AFFIDAVIT OF DESISTANCE
(In Re: Criminal Case No. S-5752 for Frustrated Homicide, RTC 11)

I, WILSON YURONG BANGCAT, of legal age, married, Filipino, with residence and
postal address at Sugilon, Siayan, Zamboanga del Norte, after having been duly sworn to
an oath in accordance with law, do hereby depose and say that:

1. That I WILSON YURONG BANGCAT, is the complainant and private offended in


a criminal case docketed as Criminal Case No. S-5752 for Frustrated Homicide
now pending trial in the Regional Trial Court, Branch 11 which was filed against
JUNIOR LIBAY ULAY;

2. That the respondent and myself, have already come to terms best
advantageous to both of us for the reason that we have agreed to settle this
case amicably as we have already reconciled and we have restored our good
relations. Moreover, we believe that the accused is innocent and is not guilty
of the crime charged against him;

3. That knowing the fact that the respondent and myself have already come to
terms and also because there is no doubt as to the guilt of both accused, my
witnesses are no longer interested and willing to testify in my favor;

4. That without the testimony of my witnesses, I will no longer be able to prove


my case in court hence I already lost interest in the further prosecution of the
above-entitled case against the accused JUNIOR LIBAY ULAY;

5. That I am executing this affidavit in utmost good faith to state the truth of the
foregoing facts and to request the concerned authorities specifically the
Regional Trial Court, Branch 11 to cause the dismissal of the above-mentioned
case that I cause to be filed against JUNIOR LIBAY ULAY, for the reasons stated
in the foregoing.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 15th day


of July, 2019 at Sindangan, Zamboanga del Norte.

This is to CERTIFY that I had personally examined the herein affiant who had

Language, a language fully understood and spoken by the affiant, and thereafter
