) the people to vote. People voted for their stomach and for their pocket. Because they need to earn, they need to have better lives. I don't think Hindraf could do anything for the betterment of the community, they are not a political party, they are a social organisation.

"But they can all the time create trouble, but I think there will be a time when this will also come to an end because the youngsters are now trying to realise 'why did we do this?' 'what did we gain?' 'who benefits out of this?'

"The dissatisfaction is there. It was across the board. And the people thought 'we cannot convince the Barisan Nasional government to do anything for us'. They thought that the Barisan Nasional government does not care for MIC no matter how much noise we make. So 'let us give the vote to somebody (else) and let them make the noise'. This is what happened."

"I have been continuously fighting and I foresaw that this was going to happen. Six months before the elections, I went to the prime minister and told him 'I have a short programme for the next three years. Can you give some money so that we can boost the morale of the party among the Indians.'

"First he said, 'I'll look into it', later he said, 'No', he cannot give. So thereafter I thought, 'What can we do?'"

"I know that after the elections, our party is in disarray. A leader who runs away when the party is in disarray is no leader," he said.

The former works minister also stressed that it is the duty of a leader to put the house in order and examine what had went wrong."

Indians Protest against Exco discrimination

An illegal gathering was held in Ipoh to protest the appointment of only one Indian state executive councillor. The gathering fizzled out after police closed roads leading to the Ipoh padang.

Policemen were sent to the scene to monitor the situation after getting wind of the gathering. The policemen left the area around noon after those who had gathered, dispersed.

Menteri Besar Mohammad Nizar Jamaluddin had on Saturday announced a 10-member exco line-up comprising six state assemblyman from the DAP, three from PKR and one from Pas.

Sungkai DAP state assemblyman A. Sivanesan is the sole Indian representative in the state executive council.

There are four other Indian state assemblymen, including three from the DAP and one from Parti Keadilan Rakyat.

Most likely, they were Indians from MIC. The Indians now felt they were the power-maker and had placed PAS-DAP-PKR in power and as such they deserved to have more representations in Exco seats and also at least an Indian deputy menteri besar or possibly a deputy prime minister.

MIC president S Samy Vellu today blasted the opposition over the lack of Indians in their state executive councils.

Responding to a question on multiracial politics, Samy said the newly formed state governments should have given the Indians two exco positions.

According to Samy Vellu, the sole Indian exco members in the four opposition-controlled states will not be able to provide effective representation for the community, especially with BN still controlling the federal government.

"Why only one? Why are they following just like Barisan Nasional (BN)? Is this what they promised before the elections, they have their own motives.

What about Pahang?

On why the Indians were not given an exco position in the BN-controlled state of Pahang, the MIC president replied: "I will not beg anymore... enough of begging for that and this."

"If the Pahang state government feels it is better off without an Indian in the exco, fine. We have said what we want and it is up to the state government," he added.

Samy Vellu also dismissed the suggestion that MIC is being marginalised in BN.

"The opposition tells lies to attract people, we tell the truth. In this last one month, I have learnt one thing, which is how to tell lies to attract voters.

Quizzed on how long he will remain in power, the 72-year-politician quipped: "Until I die. This is what people are saying, they want me to die earlier."

In his speech earlier, Samy Vellu urged the Prime Minister's Department to establish a special fund and mechanism for the economic growth and equity ownership of the Indian community.

"When I submitted a special request for the upliftment of Malaysian Indians to the prime minister, he advised us to work with the Economic Planning Unit and extract benefits from them.

"Therefore in the field of economic upliftment and equity enlargement, the federal government must assist the Indian community.

"May God give us the vision, the strength and the endurance to overcome contemporary political challenges," Samy said.

It was rumoured that MIC would sent a delegation to meet with Prime Minister Abdullah Ahmad Badawi to discuss the possibility of appointing a second deputy prime minister and they would prefer either Samy Vellu or even Subramainiam to be given the post to proof that there is no discrimination against the Indians. They would also prefer that PAS, DAP, PKR and possibly Umno, should also appoint an Indian deputy president within their party to protect the interests of the Indian community and ensured their success and prosperity in line with the principles as established in the NEP.

Meanwhile, the Dayak Chamber of Commerce and Industry has called for the NEP to be implemented to help the Dayaks effectively participate in business so that they can also be as prosperous as the Melanaus and Malays. Newly elected president Tan Sri Leo Moggie said the community needed more assistance than others to succeed in business. “As far as the Dayak community is concerned, they should be given opportunities,” Moggie said. “This was the spirit of the New Economic Policy,” he added.

On the Chinese side, the MCA is looking into how to maintain the Chinese primary schools to ensure that the Chinese Language is allowed to be taught in schools and also to ensure that lion dance tradition is continually permitted by Umno. MCA are more concern with how to win back those seats lost to DAP and they will spent more efforts and fire-spreading propaganda of the secret cooperation of DAP with PAS which is an Islamic party. They know that the Chinese feared the Islamic state concept and the Hudud law and by projecting DAP's cooperation with PAS it would suffice to instill fears and phobias. The MCA is happy with what they had in the cabinet and do not need any better positions as they had got all the 4-ministries - Local Govt Ministry, Health Ministry,Women, Family and Community Ministry and Transport Ministry; this is enough for them as they can cari makan already. The economics of the ordinary Chinese is okay as MCA knows fully well that the poor Chinese can sell pirated VCD, work for illegal 4-Ds operators and football betting syndicates, assist Ah Long to collect debts, get employment at brothels and mini casinos as it is less competitive sector of which the Muslims would not be clamoring for 30% stakes, massage parlours, and buy projects from Umno. As such, the Chinese don't need NEP or any form of handouts as they can buy the business opportunities from the Malays, cooperate with the police and the anti-narcotic agency. The worst case scenario is for Chinese men to sell drugs and women to work as prostitute which are lucrative ventures.

Samy begins talking Aloud

Samy calls for Hindraf 4's release

In a dramatic about-turn, MIC president S Samy Vellu today called for the release of the four Hindu Rights Action Force (Hindraf) leaders held without trial under the Internal Security Act (ISA).

"The government has to make a decision. Kenghadharan is very sick, Manoharan is an elected member. So I think it is quite reasonable. I am going to ask PM (to release them) and meet the Internal Security Minister (Syed Hamid Syed Albar).

He said Ganabatirau, and Vasantha Kumar were "not very much involved (in the rally), so the government has to make a decision."

If he (Abdullah) wants to release all (five) of them, it is up to him. We have no objection. We also don't want them to be kept inside for too long a period," he said.

The fifth Hindraf leader under detention is P. Uthayakumar.

He also urged Hindraf chairperson P Waythamoorthy - who is currently in London on self-exile - to return to the country and be reunited with his family, saying that the latter should not be a political refugee.

Describing it as being motivated by "fairness", he said: "At the same time, we feel that as Indians, we have to do something about this."

"I made some moves on this earlier, but I didn't tell anybody. I will now make a very strong move to see what can be done," he added.


MIC members join PAS

Meanwhile, The Kampung Jebong MIC branch in Simpang here was officially dissolved when 110 of its members quit the party to become members of "Kelab Penyokong PAS" (PAS Supporters Club).

Branch chairman M. Muninathan, accompanied by committee members, submitted their application forms to Bukit Gantang MP Roslan Shaharom at a village temple here on Saturday night.

Roslan said the welfare of the former MIC branch members and members of the Indian community would be taken care of.

"We will take care of you because any problems affecting the Indian community will also affect members of the other communities," he said.

Roslan said he was indebted to the Indian community here as more than 95% of Indian voters within the Bukit Gantang parliamentary constituency had voted for him in the recently-concluded general election.

Shahrizat made special adviser with minister status

Umno women's wing deputy chief Shahrizat Abdul Jalil has been appointed a special adviser to the prime minister with the status of minister on women and social development affairs.

According to Bernama, the Prime Minister’s Department said the appointment will be effective starting tomorrow.

At present, Prime Minister Abdullah Ahmad Badawi has two special advisers with the status of minister - for Islamic affairs and foreign affairs.

Meanwhile, a group of 50 Wanita Umno members went to the Abdullah's official residence in Putrajaya this evening in an attempt to see the prime minister to express their disappointment in their leader, Rafidah Aziz, being dropped from the cabinet.

The Wanita Umno group dispersed 10 minutes later when no one from the prime minister's residence came out to receive them. Rafidah may have a good chance to be named as adviser to PM too.

Meanwhile, we also hear rumours that MIC members will also be organizing a group of their leaders to see the prime minister to express their disappointment that their beloved president Datuk Seri Samy Vellu was not appointed as the special adviser to the prime minister with ministerial status. It is rumoured that the MIC wanted PM to appoint Samy to be the special adviser with half-ministerial status, in charge of JKR affairs and toll concessionaires so that he can continue to contribute to the nation and make JKR a better institution while at the same time protect the interests of the Indians whose votes are badly needed by the BN.

It seems that Samy has received a sudden epiphany from the divine who had revealed to him the essential wisdoms on how to turn JKR to be a world class institution and how to manage the toll concession agreements.

The MIC will ensure that Samy's appointment as special adviser with half-ministerial status should not affect the role of the new Works Minister Datuk Mohd Zin as Samy will only be empowered to deal with JKR's projects and toll Concession Agreements of which he is a super expert, while the new Works Minister will take care of Lembaga Lebuhraya Malaysia (LLM).

Samy's Indian dilemma

The time is not right for a single party system in Barisan Nasional as suggested by Gerakan, MIC president Datuk Seri S. Samy Vellu said here.

He was commenting on Perak Gerakan chief and national vice-president Datuk Chang Ko Youn’s call to all Barisan Nasional component parties to consider amending their constitutions to accept members from all races in line with the voting trend shifting away from racial politics. He said the results of the recent general election showed that the electorate did not vote according to the racial background of the candidates.

Chang said it was time for Barisan to study the composition of its coalition and the ideologies of the respective political parties.

Samy said in today’s political situation, such a move would dilute the rights of the Indian community.

Samy Vellu said a smaller community like the Indians have to fight for their rights and that could only be done through MIC.


Samy is not jobless now. He has accepted a temporary consultancy job at BOMAG at a JKR road project training pilots of road compactor machine.

PM Science adviser said if you fly in a rocket you are called an astronaut; so if you drive a compactor you can be identified and classified as a Pilot. And if you test the soil by touching it, then you can also accredit yourself as a Scientist.

Samy's dogmatic political ideology cannot change neither could he evolve with reality. He believed only him and his MIC (if he remain as MIC president) can protect the Indians and elevate their living standards.

More than 20 years as MIC president, he had proven that some Indians, (those few Indians who were his cadres) had become rich. Samy may also want to claim credit that Ananda Khrisnan is also an Indian who became rich during his tenure as MIC president.

This is prove that he had help the Indians, at least that few of them that are now rich, including Ananda, and that by itself is a good result because that's the best he can do.

To Samy, the Hindraf was unfair to him, and unfair to cause the Indians to dump him. The leaders of Hindraf were lawyers, which means they were successful because of MIC. By Samy's political philosophy, as long as there are a few Indians who had become lawyers and doctors, it was the result of MIC's effort and contribution.

But Samy is not blind to the more than a million poor Indians who were marginalized. Probably, he believed that they deserved to be what they are. He still believed that only him and MIC under his leadership is the sole protector of the Indians. He is senile... today we have an Indian deputy chief minister in Penang; we have an Indian Exco in Kedah state administration; we will be having an Indian deputy MB in Perak and an Indian Exco in Selangor. The Indians had received better recognition under the Barisan Rakyat conceptualized government. They would be well protected and taken care of by Barisan Rakyat, and they will never need MIC again.

Wake up Samy! Reality is not an illusion.

Oh, by the way, Samy, I didn't know that you have taken control over the toll booth?

Mahathir: Samy stifled Indian voices

The problems plaguing the Indian community could be resolved by removing MIC president S Samy Vellu who stifled Indian voices, said Dr Mahathir Mohamad yesterday.

Mahathir said removing the MIC leader would allow more Indian voices to be heard.

Mahathir also criticised Samy for creating excuses about bringing up Indian issues at the Cabinet level.

"That is his excuse. I know how much he talks in the Cabinet. Don’t (say) something that others cannot prove because nobody heard him in Cabinet except us.

"He talks, but these things were not the issues that he raised - like the recovery of money for the Indian community who were brought here by force and all that.

"He never mentioned that, I’ve never heard him. He never said that the Malays were committing genocide and ethnic cleansing. He never said that. Why didn’t he say that?" he asked.

"Samy Vellu did not ask for assistance. The problem is that he is preventing other Indians from having a say."

Samy's Statistics of facts and lies

Samy Vellu counters 'lies' with facts and figures

Samy Vellu yesterday unveiled statistics on financial aid and other assistance provided to the Indian community. The statistics were aimed at countering allegations by opposition groups that the community had been neglected by the government.

He said the government had provided a grant of RM300 million to build the MIC-run Asian Institute of Medicine, Science and Technology University (AIMST) in Kedah.

"The government also gave us an initial grant of RM8 million to build the TAFE College in Seremban, which has produced 44,000 para-professionals," Samy Vellu said.

Since AIMST and TAFE College are controlled by MIC which is the representative of Malaysian Indians, by default, the Indians have benefitted and gain, irrespective even if they don't because MIC is Indians.

Samy Vellu said the federal government also allocated RM1 million annually for the building of temples.

Samy also said Indian youth received an allocation of RM4 million of which RM1 million was allocated to 200 Indians from urban poor families who could not secure places at skills training institutes. The remaining RM3 million had been used as a revolving micro loan fund with Yayasan Tekun.

He said the government had also allocated RM5.4 million to the MIC-run Social Strategic Foundation to undertake social programmes between 2004 and this year.

Samy Vellu said the government had also allocated RM5 million to enable 1,000 Indian youths who had failed their examinations to enroll in skills training courses that included residential facilities and pocket allowance through Giat Mara, INPENS International College in Pulau Indah and other training institutes.

So, 50 years of existence and 28 years of ruling MIC, Samy has this result to show the Indians. Can the Indians be happy with this result?

Samy says "Maybe" his last term

Samy reciting Karma Less Sutra

Sub-contractors to be paid directly by Works Ministry

Samy Vellu said: "The Works Ministry will make direct payments to sub-contractors handling government projects with immediate effect to ensure that they receive the money on time. This will also overcome the problem of them not getting the amount promised by main contractors."

Samy Vellu said, "Under a directive from Prime Minister Datuk Seri Abdullah Ahmad Badawi, contractors handling government projects will also have to register their sub-contractors."

Samy doesn't seem to have much to say. He keep reciting his Karma without the Sutra. He is saying something from nothing. He must be so confused that he did not realized that he knew nothing of what's happening in JKR for the last few decades, and he doesn't know that he knew nothing, absolutely nothing, about anything that really mattered on this subject matter.

Since the 1990s, JKR had been practicing the direct payment to the Nominated Sub-contractor. Upon award of any PWD projects to the main contractor, the main contractor would have to sign Form 66 which empowers the JKR to make direct payment to all Nominated Sub-contractors.

The move was to resolve complaints from nominated sub-contractors that numerous main contractors did not pay them when they received monies from the government which include payment due to these sub-contractors, or that the monies was not paid in a reasonable timely manner or that the sum paid was a reduced amount than the amount certified in the payment certificate.

Firstly, this directive did not come from Pak Lah's instruction but was implemented during the Mahathir's regime and what Pak Lah did was a continuity of the policies.

Secondly, it is not the sub-contractors which is engaged by the main contractor (and often defined as domestic sub-contractors) that is intended but the Nominated Sub-contractors and Nominated Suppliers.

Thirdly, the government cannot interfere into the affairs on payment terms and conditions of contract between the domestic sub-contractors who were contracted by the main-contractors as it could, by implied terms, create a contractual obligations by the cause of action, and also be an act of interference which varied the terms and conditions of contract, thereby caused the government to have created a special relationship with the other parties who were not a party to the contract with the government, by way of "Voluntary Assumption of Responsibility" which thereof give rise to a special duty of care under the Hedley Byrne v Heller Principles.

We have so many legal advisors in JKR and we also have the Attorney-general office to provide legal advices to the Works Ministry; yet we don't see them advising rightly, or is it that Samy is not listening to the legal experts?

Samy Vellu also said a demonstration by 10,000 Indian people did not mean the country faced an unrest.

“Unrest means the whole community getting together and causing problems. This is not happening there,” he said, adding that the majority of the Indians were peace-loving and supported the Government.

Samy said there was no demonstration or violence in the country as claimed by certain quarters.
“It was a gathering by a group calling itself Hindraf. It is not a registered body or a union,” he said.

He said the organiser of Hindraf was not in the country while the others were detained under the Internal Security Act (ISA). (Dear Samy, are you inferring that the organisers of Hindraf was not in the country during the gathering while the others were detained earlier? Your statement did not reveal the facts accurately)

10,000 Indians gathering is not demonstration, said Samy. But the police arrested the 31 Hindrafs and charged them for illegal demonstration and attempted murder? So, the police was wrong... there's no demonstration and this is an official statement from a senior minister of our Malaysian government. Samy must be right and the police must be wrong!!!

Samy said "There is no unrest as it's only 10,000 Hindrafs." There's also no unrest as there's 40,000 people from Bersih. So why the police use tear gas and water cannons? And how can it be that the police and Internal Security Minister said the Hindrafs are terrorists? It's damn funny language. Words can be twisted to mean something in one place and another thing in another place. Are Malaysian ministers double-tongue or are the government as a whole multi-tongues?

Health Minister Datuk Seri Dr Chua Soi Lek admitted he is the politician in the sex DVDs circulating in Johor.

Dr Chua said the girl is his “personal friend”.

Dr Chua said he will not resign over the sex DVDs. He will leave that up to Prime Minister Datuk Seri Abdullah Ahmad Badawi to decide.

“I have seen the Prime Minister, Deputy Prime Minister Datuk Seri Najib Tun Razak and MCA president Datuk Seri Ong Ka Ting and I have personally apologised to them,” he said.

The wife of Health Minister Datuk Seri Dr Chua Soi Lek in a statement Tuesday said that she stands by her husband.

Datin Seri Wong Sek Hin said, “My husband had apologised to me and the family.

“It is a difficult time for all of us but we have accepted his regret and apology.

“He has been a good husband, father and family man who has never shirked his responsibilities.

“We know that it will be difficult during this time but we will go through this together as a family and will support him.”

He should be forgiven because he's a Health Minister, and a Health Minister must sacrifice himself to carry out some biological test to determine the functional capabilities of certain organs, in particular, those organs that often malfunction when we get older. In fact Dr Chua had proven he can still use it strenuously for about 100 minutes without assistance and enhancement from any aphrodisiac drugs or support from additional crew members. And we must also appreciate the girl who is willing to be a guinea pig for the test. The test results could not be published currently as scientific evidence is insufficient and more test is needed. In fact Dr Chua is also inviting more participants, particularly from those political leaders in MCA and Barisan Nasional, to confirm the test results and provide humanity with a better solution to overcome dysfunctional organs of old guys. This way, it will prove that BN representatives truly sacrifice themselves for the rakyat and we need to vote for him for another term. Malaysia Boleh and Singapore Ministers Tak Boleh. Today is the 1st day of 2008. Happy New Year!

So, Bloggers must start the day with only good news, Chinese say, "lai lai se se", "tai kat tai lei", which means good luck and good fortune.

So, I too must obey this rule of nature.

News No.1: Samy Vellu Pledge to uplift Indian living standards.

Datuk Seri S. Samy Vellu said his new year resolution is to uplift the standard of living in the Indian community.

"As MIC President, I will strive to create more opportunities in education, employment, economy, business, housing, health and assistance to the Indian Community through the normal system of discussions with the government." "The system had been successful ... but there is still more to be done." This is Samy's mission statement, goals and objectives for 2008.

Now, the Indian community can rejoice, for finally, after 25 years as President of MIC, Samy had discovered what he can do for the Indians. He is now enlightened; he discovered Nirvana, and he now shout Eureka!

Samy said his objective is to seek assistance from the normal system via discussions with governing body, of which Samy said, had been successful so far, but, of which more can be done.

25 years was a good experience, and enough time had lapse for the learning and ultimately discovery of the plights. It had been successful, as claimed by Samy, but of which more can be done. How true! The Indian now seems to have hope, a hope they had been hoping, and a hope that is now revived, a hope that had made them so successful thus far, and a hope that more can be done, with a hope that it will still be done by the normal system, a system where we can only seek goodwill consideration, graciousness and less suppression and oppression, and the fundamental of giving us back a little of our rights which are rightly embedded in the Constitution. There's Hope!

News No.2: Mat Rempit ride into new careers.

The 2nd Chance Programme is the brainchild of Putera UMNO initiated by its chairman Datuk Abdul Azeez Abdul Rahim 2 years ago, and funded by the Youth and Sports Ministry and the Human Resources Ministry. It provides free education, free working opportunities, and free meals.

The programme offered 10 technical modules, including automotive, hotel management and use of CCTV and the special skills of videotaping, wood carving, nursing, paramedic and computers. All the participants need not have any basic academic qualifications as they would still be granted a degree of sort upon compulsory graduation as none will be failed to motivate the rempits to participate.

In the coming years, the programme will include training the rempits to become ministers and state assemblymen, and possibly someday, one of them can be the prime minister.

Form observation of the social environment, the programme had been very successful as there are now less damages and less violence. Now we hear less of rempits causing road troubles in the day time and less stoning the police and JPJ. It fact the percentage had drop by at least 2% of crimes over the last 2 years, a sign of significant achievement from this rempit retraining programmes. Police statistics from 2003 to October 2007 showed only 2,837 illegal racers arrested under S.42(1) Road Transport Act 1987. This is significantly low in direct comparison to those illegal demonstrators arrested by the police.

News No.3: Sex DVD given free

To commemorate the new year, Johoreans were treated to a rare gift, a pair of sex DVD starring a prominent MCA senior politician and a woman engaging in various sexual antics. The direct beneficiaries of this gifts are citizens in Tangkak, Batu Pahat and Muar. Soon,this free gifts will also benefit the indirect citizens.

The DVD recordings are done with the use of CCTV in a hotel suite and the movie is 56 minutes for the 1st disk and 44 minutes for the 2nd disk. I'm not sure whether it will be made available at the YouTube but it is available at the friendly VCD vendors. It is rumored that the politician would soon be approached by Hollywood and Mollywood for a role in a new movie that had yet to be scripted and the fees offered is said to be very lucrative. It was overheard that the various film directors were simply amazed by the ability to perform 100 minutes of sexual antics by two individuals without any supporting casts and technical crews.

Tengku Adnan V-Prophesy

Hindraf Demo bcoz one did not get British Citizenship

Tourism Minister Datuk Seri Tengku Adnan Tengku Mansor said an individual who was among those behind the illegal rally in Kuala Lumpur last month had once applied for British citizenship.

Without identifying the individual, he said the application, which was made before the rally, was rejected by the British Government.

Out of frustration due to the rejection of his application, he and several others, who were similarly embittered, tried to create a disturbance to attract international attention, Tengku Adnan, an Umno supreme council member and Putrajaya Umno division chief, told reporters after launching the division's Umno Youth election machinery here.

He said these people were not fighting for the Indian community but for personal gain because they once asked “something for themselves” from MIC president Datuk Seri S. Samy Vellu but the request was not entertained.

Tengku Adnan said it was unfortunate that Malaysia had had to handle the problems created by the group.

Ho, Ho, Ho, Christmas time....

So, we now learnt that Hindraf leaders, someone, did not get British citizenship, and that's why they are suing the British govt for £3 trillion. They also did not get something for themselves from Samy Vellu; so they fight MIC. What a great piece of news.

Hi Adnan, it's X'mas time, not Halloween day!

But even Hollywood and Bollywood scriptwriters don't want such stories. Tengku Adnan must make it more dramatic and add more evils, something like V for Vendetta.

Aniza Damis speaks to Tun Musa Hitam about the Rights and Responsibilities that come with freedom of expression, and how we should try to allow it.

Excerpts:


Q: The system right now is, if you want to assemble, you have to apply for a police permit.

A: And almost automatically, its refused. So you stop there.

Q: So, if it’s refused, the assembly is illegal?

A: yes, it’s illegal.

Q: Some people feel there is a biased allocation of permits.

A: There are biased allocations, in so far as the applicants are concerned. In so far as the government is concerned, they say they are not biased. But therein lies the problem.

The law needs to be adapted. If you accept the principle expression of views in terms of demonstrations to be positive, then work on it.

Q: The government believes if you are unhappy, you should make an appointment with the government and tell them what’s wrong.

A: Let’s talk about the Indian problem. Incidentally, we’re all Malaysians. Their problem in this country is genuine. Of course we have a party that claims to be representing the Indians, but obviously, they feel that they are not satisfied with the representation. Obviously they are desperate. And I know, in many cases, they have genuine grievances.

Q: In an illegal rally, is it justified to use force?

A: No, not by anybody. The police will tell me, in many cases it is true, that they are provoked.

Q: Is Malaysia ready for peaceful assemblies?

A: Yes! Come on, we have been independent for 50 years.


I am happy that the prime minister actually directed the MIC to look into the matter. But they should not have been told…it should have been an on-going thing. Maybe they need to have a good fresh look at themselves.

The TV saying everyday that Ini Bukan Budaya Kita. I’m sorry for ridiculing this, but where is there a Budaya of violence anywhere in the world? Do you think violence is a French budaya? Indonesians? Filipinos?

Don’t anybody dare tell me that I’m anti-government, or anti-UMNO.

The right to peaceful assembly is enshrined in our democratic institution. That right also gives the right to the government to refuse.The thing at issue is not that the rights are not there. The right exist. It is the application of the right and the administration of the right that I am taking issue with.

So the survival of liberalism and tolerance depends on the ability of all to contribute. It is in the interest of all to see that this liberalism and tolerance survive. It is in the interest of all.

Q: If the government doesn’t come up with a system, what would this say about human rights and about us?

A; The government has the right to say no. the government has a right to refuse. But if it does, I’ll be disappointed. Try, lah!
