JOINT SWORN STATEMENT OF ARREST
WE, PSSg Gil Abdon and Demmy Jose Abug, both of legal ages, residents of
Tacloban City and bonafide PNP members presently assigned with PS-1, Tacloban City
Police, after having been duly sworn to in accordance with law, hereby depose:
That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of judicial
affidavits to serve as the direct examination testimony of a witness, on the basis of which
the adverse party may conduct his cross-examination on such a witness, we hereby
execute this judicial affidavit in a question and answer format;
That conformably with Section 3(b) of the said A.M. No. 12-8-8-SC, we also state
that it was Crime Investigator, PSSg Elibon P Cana. assigned with the Police Station 1,
Tacloban City Police Office (TCPO), who conducted the examination of the undersigned
affiant at Police Station 1.
That also pursuant with section 3(c) thereof, we hereby state under pain of perjury
that in answering the questions asked of me as appearing herein below, I am fully
conscious that we do so under oath and that we may face criminal liability for false
testimony or perjury.
QUESTIONS & ANSWERS
QUESTION 01 : Why are you executing this statement?
ANSWER 01 : To support in filing a criminal complaint as the apprehending
police officers against the suspect for Frustrated Murder and Violation of RA 10591
identified as Jhon Denver Casipong y Malinao, 16 years old, male, single, out of school
youth and a resident of Brgy. 62-B, Kadungganan, Sagkahan, Tacloban City.
Q 02 : When and where the incident happened?
A 02 : On 2:20 PM of February 20, 2023 at Brgy. 64, Bliss, Sagkahan, Tacloban
City.
Q 03 : Will you please narrate in detail how the incident happened which leads you
to arrest them?
A 03 : As police officers it is our main duty to enforce the law, prevent and control
crimes and maintain peace and order. On the stated time and date, were actually engaged
in the performance of our official duties and responsibilities at Police Station 1. At about
3:36 PM of same date our office received a call from a CTOC (City Tactical Operation
Center) informing an alleged shooting incident at Brgy. 64, Bliss, Sagkahan, this City
wherein the complainant was already at the Barangay Hall. We, immediately, on board in
our mobile patrol car and proceeded to the reported area and upon arrival complainant
informed us about the incident and same the identification and whereabouts of the
suspect.
Q 04 : What Happened Next?
A 04 : After knowing the incident without any time to waste together with the complainant
we onboard on our patrol car and immediately proceeded to the house of the suspect
located at Brgy. 62-B, Sagkahan, this City. Upon arrived at the said Barangay the
complainant pointed upon us the house of the suspect and while infront of his house the
complainant saw him in the door wanted to point the gun towards him, I (PSSg Abdon) saw
the suspect holding the improvised handgun and same pointed towards me therein I
immediately draw my service firearm and pointed upon him. Suspect realized our presence
as a Police officer so then he thrown away his firearm and same the ammunition infront of
him and drop into prone position, while I (PCpl Abug) immediately hold and arrest the
suspect while I (PSSg Abdon) confiscated the improvised firearm and same examined and
found out that it was loaded with live ammunition of cal. 5.56 M16 and the other
ammunition of cal. 9mm was thrown by the suspect to the ground. We apprised the
constitutional rights and cause of nature of his arrest in the presence of his sister wherein it
was translated and explain through sign language upon him.
Q 05 : What did you do to the suspect and the confiscated improvised handgun?
A 05 : The suspect and confiscated improvised handgun wrap with black rubber
marked as “JDMC”, and Ammunitions 1 (one)- 5.56 (M16) marked as “JDMC-1” and 1
(one) - Cal.9mm marked as “JDMC-2” were brought to PS-1 for the conduct of
documentation. There, we came to know his personal circumstances as Jhon Denver
Casipong y Malinao, 16 years old, male, single, out of school youth and a resident of Brgy.
62-B, Kadungganan, Sagkahan, Tacloban City
Q 06 : In the meantime, I have no more questions to ask from you, do you have
anything to add from your statement?
A 06 : None at this moment.
Q 07 : Did somebody coerce, threaten or promised you to give any reward in giving
this statement?
A 07 : No one.
Q 08 : Are you willing to sign voluntarily this document consist of three (3) pages?
A 08 : Yes, we are willing.
