CONSTITUTION OF THE NIGERIAN UNIVERSITIES ENGINEERING


ASSOCIATION, BENSON IDAHOSA UNIVERSITY CHAPTER (NUESA BIU) 2021
PREAMBLE
RECOGNISING: The uniqueness of the discipline embracing ENGINEERING as regards
improving the standards of living of man and the advancement of society;
DESIROUS: With a desire and determination to create a forum where students of Benson Idahosa
University, in the Faculty of ENGINEERING meet in a cordial environment for the purpose of
upholding the aims and objectives of ENGINEERING in society, and acquiring higher learning
in this great citadel of learning in BENSON IDAHOSA UNIVERSITY (BIU), ;
AWARENESS: Of the role which such a forum will play in the educational and social
advancement of the students in the FACULTY OF ENGINEERING;
RESOLUTION: We, the students of the FACULTY OF ENGINEERING, BENSON IDAHOSA
UNIVERSITY, hereby resolve to uphold this constitution, strive towards educational
advancement and also to form a virile, dynamic, non-political, educational and social
organization.

ARTICLE 1
GENERAL PROVISIONS
NIGERIAN UNIVERSITIES ENGINEERING BENSON
IDAHOSA UNIVERSITY CHAPTER (NUESA BIU)
1. SUPREMACY OF THE CONSTITUTION
This constitution shall be supreme and its provisions shall be binding on all the members of the
association.
2. NAME, MOTTO AND ADDRESS OF THE ASSOCIATION
Nigerian Universities Engineering Students Association, BENSON IDAHOSA UNIVERSITY,
Benin City, Edo state,
The National, and the BIU Anthems shall be sung at the beginning and end of any programmes,
meetings of EXCOs, sittings of PARLIAMENT and Congress of the Association.
3. AIMS AND OBJECTIVES OF THE ASSOCIATION
The aims and objectives of the Association shall be as stated herein:
a) To be an active, progressive and democratic association formed for the sole purpose of
promoting the welfare and interest of her members.
b) To create a platform where engineering students can learn from practicing Engineers from
diverse fields of Engineering, in synergy with other stakeholders within and outside the
university, for the development of individual and collective potentials of her members.
c) To coordinate opinions and information, encourage and publish articles of Engineering
and related interests.
d) To foster unity and harmony between members of the Association and among others. To
promote the understanding of the study of Engineering.
e) To contribute towards technological development of Nigeria by organizing seminars
symposia, lectures, workshops and other activities aimed at achieving this goal, carrying
out engineering projects with the aim of improving the standards of living in our society.
f) To promote intellectual, social, cultural and sporting activities of the Association.
g) To work closely with the Nigeria Society of Engineers (NUESA is the student wing of the
Nigeria Society of Engineers), the governing body that interface between students and key
stakeholders across Engineering Organizations, industries and the Government with the
clarion call on promoting academic excellence, building career competence across the
federation.
4. MEMBERSHIP OF THE ASSOCIATION
There shall be three grades of members: All duly Matriculated students of the Faculty; Associate
members; Honorary members.
(1) a) Each member shall pay his/her Association Dues at the beginning of the tenure of each
newly NUESA EXCO, into the NUESA BIU bank account with Above Only Microfinance
Bank, Account number 1100033279.
b) For the purpose of Section 4 (1) a) above, Regular students shall include all
(Direct Entry and Jambite) students of the Faculty.
(2) a) Non-ENGINEERING
appropriate dues to be fixed by the EXECUTIVE COMMITTEE in conjunction with the
ENGINEERING Students Representative Council (PARLIAMENT).
(b) Such Associate member shall enjoy all privileges due to members of NUESA BIU
(c) Associate members cannot vote or be voted for in any election of the Association.
(3) Honorary membership of NUESA BIU shall be conferred on: distinguished persons (not
belonging to 2 (a) and 2 (b), who have rendered assistance to NUESA BIU chapter,
FACULTY OF ENGINEERING and BENSON IDAHOSA UNIVERSITY, to be nominated
by the NUESA EXCO and approved by PARLIAMENT.
(4) The Faculty authority shall be empowered to refuse registration of any student who has not
paid the Association dues.
(5) A student on suspension from the university shall remain a bona-fide member of the Faculty
Association.
(6)
the Association and therefore the privileges inherent in such membership. A bill to this effect
shall be passed from the Executive to necessary quarters; this issue is also taken to BIUSU.
Not until all these were convinced shall the student be deemed dismissed.
(7) The PARLIAMENT shall have power to act on the recommendation of Section 4 (3) (a&b)
and others related to it if the EXCO is silent too long on the issue(s).

5. PATRONS AND MATRONS


There shall be for the Association a Grand Patron, a Grand Matron, Patrons and Matrons
ARTICLE 2
6. ORGANS OF THE ASSOCIATION
The organs of the Association shall consist of: (1) The EXECUTIVE COMMITTEE, (2)
PARLIAMENT, and (3) The CONGRESS

THE EXECUTIVE COMMITTEE
7. ESTABLISHMENT OF THE EXECUTIVE COMMITTEE
(1) There shall be an EXECUTIVE COMMITTEE (EXCO) for the Association.
COMPOSITION OF THE EXECUTIVE COMMITTEE
(2) The EXECUTIVE COMMITTEE shall comprise of the following elected officers:
(1) PRESIDENT, (2) VICE PRESIDENT, (3) SECRETARY GENERAL, (4) ASSISTANT
SECRETARY GENERAL, (5) FINANCIAL SECRETARY, (6) ASSISTANT FINANCIAL
SECRETARY, (7) MINISTER OF POWER, (8) MINISTER OF WORKS, (9) MINISTER OF
MECHANICS, (10) DIRECTOR OF WELFARE, (11) DIRECTOR OF SPORTS, (12)
ASSISTANT DIRECTOR OF SPORTS, (13) DIRECTOR OF SOCIALS, (14) ASSISTANT
DIRECTOR OF SOCIALS, (15) FACULTY CHAPLAIN, (16) ACADEMIC OFFICER,
(17) INTERNAL AUDITOR

8. POWERS AND DUTIES OF EXECUTIVE COMMITTEE


The EXECUTIVE COMMITTEE shall:

Candidates must:

(1) The tenure of office for all officers of the Association shall be one Academic Session.
(2) A member of the Association may serve a maximum of two terms in the EXECUTIVE
COMMITTEE if re-elected
11. FUNCTIONS OF THE OFFICERS OF THE EXECUTIVE COMMITTEE
(1) PRESIDENT
The President shall:
a) There shall be for the association a President.
b) Shall be the chief executive of the association and shall preside over all the general and
executive meetings.
c) Shall in consultation with the Secretary-General, summon all General and Executive
meetings of the association.
d) Shall be responsible for prompt execution of the Association s policies.
e) Shall at all time defend the integrity of the association in accordance with the provisions
of this constitution
f) Shall, in pursuance of the objectives of the association, have the prerogative of assigning
roles and duties to other members of the Executive and members of the Association.
g) Shall perform other functions that may be conferred on him by this constitution.
(2) VICE PRESIDENT
The Vice President shall:
a) There shall be for the association a Vice President.
b) She shall assist and advice the

d) She shall perform additional duties assigned by the President and the provisions of this
constitution from time to time.
(3) SECRETARY GENERAL
The Secretary General shall:
a) There shall be for the Association a Secretary General.
b) Shall record the minutes of the general and EXECUTIVE COMMITTEE meetings and

c) Shall at the instance of the President, summon all general and EXECUTIVE
COMMITTEE meetings.
d) Shall be in charge all books, documents, movable and immovable properties of the
Association.
e) Shall maintain a current list of all the members of the Association with telephone numbers
and mailing addresses.
f) Shall perform any additional duties assigned by the President and the provisions of this
constitution from time to time.
(4) ASSISTANT SECRETARY GENERAL
The Assistant Secretary General shall:
a) There shall be for the Association an Assistant Secretary General.
b) Shall assist the Secretary General and act for him/her in his/her absence.
c) Shall perform any other secretarial duty as assigned by the Secretary General.
d) Shall perform additional duties assigned by the President and provisions of this
constitution from time to time.
(5) FINANCIAL SECRETARY
The Financial Secretary shall:
a) There shall be for the Association a Financial Secretary
b) Keep the financial records of the Association
c) Maintain accurate accounting records
d) Report the financial status at each EXCO meeting
e) Authorize and sign checks approved by the EXCO
f) Shall also perform additional duties assigned by the President and provisions of this
constitution from time to time.
(6) ASSISTANT FINANCIAL SECRETARY
The Assistant Financial Secretary shall:
a) There shall be for the Association an Assistant Financial Secretary
b) Assist the Financial Secretary in performing his duties and act for him/her in his/her
absence
c) Shall perform any other finance office duty as assigned by the Financial Secretary.
d) Shall perform additional duties assigned by the President and provisions of this
constitution from time to time.
(7) MINISTER OF POWER
The Minister of Power shall:
a) There shall be for the Association a Minister of Power

The Minister of Works shall:
a) There shall be for the Association a Minister of Works

The Minister of Mechanics shall:

12. MEETINGS OF THE EXECUTIVE COMMITTEE


(1) Meeting of the EXECUTIVE COMMITTEE shall be convened at least twice in a month per
semester.
(2) And in addition, shall be convened on the request of at least a simple majority of the total
membership of the EXECUTIVE COMMITTEE.
(3) A simple majority, for the purpose of Section 12 (2) above and any other section it appears in
this constitution, shall be half plus at least one of the total number of EXCOs.
13. QUORUM OF EXECUTIVE COMMITTEE
The quorum of the EXCO meetings shall be nine (9).

ARTICLE 4
14. DISSOLUTION OF COUNCIL
The Council shall stand dissolved when:
15. CESSATION OF MEMBERSHIP OF THE COUNCIL
(1) A Council officer may, after giving at least one month written notice, resign his seat in the
Council.

16. REMOVAL FROM OFFICE


(1) A Council officer shall be removed by a resolution passed by a 2/3 majority of the total
membership of the PARLIAMENT.

ARTICLE 5
PARLIAMENT
17. ESTABLISHMENT OF THE PARLIAMENT
(1) There shall be an ENGINEERING PARLIAMENT) for the
Association.
(2) The practice and procedures of the PARLIAMENT shall be based on the provisions of this
Constitution.
(3) In any issue of the PARLIAMENT where the Constitution is silent, the Standing Order shall
be referred to.
(4) In any issue of the PARLIAMENT where the Constitution and the Standing Order are silent,
the Speaker shall have the final say.

18. COMPOSITION OF THE PARLIAMENT


(1) The ENGINEERING PARLIAMENT shall comprise of two elected representatives
from each level in each department.

19. GENERAL QUALIFICATION FOR MEMBERS OF THE PARLIAMENT


Candidates must:

(1) All legislative power shall be vested in the PARLIAMENT.
(2) The PARLIAMENT shall have power to adjudicate on any dispute that is referred to it which
arises from the implementation of the provisions of this constitution.
(3) The PARLIAMENT shall have power to review, question, and sanction or reject any activity
of the Executive.
(4) The PARLIAMENT shall have power to appoint Electoral committee for the purpose of

force of law and binding on all concerned and same communicated.
FUNCTIONARIES OF THE PARLIAMENT
21. The functionaries of the PARLIAMENT shall be:
22. DUTIES OF THE FUNCTIONARIES OF THE PARLIAMENT
(1) The SPEAKER shall:
(i) The speaker shall be elected in the first Parliamentary meeting by a simple majority of
members of PARLIAMENT present and voting in the first or any other meeting called
for that purpose.
(ii) He/ She shall be an elected member of the PARLIAMENT and not in the Executive.
(iii) The Speaker, acting through the Clerk of the PARLIAMENT, shall cause resolutions of
the House to be circulated.
(iv) Unless previously removed, a Speaker shall hold office until the election of a new
Speaker in the following session. He/ She shall preside over the election of a new
Speaker.
(v) The Speaker may be suspended or removed from office by a resolution adopted at a
meeting of the PARLIAMENT by a 2/3 majority of all the members of the House and
voting at a special meeting only.
(2) The DEPUTY SPEAKER shall:
(i) There shall be a Deputy Speaker who shall assist the Speaker in the performance of his/her
duties.
(ii) The Deputy Speaker who shall be an elected member of the PARLIAMENT shall be
elected by a simple majority of members at a meeting called for that purpose.
(iii) In case of (ii) above, the candidates for the Deputy Speakership must have indicated their
intention in writing to PARLIAMENT. The nomination shall bear the name of the
proposing member of PARLIAMENT and his/her seconder.
(iv) In the event that the Speaker is unable to attend a PARLIAMENT meeting, the Deputy
Speaker shall act on his/ her behalf.
(v) In case of the removal of the Speaker, the Deputy Speaker shall automatically become

(vi) Whenever the Deputy Speaker becomes the substantive Speaker, the PARLIAMENT
shall elect a new Deputy Speaker as laid down in Article 22(2ii).
(vii) The Deputy Speaker may be suspended or removed as in Article 22(2v)
(3) The CLERK shall:
(i) Shall be elected by the PARLIAMENT from among its members by a simple majority.
(ii) Shall take minutes and keep proper records of the proceedings of all PARLIAMENT
meetings.
(iii) Shall at the request of the Speaker, cause the circulars and agenda for meetings of the
PARLIAMENT to be sent to each member at least one week before any Parliament
meeting.
(iv) Shall perform any other functions as may be specified by the Speaker from time to time.
(4) The CHIEF WHIP shall:
(i) There shall be for the PARLIAMENT a Chief Whip who shall be an elected member of
the PARLIAMENT.
(ii) The Speaker shall present to the Parliament, a nominee for the post of Chief Whip.
(iii) The appointment of the Chief Whip shall be subject to an approval by 2/3 majority of
members voting at the first or any other ordinary PARLIAMENT meeting.
(iv) It shall be the duty of the Chief Whip to maintain order at PARLIAMENT meetings.
(v) It shall be the duty of the Chief Whip to bring to the notice of the Speaker any
transgression of the standing orders or any other matter that might obstruct the good
governance of PARLIAMENT and PARLIAMENT meetings.
(vi) In the absence of the Chief Whip, a meeting of the Parliament may elect one of its
members by a simple majority to act at that particular meeting only.

23. SITTINGS OF THE PARLIAMENT


(1) Sittings of the PARLIAMENT shall be convened by the Speaker at least once in a month per
semester, and in addition:
(2) Any member of the PARLIAMENT who absents himself from three consecutive meetings
without reason in writing to the Speaker shall be deemed to have vacated his seat. His
constituency shall accordingly be informed to make arrangement for a replacement.
(3) The Clerk shall have the power to call PARLIAMENT to elect anyone of the members to act
as the Deputy Speaker pro-tem in a particular meeting where both the Speaker and the Deputy
Speaker are absent.

24. QUORUM OF THE PARLIAMENT


The Quorum of the PARLIAMENT sitting shall be determined by 2/3 majority of the total number
of present honorable in the house.
ARTICLE 6
THE CONGRESS
25. THE CONGRESS OF THE ENGINEERING STUDENTS
(1) The general assembly of all students in the Faculty shall be called NUESA BIU Congress.
26. MEETINGS OF THE CONGRESS
(1) Congress shall be held at least once in a semester.
27. FUNCTIONS OF THE CONGRESS
(1) The congress Chairman will be nominated at the level of congress and seconded after which
he will preside over the meeting and he will be assisted by the Speaker and two (2) members
of the EXECUTIVE COMMITTEE and two (2) other members of the PARLIAMENT.
(2) Two members shall also be nominated to form a communiqué drafting committee; they are to
be assisted by the General Secretary.
(3) The congress shall allow maximum contribution and participation and shall act with due regard
to the language
(4) The decisions of the congress shall be final.
(5) In all congress meetings, members shall nominate Chief Whip to keep security of the congress
for that day.
(6) In all congress meetings, members shall comport themselves with proper decorum.

28. POWERS OF THE CONGRESS


i. The Congress may debate and pass resolution, if necessary, on any matter which is of
importance to the general body of ENGINEERING students or which endangers their rights
and privileges.
ii. The Congress shall have the power to rescind any decision of the EXECUTIVE COMMITTEE
and/ or PARLIAMENT.
iii. The decision of the Congress on any matter shall be final.
iv. It shall have the power to suspend/dismiss from office any member of the Association,
Executive found guilty of any misconduct. Such dismissal should be subject to 2/3 of the
members present at the meeting.
v. It shall have the power to recall from PARLIAMENT any senate representative found guilty of
any misconduct. Such a recall should be subject to 2/3 of the members present at the meeting.
vi. In the event of the Association not having a validly constituted executive committee and
parliament, the Dean of Faculty of Engineering, shall set up a Caretaker Committee.
vii. The duration of the Caretaker Co shall not exceed three (3) months.
viii. Whenever an officer of the Association is dismissed by Congress, election of a new officer
shall be held not later than 30 days after such dismissal, unless otherwise provided for by this
Constitution.
ARTICLE 7
THE ELECTORAL ACT
29. THE ELECTORAL COMMITTEE
(1) There shall be an Electoral Committee consisting of eleven (11) members constituted by the
PARLIAMENT.
30. DUTIES OF THE ELECTORAL COMMITTEE
The Electoral Committee duties are:
i. There shall be established for the association, electoral commission (in this section of the
constitution to be known as the Commission
ii. The commission shall be comprised of one (1) member each from each Department.
iii. Members so appointed to serve in the commission in accordance with 30(ii) above shall
be people of integrity and competence in handling electoral matters.
iv. The members shall select or appoint a chairman and a secretary among themselves.
v. The chairman shall be the Chief Returning Officer of the elections to be held by the
association and a returning officer shall be appointed among other members of the
commission.
vi. Setting aside the provisions of section 3(d) of this constitution, people appointed according
to 30(iv) above shall not be any member contesting to host the national secretariat.
vii. In the event of failure of the provisions of 30(v) above, the persons so appointed shall
cease to function in such capacity and new officers shall be appointed among the
remaining members of the commission.
viii. If the provisions in 30 (vii) above fails, the congress shall make decisions as to who shall
hold the positions and it shall be agreed upon by all contestants.
ix. Officers and members of this commission shall not have voting rights. x. The commission
shall stand dissolved immediately after a successful conduct of the elections.
31. COMPOSITION OF THE ELECTORAL COMMITTEE
The Electoral Committee shall have the following officers: (1) Chairman and a secretary among
themselves
32. QUALIFICATION OF THE CHAIRMAN OF THE ELECTORAL COMMITTEE
(1) The Chairman of the Electoral Committee shall be a male student.
ARTICLE 8
QUALIFICATION OF CANDIDATES FOR ELECTION
EXECUTIVE COMMITTEE CANDIDATES
33. PRESIDENT
(1) The Presidential Candidates must possess the following Qualifications: He /she must be a duly
matriculated and registered member of NUESA BIU.
(2) VICE PRESIDENT
(3) SECRETARY GENERAL
(4) ASSISTANT SECRETARY GENERAL
He/she can be a 100 level student.
(5) FINANCIAL SECRETARY
He/she can be a 100 level student.
(6) ASSISTANT FINANCIAL SECRETARY
(7) MINISTER OF POWER
(8) MINISTER OF WORKS
(9) MINISTER OF MECHANICS
(10) DIRECTOR OF SPORT
(11) ASSISTANT DIRECTOR OF SPORT
(12) DIRECTOR OF WELFARE
(13) DIRECTOR OF SOCIALS
(14) ASSISTANT DIRECTOR OF SOCIALS
(15) FACULTY CHAPLAIN
(16) INTERNAL AUDITOR

(17) The returning candidate(s) shall not be allowed the same office he/she has held before.

PARLIAMENT CANDIDATES
34. SPEAKER
(1) The Candidate for the Speakership position must possess the following Qualifications:

ARTICLE 9
35. QUALIFICATION OF VOTERS
(1) He /she must be a duly matriculated and registered member of NUESA BIU.
36. VOTING PROCEDURE/SYSTEM
(1) The Election shall be strictly open secret ballot system.
(2) Voting, counting, and announcement of result shall be done at accredited venue of election-
which must be in the Faculty of ENGINEERING.
(3) Only the accredited students will be allowed to vote during the election.
(4) Voting ID shall be assigned uniquely for each student as may be decided by the Electoral
committee;
(5) Election shall start after accreditation of voters.
(6) Names of the candidates shall be displayed on notice board in the faculty 24 hours before such
election takes place.
37. CAMPAIGNS BY ASPIRANTS
(1) All forms of Campaign by Aspirants shall be in a decent and cultured manner, devoid of any
harassment, intimidation and contradiction to any provisions of this Constitution.
(2) Campaigns shall not in any way constitute nuisance or defamation of character of any member
of the Association.
(3) All campaigns must not commence until the ban has been lifted on all offices by the NUESA
BIU Electoral Committee.
(4) Posters of any form of campaign awareness shall not be pasted on painted walls and doors but
restricted to notice boards and bill boards.
(5) Campaign train with music or any form of singing and dancing should not be taken near
classrooms, offices, and laboratories.
(6) All forms of campaign by Aspirants shall end twenty-four (24) hours before the
Commencement of voting.
38. DISQUALIFICATION OF CANDIDATES DURING ELECTION
(1) All candidate(s) that intimidates or attempt to intimidate voter(s) shall be penalized by
electoral committee with twenty (20) votes reduction.
(2) Any fight during election that is traced to a particular candidate by him/herself or his/her
supporters shall attract cancellation of his/her candidature.
39. SWEARING-IN CEREMONY
(1) The Out-going EXCOs shall organize a befitting swearing-in ceremony for the newly elected
officers of the Association, in conjunction with the outgoing PARLIAMENT, Electoral
Committee, and the newly elected officers.
(2) The Oath of Office shall be administered by the outgoing Speaker
(3) Handing over of the Association properties shall be done at the venue of the swearing-in
ceremony by the outgoing president.
(4) Every elected officer, both PARLIAMENT and EXECUTIVE COMMITTEE must attend the
swearing-in ceremony.
(5) The Speaker of the PARLIAMENT (newly elected) shall perform Oath of office to the
honourables thereafter.
40. ELECTORAL MALPRACTICE
(1) Any candidate found guilty of electoral malpractice shall be banned for two (2) years from
such and subsequent elections by the constituted authority.
(2) Where a vacancy occurs in the PARLIAMENT/ EXECUTIVE COMMITTEE, the same shall
be filled by a bye-election conducted in the manner herein before provided.
41. WITHDRAWAL FROM ELECTION
(1) Any candidate willing to withdraw from the election shall do so, in writing to the Returning
Officer, not later than 12 hours before the elections.
(2) A student who has been found guilty of misconduct by a duly constituted authority, and the
student is duly notified shall be disqualified from contesting for any office.
(3) The Chairman of the Electoral Committee shall publish a list of qualified candidates for each
of the offices on all notice boards in the Faculty at least 48 hours before the election date.
(4) Each voter shall be entitled to cast only one vote for each of the offices to be filled.
(5) Every candidate shall nominate two (2) agents at the counting center and submit the names of
each agent to the electoral committee at least 24 hours before election.
(6) Such agent has no right to count votes.
(7) The candidate who obtained the highest number of votes for the particular office shall be
declared the winner.
42. RESIGNATION OF ELECTORAL OFFICER
Any electoral officer willing to resign his appointment shall do so by giving one week resignation
letter notice before resigning.
ARTICLE 10
FINANCE, BUDGET AND AUDIT
43. FINANCE
(1) A majority of voting members of the association may determine reasonable dues and fees
assessed to each member at the beginning of each semester.
(2) Registered student members are required to meet all financial obligations incurred by the
association.
(3) Monies raised by the association through the payment of dues or through fund-raising activities
shall be deposited in the associations account at a financial institution
(4) Every member of the Association shall, in addition to the membership dues, pay any other
dues as may be prescribed by the EXECUTIVE COMMITTEE subject to the approval of the
PARLIAMENT.
(5) The association shall undertake fund raising activities when necessary, but within the limit set
by the faculty authority.
(6) The fund of the association shall be utilized strictly for the purpose of the Association.
(7) Any Association officer who in his official capacity is guilty of impropriety shall be liable for
his/her misconduct to the extent for such improper expenditure.
(8) The Financial Secretary shall make the financial statements of accounts available for the
PARLIAMENT from time to time.
(9) Purchases and Expenses shall be within the limit provided for in the main or supplementary
budget approved by the PARLIAMENT.
(10) The Association shall operate a bank account with Above Only Microfinance Bank with
account number 1100033279, to control all income and expenses transactions by the
Association.
(11) All monies generated into the Account of the Association shall be shared using the prescribed
sharing formula.
(12) The sharing formula shall also be applicable to the disbursement of the Allocations of the
Association.

44. SOURCES OF INCOME


(1) Membership dues to be recommended by the Executive and ratified by the Senate at least one
(1) month before the beginning of a new session.
(2) All donations made to the Association.
(3) All profits accruing from activities organized as well as utilities provided by the Association.
(4) Proceed from any undertaking that the Association may deem fit to embark on from time to
time.
(5) Grants made by the FACULTY
(6) Funds coming into the Association from other sources

45. DISBURSEMENT
(1). The EXECUTIVE COMMITTEE
the annual budget have been approved by the PARLIAMENT.
46. Disbursement of membership dues
(1) All funds from dues of members shall be disbursed among the various arms of the Association
as provided below:
(i) Half (1/2) of the total sum shall be appropriated towards FACULTY and DEPARTMENT
selected activities for the welfare of students within the Faculty of Engineering.
(ii) Half (1/2) of the total sum shall be appropriated towards EXECUTIVE, PARLIAMENT and
the CONGRESS activities for the welfare of students within the Faculty of Engineering.
(2) All funds appropriated towards EXECUTIVE, PARLIAMENT and the CONGRESS activities
referred to in 46 (ii), shall be disbursed among the various arms of the Association as provided
below:
(a) Three-quarter (3/4) of total the sum appropriated towards EXECUTIVE, PARLIAMENT and
GENERAL CONGRESS activities, shall be for the EXECUTIVE COMMITTEE activities.
(b) One-quarter (1/4) of the total sum appropriated towards EXECUTIVE, PARLIAMENT and
GENERAL CONGRESS activities, shall be for the PARLIAMENT and the CONGRESS and
shall be shared as follows:
(i) Four-fifth (4/5) of the total sum appropriated towards PARLIAMENT and the CONGRESS,
shall be for the PARLIAMENT activities.
(ii) One-fifth (1/5) for of total sum appropriated towards PARLIAMENT and the CONGRESS
shall be for the CONGRESS activities
(2) Disbursement of funds in the PARLIAMENT and CONGRESS shall be with the directive of
the Speaker of PARLIAMENT and CONGRESS Chairman respectively in accordance with
the budget of both arms as approved by the SENATE and CONGRESS respectively.
47. Funds may be disbursed for the following:
(1)
(2) Furnishing and maintenance of the Association Secretariat.
(3) Expenses in respect of approved functions of the Association.
(4) Approved capital expenditure in respect of utilities provided by the Association.
(5) Such other expenses as may be recommended by the EXECUTIVE COMMITTEE and
approved by the PARLIAMENT from time to time.
(6) Electoral Commission Secretariat fund covering a budget to that effect presented by the
Commission to the PARLIAMENT for ratification.
48. Procedure for disbursement
(1) The EXECUTIVE COMMITTEE shall meet to agree on any particular disbursement of the
Association . The meeting shall be convened subject to the provisions of the
Constitution on ordinary or emergency meetings.
(2) The following shall be signatories to all withdrawals from the Association
(a) The President
(b) The Financial Secretary
(c) The Staff Adviser
(d) The Faculty Officer
(3) The annual budget after acceptance by the PARLIAMENT shall be presented to the Staff
Advisor for final approval.
(4) The Financial Secretary shall be empowered to keep an impress account of not more than the
amount determined by the PARLIAMENT at its inception.
(5) The Financial Secretary shall be solely responsible for issuing money from NUESA BIU
account.
(6) Copies of the approved budget shall be conspicuously displayed on Faculty notice boards and
other notice boards as may be directed by the PARLIAMENT. Copies shall also be made
available to the Dean Faculty of Engineering for his information.
(7) Once the budget is approved by the PARLIAMENT, no amendment may be made in the
allocation of the Association -approval of the PARLIAMENT.
49. Receipt
(1) Receipts duly signed by the Financial Secretary and stamped shall be made out in
acknowledgement of all funds received by the Association.
(2) Receipts shall be obtained for all demands made from the Financial Secretary.
(3) Receipts shall be made out in triplicate on the official receipt books of the Association and a
copy of the triplicate shall be deposited with the Financial Secretary for his records.
(4) Receipts of expenditure must be submitted to the Financial Secretary within one (1) week of
such transactions (statements of account countersigned by whoever authorized the expenditure
must be submitted where receipts are not possible).
(5) No bills shall be considered for claims without pre information of the EXECUTIVE
COMMITTEE.
(6) Any amount or revenue realized from any venture embarked upon shall be immediately
forwarded to the Financial Secretary; an amount shall be deposited into the Association
account on the next working day. Any expenditure from the Association
kept shall not be honoured and such member of the EXECUTIVE COMMITTEE shall be
made to refund all such amount privately kept.
(7) At every ordinary Executive meeting, the amount of the Association account shall be made
known to members
50. BUDGET
(1) The EXECUTIVE COMMITTEE shall, through the Financial Secretary, present to the
PARLIAMENT a Budget showing estimated income and expenditure for the period not
exceeding one academic year.
(2) Purchases and Expenses more than N2, 000 (two thousand Naira) shall be made out of the
petty cash balance.
(3) Any analytical petty cash book shall be maintained by the Financial Secretary. This shall be
balanced periodically before reimbursement is made.
(4) The Financial Secretary shall present the impress account vouchers to the Audit Committee
every month for internal auditing.
45. AUDIT
(1) The Account of the Association of all categories as the case may be shall be subjected to
interim audit from time to time by the Audit Committee to be set up by the PARLIAMENT
and headed by a member of the committee.
(2) The Head of the committee in sub section (1) above shall be the Internal Auditor.
(3) A final Audit of the accounts of the Association (EXCO and PARLIAMENT shall be
conducted by the Auditor at the end of the tenure of the Association.

ARTICLE 11
COMPOSITION OF COMMITTEES

(3) The PARLIAMENT may also constitute Ad-hoc Committees from time to time whenever it
deems it fit.
(4) Except where specifically stated in the provisions of this Constitution, the Speaker of the
PARLIAMENT shall appoint the Chairman and Secretaries to all Committees.
47. FACULTY/ PROFESSIONAL STAFF ADVISOR
(1) There shall be a full-time academic staff member of the faculty of engineering to serve as
NUESA staff advisor. The advisor shall certify the associa -signing
all checks and vouchers. This statutory requirement of having an advisor is mandatory.
48. ACKNOWLEDGEMENT
(1) Officers of the Association shall, at the end of the tenure of office, be entitled to a Certificate
of Office upon handing over of office in recognition of their service to the Association.
(2) Electoral Committee members shall also be given Certificate of Service upon completion of
all Electoral activities.
(3) Staff advisors shall be entitled to a Certificate of Office upon handing over of office in
recognition of their service to the Association.

ARTICLE 12
DRAFTING OF THE CONSTITUTION
49. DRAFTING
(1) The PARLIAMENT shall have the power to amend any section or sub-section of this
Constitution with the approval of a two-third (2/3) majority of the PARLIAMENT
honourables.
(2) A Constitution Drafting Committee shall be set up, which shall comprise of one member from
each Department.
(3) The Constitution Drafting Committee shall call for memoranda before the Constitution
Drafting.
(4) The proposed Drafting or bill shall be published on all notice boards in the Faculty and
Congress must be summoned for the Adoption through the consent of 2/3 majority of all
NUESA BIU members before the Drafting can be concluded.
ARTICLE 13
INTERPRETATION, CITATION AND COMMENCEMENT
50. INTERPRETATION
(1) The PARLIAMENT shall have the power to interpret this Constitution.
(2) The PARLIAMENT shall have the power to decide on cases where the Constitution is silent.
51. CITATION
This Constitution may be cited as the Constitution of the Nigerian Universities ENGINEERING
BENSON IDAHOSA University Chapter (NUESA BIU) 2021.
52. COMMENCEMENT
The provisions of this Constitution shall come into force immediately after the adoption by the
Congress.
