Affidavit of Desistance

Michael Tokoyo Corpuz and Edgardo Sabando Gaita Jr. filed a criminal complaint for grave threat against Franklin Cayao Reyes. However, they can no longer state with certainty Reyes' liability since the incident occurred at night. They are withdrawing the complaint and clearing Reyes of any responsibility. Through this affidavit of desistance, Corpuz and Gaita desire to dismiss the criminal case and have it considered closed.

AFFIDAVIT OF DESISTANCE
We, MICHAEL TOKOYO CORPUZ, of legal age, Filipino, and a resident of
Barangay Malcampo, Roxas, Palawan, and EDGARDO SABANDO GAITA, JR., of
legal age, Filipino, and resident of Barangay Malcampo, Roxas, Palawan, after having
been duly sworn in accordance with law, hereby depose and say:

1. That we are the private complainants in the complaint entitled "PP. vs.
FRANKLIN CAYAO REYES ", for GRAVE THREAT, docketed as NPS
DOCKET NO. IV-08-INV-18E-0295 before the Office of the Provincial
Prosecutor, Puerto Princesa City, Palawan, Philippines;

2. That since we could not state with certainty and without a doubt the liability of the
accused, FRANKLIN CAYAO REYES, and considering the fact that the incident
transpired during nighttime, we are permanently withdrawing our complaint
against him. We clear him of whatever responsibility or liability to us and thereby
informing the Provincial Prosecutor of Palawan, that we are withdrawing the
complaint for GRAVE THREAT against FRANKLIN CAYAO REYES;

3. That in view of the foregoing, we are no longer interested, and we hereby desist,
in prosecuting the said criminal case against FRANKLIN CAYAO REYES;

4. That we execute this Affidavit of Desistance so that the above-mentioned


criminal case against FRANKLIN CAYAO REYES be immediately dismissed and
considered finally closed.
