AN ACT TRANSFERRING THE PH ILIPPIN E NATIONAL


POLICE ACADEMY (PNPA) AND THE NATIONAL
POLICE TRAINING INSTITUTE (NPTI) FROM THE
PH ILIPPIN E PUBLIC SAFETY COLLEGE (PPSC) TO
TH E P H IL IP P IN E N A TIO N A L PO L IC E (P N P ),
AMENDING FOR THE PURPOSE SECTIONS 24, 36,
66, 67 AND 68 O F R E P U B L IC ACT NO. 6975,
OTHERWISE KNOWN AS THE “DEPARTMENT OF
THE INTERIOR AND LOCAL GOVERNMENT ACT OF
1990”, AS AM ENDED, A PPRO PRIATIN G FUNDS
THEREFOR AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the


Philippines in Congress assembled:

S ection l. Section 24 of Republic Act No. 6975, as


amended, is hereby am ended to read as follows:
“S ec . 24. Powers a n d Functions. —The
PNP shall have the following powers and functions:

“In addition, th e PN P sh all absorb the


office of th e N atio n al A ction C om m ittee on
A nti-H ijacking (NACAH) of the D epartm ent of
National Defense, aU the functions of the present
P h ilip p in e A ir F o rc e S e c u rity C om m and
(PAFSECOM), as well as the police functions of
the Coast Guard. In order to perform its powers
and functions efficiently and effectively, the PNP
shall be provided w ith adequate land, sea, and
air capabilities and all necessary m aterial means
or resources.

“To better achieve the goals of a highly


efficient and competent police force, the Philippine
National Police (PNP) shall have adm inistrative
and operational supervision and control over the
Philippine N ational Police Academy (PNPA)
established pursuant to Section 13 of Presidential
Decree No. 1184, and the National Police Training
Institute (NPTI), formerly known as the Philippine
National Training Center (PNTC).”

S ec . 2. A new Section 35-A is hereby inserted in the same


Act, to read as follows:

“S e c . 35-A. N a tio n a l Police T ra in in g


I n s t i t u t e (N P T I). - T h e N P T I s h a ll be
responsible for the m andatory and leadership
trainings of all police non-commissioned officers
(PNCOs). The su p erv isio n a n d control over
the NPTI shall be established in the revised table
of o rg an izatio n and eq u ip m en t a n d staffing
p a tte rn under Section 68-B.
“The NPTI shall be headed by a Director with
the rank of Police Major General.”

S e c . 3. Section 66 of the sam e Act is hereby amended to


read as follows:

“S ec . 66. Creation of the Philippine Public


Safety College. - There is hereby created the
Philippine Public Safety College (PPSC), which
shall be the prem ier educational institution for
the training, hum an resource development and
continuing education of aU personnel of the Bureau
of Fire Protection and Bureau of Jail Management
and Penology and the provider of select mandatory
career courses for police commissioned officers and
specialized courses for personnel of the PNP.

“The College sh all be u n d e r the direct


supervision of a Board of T rustees composed of
the Secretary and the three (3) bureau heads.”

S e c . 4. Section 67 of the same Act is hereby am ended to


read as follows:

“S e c . 67. C o m p o sitio n , P o w ers a n d


Functions. - The College sh all consist of the
N ational Fire T raining In stitu te , the N ational
Police College, the N ational Forensic Science
Training Institute, the N ationalJail Management
and Penology T ra in in g In s titu te , and o th er
special training centers as may be created by the
D epartm ent, whose functions shall be as follows;

“(a) F o rm u late and im plem ent tra in in g


program s for all personnel of the Fire and J a il
B ureaus and o th er tra in in g centers under the
Departm ent:
“(b) F o rm u la te a n d im p le m e n t s e le c t
mandatory career courses for police commissioned
officers;

“(c) Form ulate and im plem ent specialized


courses for personnel of the PNP;

“(d) E s ta b lis h a n d m a in ta in a d e q u a te
physical training facilities;

“(e) Develop and im plem ent research and


developm ent to support ed ucational train in g
programs;

“(f) Conduct an assessm ent of the training


needs of all its clientele; and

“(g) Perform such other rela te d functions


as may be prescribed by the Secretary.”

S e c . 5. A new Section 67-A is hereby in serted in the


same Act, to read as follows;

“S e c . 67-A. P h ilip p in e N a tio n a l Police


Academy (PNPA). - The PNPA is the prem ier
institution for police education, and the prim ary
source for commissionship of police lieutenants.
The PNPA shall be under the direct administrative
and operational supervision and control of the
Chief of the PNP.

“The PNPA sh all be headed by a PNPA


D irector w ith the ran k of Police M ajor General,
who shall be assisted by a Deputy Director w ith
th e r a n k of Police B rig a d ie r G e n e ral. The
PN PA sh a ll have a D ean of A cadem ics and
a C om m andant, both w ith the ran k of Police
Brigadier General.”

S e c . 6. A new Section 68-A is hereby in serted to read


as follows;
“S e c . 68-A. T ran sfer of P ersonnel a n d
P r o p e rtie s . - T h e p e r s o n n e l a n d a ll th e
properties, facilities, records, equipm ent, funds,
c h o ses in a c tio n , a p p r o p r ia tio n s , r ig h ts ,
functions, habilities and other assets of the PNPA
and NPTI are hereby tra n sfe rre d to the PN P.”

S ec . 7. A new Section 68-B is hereby in serted to read


as follows:

“S ec . 68-B. T ransition. — (a) W ithin one


hundred twenty (120) days from the effectivity of
this Act, the Chief of the PN P shall subm it the
revised table of organization and equipm ent and
staffing p a tte rn of the PNPA and the NPTI to
the N ational Police Commission (NAPOLCOM)
and the D epartm ent of Budget and M anagem ent
(DBM) for a p p ro v a l. T he re v is e d ta b le of
organization and equipm ent and staffing p attern
may include the reorganization and renam ing of
existing PNP train in g offices and units, and the
realignm ent of functions as m ay be necessary;

“(b) The personnel of the PNPA and the


NPTI shall be transferred from the PPSC to the
PNP and continue to perform th eir duties and
responsibihties and receive th eir corresponding
salaries and benefits;

“(c) The PNP, PPSC, PN PA and NPTI shall


jointly conduct an inventory of all the properties,
facilities, records, equipm ent, funds, choses in
action, appropriations, rights, functions, Habilities
and other assets of the PNPA and NPTI prior to
their complete transfer to the PNP;

“(d) For a period of five (6) y ears from


th e effectiv ity of th is Act, th e PN PA sh a ll
c o n tin u e to a c c o m m o d a te c a d e ts for th e
B u re a u of J a il M a n a g e m e n t a n d Penology
(BJM P) an d th e B u re a u of F ire P ro te c tio n
(BFP): P ro v id ed , T h a t th is p e rio d m ay be
extended by the PN P upon the request of the
BJMP and BFP in case the PPSC is still not able
to provide the education and tra in in g required
by the two (2) bureaus. P u rsu a n t thereto, the
Departm ent of the Interior and Local Government
(DILG), in consultation with the PPSC, is hereby
authorized to create a separate academy for the
BJM P and BFP. T hereafter, the PNPA shall
produce g ra d u a te s who will exclusively join
the PNP: Provided, further. T h a t the budget
required for the per capita expenses for cadetship
train in g during the tra n sitio n period shall be
included in the respective appropriations of the
BJM P and BFP; and

“(e) The S ecretary of th e DILG and ex


officio C h a irm a n of th e NAPOLCOM sh a ll
f o rm u la te a n d im p le m e n t a five (5 )-y e ar
tran sitio n plan to ensure the smooth tran sfer of
the PNPA and NPTI to the PN P.”

S e c . 8. W ithin ninety (90) days from the effectivity of


this Act, the N ational Police Commission, in coordination w ith
the P h i l i p p i n e National Police, Philippine Public Safety College
and D epartm ent of the In te rio r and Local G overnm ent shall
prom ulgate the necessary rules and regulations to im plem ent
the provisions of this Act.

S e c . 9. T h e a m o u n t n e c e s s a ry fo r th e i n i t i a l
im plem entation of th is Act sh all be charged a g a in st the
current year’s appropriations of the Philippine National Police
Academy and the National Police Training Institute under the
Philippine Public Safety College. T hereafter, such am ount as
may be necessary for its continued im plem entation shall be
included in the annual G eneral Appropriations Act.

S ec . 10. In case any provision of this Act or any portion


hereof is declared unconstitutional, the rem aining provisions
a h u ll not be affected thereby.
S e c . 11. All laws, decrees, executive orders, rules and
regulations, and other issuances or p a rts thereof which are
inconsistent w ith th is Act are hereby repealed, am ended or
modified accordingly.

S e c . 12. This Act shall take effect fifteen (16) days after
its publication in the Official Gazette or in a newspaper of general
circulation.
