“RESOLUTION ENACTING AN ORDINANCE REGULATING THE USE OF VIDEOKE
AND OTHER SIMILAR DEVICES AND MACHINES WITHIN THE JURISDICTION OF
CALILLAUAN, SOLANA, CAGAYAN UNTIL 10 PM TO PREVENT DISTURBANCE AND
PROVIDING PENALTIES FOR VIOLATION THEREOF”
WHEREAS, Section 16 of the Local Government Code states that “Every local
Government unit shall exercise the powers expressly granted, those necessarily implied
therefrom, as well as powers necessary, appropriate, or incidental for its efficient and
effective governance, and those which are essential to the promotion of the general
welfare”;
WHEREAS, The Sangguniang Barangay shall maintain peace and order and promote
and preserve the comfort and convenience of their inhabitants;
NOW THEREFORE, on motion of Sangguniang Barangay Member Agustin V. Soriano
duly seconded by the Sangguniang Barangay Member Ashan H. Lovidero and adopted by
the body:

BARANGAY ORDINANCE NO. 03

“AN ORDINANCE REGULATING THE USE OF VIDEOKE AND OTHER SIMILAR
DEVICES AND MACHINES WITHIN THE JURISDICTION OF CALILLAUAN, SOLANA,
CAGAYAN UNTIL 10 PM TO PREVENT DISTURBANCE AND PROVIDING PENALTIES
FOR VIOLATION THEREOF”
SECTION 1. TITLE – This Ordinance shall be known as “AN ORDINANCE REGULATING
THE USE OF VIDEOKE AND OTHER SIMILAR DEVICES AND MACHINES WITHIN THE
JURISDICTION OF CALILLAUAN, SOLANA, CAGAYAN UNTIL 10 PM TO PREVENT
DISTURBANCE AND PROVIDING PENALTIES FOR VIOLATION THEREOF”
SECTION 2. DEFINITION OF VIDEOKE MACHINE – Any equipment or musical
contrivance comprising of a Television set or Monitor, Video Player, Amplifiers, Speaker,
Microphones and any sound system use for sing along whereby lyrics of a song with
accompanying visual backdrops are seen on monitor or screen.
SECTION 3. REGULATED ACT – Any person who operates/uses a Videoke Machine shall
comply with the following:
a. The operation of the Videoke Machine shall operate only from 8:00 am to 10:00 pm.
b. The Videoke Machine is prohibited to operate from 10:01 pm to 7:59 am the
following day.
c. The sound of the Videoke Machine shall not disrupt the neighbors or too loud to
disrupt the people surrounding them who are resting or sleeping.
d. Shouting or yelling or any form of excessive noise using the Microphone of the
Videoke Machine is strictly prohibited.
SECTION 4. EXEMPTION – the prohibitive hours to operate or use the said Videoke
Machine does not apply during Barangay Fiesta, Christmas Eve and New Year’s Eve.
SECTION 5. PENALTY – Violators of this Ordinance are hereby penalized to pay a fine
and community service as follows:
FIRST OFFENSE – WARNING
SECOND OFFENSE - P500.00 AND THREE (3) HOURS COMMUNITY SERVICE
THIRD OFFENSE AND SUCCEEDING OFFENSES – P1000.00 AND THREE (3) HOURS
COMMUNITY SERVICE
SECTION 6 – ENFORCEMENT OF ORDINANCE – Barangay Officials including Barangay
Tanods are hereby authorized to enforce and apprehend violators of this Ordinance.
SECTION 7. REPEALING CLAUSE – Provisions of previous Ordinances, Resolutions,
Enacted and passed by this body are hereby amended and repealed accordingly.

SECTION 8. SEPARABILITY CLAUSE – If any of this Ordinance shall be declared by the
court as null and void, the other portions hereof shall remain valid and legal and in full
effect.
SECTION 9. EFFECTIVITY CLAUSE – This Ordinance shall take effect fifteen (15) days
after its approval and posting in three conspicuous public places.
