TERMS & CONDITIONS
Validity
1 Week from Date of Offer.
Price Basis
Ex-Customer Site, Kuwait.
Our quoted price is based on prevailing structure of custom duty/ Government taxes, any variation to our
cost due to change in customs duty/ Government taxes as a result of Kuwaiti Legislation will be
charged to buyer.
The offered delivery is non-binding and subject to re-confirmation at the time of order acceptance by Al
Bahar.
Payment Terms
25% advance along with order and balance 75% against LC Which shall include the following Clause:
“Beneficiary has to advise openers by telex/fax (Notice) regarding readiness of goods for inspection and
delivery. If openers fail to inspect and take delivery of the goods within seven days from the date of
notice, documents will be accepted for negotiation without the counter signatures of the openers on
delivery note and invoice. In such case above notice should accompany the documents."
In case payments are delayed, interest at the rate of 1% per month shall be applicable from the payment
due date as per agreed payment terms.
In case delivery of the equipment cannot be made due to reason(s) attributable to the buyer, the
payment shall be made on intimation from us that the goods are available for delivery. In case of Non-
Payment a Storage Fee of 1% of order value will be charged per month against all non-collected and/or
non-delivered goods from the date of intimation of goods availability at Al-Bahar Stores.
If the project is substantially delayed / suspended or approval of equipment is delayed due to reasons
not attributable to us, then; price increase shall be applicable on material not ordered and / or not
received.
We reserve the right to hold / stop further works in case payments are delayed & shall not be responsible
for any consequence(s) arising out of such an action.
Delivery

Warranty
Manufacturer standard warranty shall apply for 24 Months/1000 hours whichever occurs first from the date of
Commissioning for Standby Power sets, and is subject to proper storing / normal operation and maintenance of
the equipment as per recommendation. The warranty is however, null and void in case of misuse, damage and
repairs not carried out by Al-Bahar
Insurance
If delivery to site is in Al-Bahar scope then Al-Bahar will arrange transit insurance of the materials upto
buyer stores. If materials are collected from our warehouse then transit insurance shall be arranged by
buyer at their cost.
We will cover W.C. insurance of our labor and staff deputed to site for commissioning purpose, any other
insurance like insurance of the materials at site, erection risks, third party liabilities, risk to existing
properties, etc shall be procured by the buyer at its cost.
Commissioning
Commissioning of the GENSET(s) will be done by our engineers. Our engineer will reach the site for
commissioning on receipt of buyer confirmation that site is ready for commissioning. The GENSET(s) will be
commissioned on available load. In case no load is available, then commissioning will be deemed completed on
the generation of voltage at the generator terminals. Commissioning visit is limited to one (1) visit per Site, any
additional visit will be charged KD. 10/- per hour.
Cancellation
Once order received by us it is not subject to cancellation.
Force Majeure Condition
All the terms and conditions of our offer are subject to force majeure conditions and we shall not be responsible
for any loss, damages or delay of any kind whatsoever due to any cause beyond our reasonable control
amounting to force majeure such as acts of Government, strikes, fire, lockouts, explosion, thefts, floods, riots, civil
commotion, intended destruction and acts of God etc.

LIST OF EXCLUSIONS
1. Civil, Structural Works, Electrical Works, Mechanical Works, Ventilation Works, Acoustic Treatment of
DG set room and any Supply to carrying out these works.
2. Supply and Installation of Air Intake and Radiator Air Exhaust Louvers, Air Filters, Ventilation Fans.
3. Miscellaneous installation material like supports/ clamps/ fire Extinguishers/ shock charts/ rubber mats/
lightning arrestors/ first aid kits.
4. Equipment, tools, erection devices, welding rods and all consumable materials required for site erection.
5. Installation of all supplied Electrical items like Pump Control Panel, Switchgear (Synchronizing Panel)
etc.
6. Supply of ATS / MTS, Motor Control Centers, Feeders and distribution boards etc.
7. Air-conditioning for control / power room.
8. Design, Supply and Installation of earthing system including earth pits, earth strip.
9. Factory Witness Test or Third Party Inspection related expenses like traveling, lodging, boarding etc.
10. Any expenses for services of third party for witness test / inspection of equipment.
11. Day Fuel Tank,Main Fuel Storage Tank, Fuel Transfer Electric Pump, Pump control Panel, Level
Indicator and Fill Panel.
12. Supply of Diesel including first fill of diesel fuel and Load Bank for testing & commissioning at site.
13. Operation / Maintenance of DG Set / Class Room / Training Factory.
14. All Special material required for Shelter Installation like Blast door, Blast valve, special spring Isolators
with supports, cross beams if required.
15. Any Spare Parts / Tools.
16. Necessary approvals from Government Bodies like KWT Environment Authority/MEW /MPW/KNPC/KFD
and obtaining fuel filling permit from KNPC.
17. Technicians, Support personnel at site which are required to assist Al-Bahar Commissioning Engineer
during installation audit & commissioning.
18. Storage and Preservation of equipment at site prior to commissioning.
19. Any supply, which is not specially listed in our offer.
