That on or about 08 July 2018 at 7:30 pm in the City of Makati and
within the jurisdiction of this Honorable Court, the above named
accused, conspiring and confederating with each other, took the
victim out of his uncle’s residence, did then and there, with malice
aforestated and with deliberate intent to take the life of JOSHUA DE

GRACIA, willfully, unlawfully, feloniously, suddenly, unexpectedly,
treacherously and beyond their authority shot the latter with their
service guns, wounding him in the back of his left shoulder, at the
back of his head and at his upper left thigh, while he was
handcuffed, enfeebled and unable to defend himself, all wounds
being necessarily mortal, thereby causing the direct and immediate
death of said JOSHUA DE GRACIA.
