They are both single and widow, respectively, so there is no legal impediment for them to marry each other. 3. They have executed this affidavit to attest to the facts of their cohabitation and to allow them to marry without a marriage license, according to Article 34 of the Family Code of the Philippines.

AFFIDAVIT OF COHABITATION

WE, APOLINARIO T. MALICAY JR., of legal age, Filipino, single, and a


resident of Purok-3, Minlasag, Sibutad, Zamboanga del Norte, and VILMA
TANODRA LUCMAN-BALAORO, likewise of legal age, Filipino, widow, and a
resident of Purok-3, Minlasag, Sibutad, Zamboanga del Norte, after having been
duly sworn to in accordance with law, do hereby depose and say:

1. That we have been living together as husband and wife under the same
roof, continuously and without any interruption, since November 16, 2012
or a period of more than five (5) years;

2. That during our cohabitation and even until the present, we remain both
of single and widow status, respectively, hence, there is no legal
impediment for us to marry each other; and

3. That we are executing this affidavit to attest to the foregoing facts and for
purposes of contracting marriage without the need of securing the
marriage license pursuant to the provisions of Article 34 of the Family
Code of the Philippines.

IN WITNESS WHEREOF, we have hereunto set our hands this 8 th day of


March, 2019, at Dipolog City, Philippines.
